Subiect:
Request for authorization to transfer funds for the design and modification of the existing
traffic signal at the intersection of California Street and Base Line Street.
Backl!l"ound:
The San Bernardino City Unified School District has submitted a request that the City design
and construct a modification to the existing traffic signal at the intersection of California Street
and Base Line Street. This intersection currently has signal controls on the north, east, and
west legs, but there is no control on the south leg. The School District is requesting that the
City modify the signal to control the south leg of the intersection. See location map (Exhibit
A).
The reason for the requested signal modification is to allow the School District to construct its
primary access driveway to align with the south leg of the intersection. The driveway
construction will be accomplished entirely by the School District, subject to design approval by
the City.
It was originally anticipated that State Street could be constructed from Base Line Street to
approximately 1,000 feet south of Base Line Street in time for the opening of High School No.
5 in September of 2000. This would have allowed the School to take its main access from the
newly constructed State Street. A funding shortfall and a conflict with existing high voltage
electric transmission lines has delayed the completion State Street. Because of these problems,
it is not anticipated that State Street will be constructed in time to meet the District's timetable
for opening the new High School.
At the November 1, 1999 Council meeting, Staff was directed to evaluate a private property
owner's proposal to design and construct a portion of State Street with an understanding that
the cost of the project, including right-of-way, might be reimbursed to said property owner at
some later date. It was proposed that these improvements could be accomplished within the
District's necessary time frame and preclude the need for traffic signal modifications at the
intersection of California Street and Base Line.
The results of that evaluation are as follows:
1) The preliminary design submitted for Staff review appears feasible with the revisions
recommended during plan check. More definitive review will be necessary during the fmal
design process, including the approval of an Engineer's Estimate, which could serve as the
basis for any reimbursement agreement between City and Property Owner.

2) It does not appear to be feasible to utilize Federal/State Aid funding to reimburse a private
property owner for costs associated with a road improvement project as proposed.
3) It is possible, through a simple reimbursement agreement, for the City to reimburse a
private property owner for infrastructure costs considered above and beyond those required
of his/her development.
4) In order for the City to commit to reimbursing the property owner for costs associated with
State Street, it is anticipated that the Mayor and Common Council would have to
reprioritize projects already established in the 5-year Capital Improvement Program (CIP),
or make a commitment to include the reimbursement in the CIP within some future time
threshold.
5) School District representatives continue to express a strong concern with the primary
access to the new school passing beneath the high voltage lines en route to State Street (see
follow-up letter attached).
In the attached letter, the School District has asked the City to commit $65,000 to modify the
signal. Due to age of the existing signal, we feel that $65,000 may only cover construction
cost and, therefore, additional funds are being requested to cover design, construction
inspection and contingencies. The estimated costs are as follows:

Financial Imuact:
A total of $536,000 was carried forward as part of the FY 1999-2000 CIP in Account No. 129-
367-5504-7060 (State St. from 9"' to Baseline--Grade, pave and install traffic signal). Staff
proposes to transfer $85,900 of the State Street monies to California at Base Line Street traffic
signal modification. Staff would propose to restore these funds to the State Street account as
part of the FY 2000-2001 CIP.
Recommendation:
That the Mayor and Common Council Authorize the Director of Finance to Transfer $85,900
from Account No. 129-367-5504-7060 (State St from 9th to Base Line - grade, pave and install
traffic signal) to fund the modification of the existing traffic signal at the intersection of
California Street and Base Line Street, Account NO. 129-367-5504-7182.

Dear Mr. Casey:
The San Bernardino City Unified School District wants to thank you and T. "Jarb" Thaipejr, for
reviewing the proposed State Street access for the new high school, as proposed by Mr. Norm
Johnson.
While the District supports the future development of State Street, the District at this time can
not support providing access for the new high. school - from State Street. There are two major
reasons:
I. HEALTH & SAFETY - While there is no current report stating that students passing
under the high power Southern California Edison transmission lines are in danger of
electric magnetic fields, the District does not want to expose the students to any
unforeseen danger. The area residents have already expressed their concern about
various environmental issues at the new site. The District does not want to aid to the
community concerns. ,
2. EASEMENT & TIMING - Southern California Edison has restricted all construction
beneath the transmission lines. There is a concern that street elevations would not allow
the ;:vr.stnlcticn of the street, much less the daily access of vehicles. underneath the
transmission lines (proper clearances would not be achieved). Additionally, the time
frame to obtain the necessary construction easements and relocate and elevate the
transmission lines - could not be in time for the opening of school.
At such time, when the District and the community could be given assurances about the
environmental safety of the students traveling under the transmission lines, and the
development/relocation of the driveway has Qccurred (with proper height elevations), would the
District consider using State Street as an access point for the new high school.

The following is a staff assessment of ,yfr. Johnson's proposal to design/construct a portion of
State Street between 16th and Sth Street:
I) Preliminarv Desi!ffi: Staff has reviewed the Engineer's preliminary design an'::.
although the proposed fill along the westerly edge of the right-of-way (ROW) wil!
be costly to construCt, we find the design to be generally feasible. In addition.
:o.!r. Johnson's design does not adequately address the long term circulation nee.:.s
in that area of the City. Ultimately. the bridges proposed North of FoothilLS~"
will be necessary to provide a continuous \'orthSouth collector between proposed
Route 30 and Route 10 in order to fully address the circulation needs in the area.
The next logical step in the process would be for :o.!r. Johnson to commission tinal
design engineering which he has not done to date. The design would include a
cost estimate adequate to form the basis for a reimbursement agreement. Some
assessment should also be made with respect to this property owner's
responsibility toward mitigating the impacts associated with the present and future
development of his property, served by the proposed State Street, based on a
traffic study provided by him. The plans and estimate should be reviewed and
ultimately be approved by staff. In addition, the property owner's intended
alignment at State Street and 4th/5th warrants special consideration in conjunction
with the other proposals in this area.

3) TiminlliPriorities: In order for the City to commit to reimbursing the property
owner for costs associated with State Street, it is anticipated that the Mayor and
Common Council would have to reprioritize projects already established in the
5-year Capital Improvement Program (CIP), or make a commitment to include the
reimbursement in the CIP within some future time threshold.
4) School District: The Council's decision on the District's proposal is a separate
issue from staffs evaluation of Mr, Johnson's proposal. The School District has
expressed their opposition to utilizing State Street as their primary access to the
new high school (see attached) in either alignment. It has a relatively minor
impact on the overall funding available for the State Street project.
In conclusion, although staff has determined that it is possible for the Mayor and Common
Council (MCC) to move forward toward a reimbursement agreement with Mr, Johnson for the
design/construction of a portion of the proposed State Street project. Until additional
engineering work is completed on the project by Norm Johnson's engineer, a reliable cost
estimate can not be developed. ~!r. Johnson, however, has indicated that in order to continue
with the final engineering for this project he would need some level of commitment from the
MCC.

prior to beginning reimbursement procedure, the project mLlSt be programmed in !:he
Federal State-Wide Transportation Improvement Program (FSTIP) and formally
authorized (approved) by the Federal Highway Administration (FffI,VA) for Federal
funding. .-\fter the project is approved for funding, the local agency is responsible for
initiating the "Request for ApprovaLAuthorization to Proceed" and obtain approval prior
to starting any item of work. Any work performed prior to authorization is ineligible for
reimbursement.
At the present time. the State Street project IS m the Federal State-wide Transportation
Improvement Program, but it has not been selected and programmed for the Surface
Transportation Program (STP) funding. Therefore, it is not eligible for reimbursement from
Federal funds at this time.
The request for new projects to be financed by STP funding is scbeduled for September 2000.
We have planned to resubmit the State Street project at that time.
Again. any works performed prior to approved authorization to proceed are not eligible for
Federal FlD1ding and can not be used as local mlltrhn,g funds.

Request for Continuance to 12/06/99 - Authorization to transfer funds for the design and
modification of the existing traffic signal at the intersection of California Street and Base Line
Street.
Backeroond:
The San Bernardino City Unified School District submitted a request that the City design and
construct a modification to the existing traffic signal at the intersection of California Street and
Base Line Street. This intersection currently has signal controls on the north, east, ~ west
legs, but there is no control on the south leg. The School District is requesting that the City
modify the signal to control the south leg of the intersection. See location map (Exhibit" A").
The request was heard on October 4, 1999, and continued at the request of Councilwoman
Anderson until November I, 1999, to allow more time to explore other options.
A letter (See Exhibit "B") has been received from the San Bernardino City Unified School
District requesting that the item be further continued until December 6, 1999. This
continuance is supported by staff as it will allow us to evaluate the proposal presented by Mr.
Johnson at the meeting of October 18, 1999, and provide a coordinated response.
Financial Imllf'rt:
There will be no fmancial impact to the City due to this continuance.

Backlrround:
The San Bernardino City Unified School District has submitted a request that the City design
and construct a modification to the existing traffic signal at the intersection of California Street
and Base Line Street. This intersection currently has signal controls on the north, east, and
west legs, but there is no control on the south leg. The School District is requesting that the
City modify the signal to control the south leg of the intersection. See attached letter (Exhibit
"A") and location map (Exhibit "B").

The reason for the requested signal modification is to allow the School District to construct its
primary access driveway to align with the south leg of the intersection. The driveway
construction will be accomplished entirely by the School District.. subject to desig~ approval by
the City.
It was originally anticipated that State Street could be constructed from Base Line Street to
approximately 1,000 feet south of Base Line Street in time for the opening of High School No.
5 in September of 2000. This would have allowed the School to take its main access from the
newly constructed State Street. A funding shortfall and a conflict with existing high voltage
electric transmission lines has delayed the completion of plans for State Street. Because of
these problems, it is not anticipated that State Street will be constructed in time to meet the
District's timetable for opening the new High School.
In the attached letter, the School District has asked the City to commit $65,000 to modify the
signal. Due to age of the existing signal, we feel that $65,000 may only cover construction
cost and, therefor!:, additional funds are being requested to cover design, construction
inspection and contingencies. The estimated costs are as follows:

Financial Imoact:
A total of $536,000 was carried forward as part of the FY 1999-2000 CIP in Account No. 129-
367-5504-7060 (State St. from 9111 to Baseline - Grade, pave and install traffic signal). Staff
proposes to transfer $85,900 of the State Street monies to California at Base Line Street traffic
signal modification. Staff would propose.to restore these funds to the State Street account as
part of the FY 2000-2001 CIP.
Recommendation:
That the Mayor and Common Council Authorize the Director of Finance to Transfer $85,900
from Account No. 129-367-5504-7060 (State St from 9111 to Base Line - grade, pave and install
traffic signal) to fund the modification of the existing traffic signal at the intersection of
California Street and Base Line Street, Account NO. 129-367-5504-7182.

The District's fif'.h high school is now under construction. As originally designed,
primary vehicle access to the site was from a proposed extension of State Street. For
various reasons, the City's State Street project is not scheduled to be completed in the
near future.

As a result, the District has agreed to fund a private road for access to the site by
extending California Street south of Base Line Street. The San Bernardino City Unified
School District requests that previously budgeted City funds of approximately $65,000.00
for State Street traffic signals be used for the design and installation of traffic signals at
the intersection of California Street and Base Line Street to service the vehicle traffic for
the new high school site.

The following is a staff assessment of Mr. Johnson's proposal to design/construct a portion of
State Street between 16th and 5th Street:
I) Preliminarv Design: Staff has reviewed the Engineer's preliminary design and.
although the proposed fill along the westerly edge of the right-of-way (ROW) will
be costly to construct, we find the design to be generally feasible. In addition,
Mr. Johnson's design does not adequately address the long term circulation needs
in that area of the City. Ultimately, the bridges proposed North of Foothil1/5tll
will be necessary to provide a continuous North/South collector between proposed
Route 30 and Route 10 in order to fully address the circulation needs in the area"
The next logical step in the process would be for Mr. Johnson to commission final
design engineering which he has not done to date. The design would include a
cost estimate adequate to form the basis for a reimbursement agreement. Some
assessment should also be made with respect to this property owner's
responsibility toward mitigating the impacts associated with the present and future
development of his property, served by the proposed State Street, based on a
traffic study provided by him. The plans and estimate should be reviewed and
ultimately be approved by staff. In addition, the property owner's intended
alignment at State Street and 4th/5th warrants special consideration in conjunction
with the other proposals in this area

3) TiminlZlPriorities: In order for the City to commit to reimbursing the property
owner for costs associated with State Street, it is anticipated that the Mayor and
Common Council would have to reprioritize projects already established in the
5-year Capital Improvement Program (CIP), or make a commitment to include the
reimbursement in the CIP within some future time threshold.
4) School District: The Council's decision on the District's proposal is a separate
issue from staffs evaluation of Mr. Johnson's proposal. The School District has
expressed their opposition to utilizing State Street as their primary access to the
new high school (see attached) in either alignment. It has a relatively minor
impact on the overall funding available for the State Street project.
In conclusion, although staff has determined that it is possible for the Mayor and Common
Council (MCC) to move forward toward a reimbursement agreement with Mr. Johnson for the
design/construction of a portion of the proposed State Street project. Until additional
engineering work is completed on the project by Norm Johnson's engineer, a reliable cost
estimate can not be developed. Mr. Johnson, however, has indicated that in order to continue
with the final engineering for this project he would need some level of commitment from the
MCC.

At your request, I have researched the procedure for obtaining reimbursement from Federal Aid
Funding for the State Street project.
The following is my finding:
Under Chapter 3, "Project Authorization", of the Local Assistance Procedure Manual,
prior to beginning reimbursement procedure, the project must be programmed in the
Federal State-Wide Transportation Improvement Program (FSTIP) and formally
authorized (approved) by the Federal Highway Administration (FHW A) for Federal
funding. After the project is approved for funding, the local agency is responsible for
initiating the "Request for Approval/Authorization to Proceed" and obtain approval prior
to starting any item of work. Any work performed prior to authorization is ineligible for
reimbursement.
At the present time, the State Street project is in the Federal State-wide Transportation
Improvement Program, but it has not been selected and programmed for the Surface
Transportation Program (STP) funding. Therefore, it is not eligible for reimbursement from
Federal funds at this time.
The request for new projects to be financed by STP funding is scheduled for September 2000.
We have planned to resubmit the State Street project at that time.
Again, any works performed prior to approved authorization to proceed are not eligible for
Federal Funding and can not be used as local matching funds.

While the District supports the future development of State Street, the District at this time can
not support providing access for the new high. school - from State Street. There are two major
reasons:
