GLs-~ Council Notes: F' ce ~ I~-~ Agenda Item No. I~+/ ~~1~1~9 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Resolution of the City of San Bernardino awarding a service agreement and an annual purchase order in an amount not to exceed $288,392 to the Wackenhut Corporation for jail operations. BACKGROUND: Cti December 18, 1995, Resolution #95-437 was adopted authorizing the Police Department to contract with the Wackenhut Corporation to provide jail operations for the «ry jail, pursuant to Bid #F096-13. The contract was for one yeaz with two possible one-yeaz extensions based upon performance. On July 6, 1998, Resolution #98-197 was adopted authorizing the Police Department to extend the contras and annual purchase orders with the Wackenhut Corporation for jail operations until June 30, 1999. On June 21, 1999, Resolution #99-148 was adopted authorizing the Police Department to extend the contras and annual purchase order #99-2249 with the Wackenhut Corporation until December 31, 1999, to allow sufficient time to re-bid the contras for jail operations. Police Department staff worked with the Purchasing Division to develop appropriate bid specifications to re-bid the contras for jail services. On August 4, 1999, request for bids #F-00-23 was distributed to four potential vendors and advertised in The Sun newspaper, with a submission due date of September 14, 1999. The Wackenhut Corporation was the only respondent to the request for bids. The bid price of $288,392 for FY 99/00 is $8,392 or 3°~ higher than the Annual Purchase Order of $280,000, which was issued to the Wackenhut Corporation for FY 98/99. Therefore, it is recommended that the Ciry awazd a service agreement and an annual purchase order with the Wackenhut Corporation Awarding of a service agreement and an annual purchase order to the Wackenhut Corporation will allow the continued operation of these vital services without interruption. The purchase order will be for one year with the option of two one-yeaz extensions, and will commence on January 1, 2000. Contracting out these services has proven to be cost effesive and efficient. The Department's efficiency would be negatively impaled by the loss of the jail staffing as other city employees would need to be hired or rediresed to assume these duties on a regular or overtime basis that would exceed the cost of the jail services. FINANCIAL IMPACT: The Police Department's adopted budget for FY 99/00 includes $288,400 for contractual jail services under Account #001-228-5505 ~ail/Professional Services). We anticipate expending $142,194 of these funds by December 31, 1999 for continued jail operations pursuant to Resolution #99-148. The re*+,a;n;ng budgeted funds amounting to $146,206 will be sufficient to cover the jail staffing costs with the Wackenhut Corporation for the remaining six months of FY 99/00. WHEREAS, CITY has need for Jail Operations Services and, 6 B. WHEREAS, CONTRACTOR is competent, experienced and able to perform 7 said services: and, g C. CITY retains the right to challenge all or any part of an 19 invoice. 20 4. The policies 11 shall name the CITY as an additional insured and shall provide for ten (10) day notification 12 to the CITY if said policies aze terminated of materially altered. 13 14 CONTRACTOR shall perform work tasks as directed by the San Bernazdino Police 15 Depaztment, but for all intents and purposes, CONTRACTOR shall be an independent 16 contractor and not an agent or employee of the CITY. 17 8. In the performance of this Agreement and in the hiring and recruitment of employees, 18 CONTRACTOR shall not discriminate on the basis of race, creed, color, religion, sex, 19 physical handicap, ethnic background or country of origin. 20 9. These offices comprise the California District. Each office is equipped with experienced, qualified management personnel responsible to provide ongoing recruiting, staffing, training, supervision, security consulting, and general operational overview. The Riverside Office will assume overall responsibility for the management and supervision of The City Of San Bemardino's account. The Riverside office has been in operation since 1970, currently serves over 65 clients and has an associate base of four hundred security officers. Sturm, Vice President, Califomia District. Mr. Sturm came to Wackenhut after a twenty year career as an officer in the U.S. Army. His career was spent in the Special Operations and Counter-terrorism business. To recruit individuals to meet the stringent requirements of our CPO program, Wackenhut uses college employment services, military bases and reserve centers, trade magazines, employee referrals, local newspapers, and state and private employment agencies. The selection process begins with the applicants completing the standard Wackenhut Application for Employment form. The Application for Employment allows us to secure, from prospective employees, the background information needed to make sound employment decisions. It meets the nondiscriminatory requirements of both the Civil Rights Law and the Executive Orders issued for government contractors. The Personnel Clerk reviews the application carefully to ensure that the applicant has answered all questions. Some applicants may leave a question unanswered because they do not understand it, while others may intentionally avoid answering because they do not want to discose the information. Each application received is reviewed immediately for this purpose and the applicant will be instructed to provide additional responses as necessary to comply with instructions on the form. 7 1999-323 The next stage of the process is the initial interview with the Manager of Physical Security. During the interview, the application will be reviewed with the applicant, with special attention given to all items relative to minimum qualifications for employment and particularly those marked during the initial review of the completed forms. Additionally, the applicant will lie observed for personal grooming and appearance, health, maturity, oral communication, and apparent interest in the position. Any documentation of claimed training, experience, or other achievements will be requested at this time. The applicant will be questioned regarding any apparent discrepancies on the application, gaps in employment history, etc. At this time, those applicants found to be unqualified for employment with Wackenhut will be so advised and the reason thereof. Those who are found qual~ed will be advised of this decision and subsequently have a background check performed. The background check for the Custom Protection Officer will include the following: * EmolovmenUQualificetions Verification -Contact all employers for the previous 7 years to verify employment and verify that the applicant has not been terminated for other than honorable circumstances. We also verify health, education, periods of employment, etc. This is accomplished by telephone or letter. * Neighborhood or Reference Checks -Contact at least 2 additional persons who are not relatives for character references in an effort to establish the reliability and trustworthiness of the individuals. * Police Records Check -Verification that the candidate does not have a criminal record. This is conducted through our on line data base and at the courts. * Credit History -Conduct credit review of candidate to determine financial responsibility. Interview all raters who have given a negative review. * Druo Test - A annual drug screen will be conducted by a certified laboratory. * MMPI - A MMPI (Personality Inventory) will be conducted by a certified psychologist. * DMV - A check will be conducted to insure officer has a valid California drivers license and is current and in good standing. * Education - A check will be conducted to insure officer has a valid high School diploma or equivalent. S 1999-323 ~w* Upon receipt of the results of the investigation, the Investigator will forward the information to the Manager of Physical Security who will review the report and all other data available to determine whether adequate information exists to schedule a final interview. If insufficient data is received, additional investigations will be initiated, or he applicant will be re-interviewed regarding discrepancies or missing data. Employment Procedure Upon completion of the background investigation and determination that the applicant is suitable for employment, the Manager of Physical Security will present the applicant's file to the Area Manager for a final interview. This interview proceeds along the same lines as the initial interview with attention given to personal grooming and appearance, health, maturity, oral communication skills, and apparent interest in the position. If the applicant passes this phase, he/she is extended a bonafide job offer (subject to satisfying the Conditions of Employment), and if accepted, will continue the employment process. This will include the following: ' Instruction and testing of the required California Powers of Arrest program. Submission of fingerprint cards and application for licensing to the Department of Consumer Affairs. ' Passing the required training. Evaluation During the first ninety days of employment each employee, including retained incumbents, will be in a probationary status to ensure job suitability. THE WACKENHUT TRAINING INSTITUTE The Wackenhut Training Institute (WTI) is the training division of The Wackenhut Corporation. It was established for the purpose of developing sophisticated training curricula, lesson plans, audio-visual aids, and platform training expertise to support the Corporation's operational missions. The Wackenhut Training Institute also offers its training expertise to proprietary firms, governmental agencies, and competitive companies on a contractual basis. Throughout the past 20 years, Wackenhut has been extensively involved in establishing and maintaining a wide variety of security, safety, and law enforcement training programs for Wackenhut employees and for client personnel. An estimated 100,000 persons have been trained in various aspects of industrial security, fire protection, industrial safety; motivation, supervisory, and management techniques; and secretarial, clerical, and other skills. Training has been provided in formal classroom sessions, seminars, field exercises, and on-the job application by WTI instructors using Wackenhut-developed training and operational manuals, handbooks, audio-visual presentations, and technical reference data. Wackenhut's staff of training professionals at its Corporate headquarters is continually involved in maintaining, updating, and expanding the various training programs. This staff supports Wackenhut's operations units in their training requirements, but is also available to our clients, on a contractual basis, for any additional training programs. The Wackenhut Corporation strives to provide its clients with personnel who will perform beyond expectations. The new Security Officer is introduced to the job through an forty (40) hour'dass room course' on the duties and responsibilities of the City Of to 1999-323 Rialto Police Department's policy & procedures, including the eight (8) hour "Title 15° requirement . An additional minimum of sixteen= (16) hours of 'On-The-Job' specific training and eight (8) hours of quarterly remedial training. Training includes the following: 1. The quality of our professional security services stem from our insistence on development and administration of meaningful training plans and programs. The activation of those programs requires a training policy which has the unreserved endorsement and active support of a company's executive management; a training plan which is designed to effectively meet the specific needs of the client; lesson outlines and support material which reflect state-of-the-art; and a professional staff of instructors who effectively impact the trainees so that they are technically prepared to handle their assigned duties with performance excellence. The program must also motivate properly trained employees through superior leadership and first-line supervision to assure that the end result is a high quality service product. Every officer in The Wackenhut Corporation receives basic training in security procedures. Basic training, however is not sufficient for the superior cadre of security personnel who wear the CPO uniform. For them nothing short of a cemprehensive forty (40) hour classroom training program will suffice. Students are encouraged to ask questions. SECURITY OFFICER HANDBOOK FAMILIARIZATION AND TESTING A Wackenhut Security Officer Manual is issued to each newly hired individual and the employee is instructed to read and become familiar with the manual's contents. Employees are advised that a test will be administered on the contents of the manual by the Training Director. The answer sheet is placed in the employee's personnel file and the examination results are entered on the 'Training Report for Security Officers". 3. SITE/POST TRAINING After employment, each individual will receive hours on-the job training conducted by a Supervisor and/or Training Director. The training will consist of, but is not limited to: pertinent information regarding The. City Of San Bernardino; review of special and post orders; shift hours and schedules; alarm systems; fire extinguisher locations; ingress and egress controls; client and TWC reports; emergency telephone numbers; and any other instruction necessary to properly insure that the new Security Officer can handle this assignment properly. On-the job training will be recorded on the Wackenhut Training Report for Security Officers and placed in the individual's personnel file. 13 1999-323 ~ QUALITY ASSURANCE Quality Assurance Wackenhut's Quality Assurance Program is designed to provide you with the greatest level of performance for your security investment. We can provide coordinated services for a single location or many locations nationwide. This reduces the time and effort required to meet your needs and/or expand programs. Acknowledging that our services must complement your overall security posture, we have developed a special Client Relations Program in which you will be asked by our Corporate Headquarters to evaluate our job performance. Your comments, which will be periodically solicited in the form of a brief questionnaire, will enable us to be totally responsive to your needs and also identify ways to improve our services. Should corrective action be necessary to resolve a situation which you feel adversely impacts on your security posture, afollow-up procedure has been established by our Corporate Headquarters to monitor and confirm the adequacy of our remedial action. Area Managers monitor, supervise, and visit each facility on a monthly basis, or as often as regwred, to ascertain any recommendations and/or suggestions for improvement of security and solution of any personnel problems. One of the major responsibilities of the Wackenhut Manager is to maintain close relations with appropriate The City Of San Bemardino's representatives and subordinate Wackenhut personnel to assure that services provided by the Company are in accordance with the expectations, and policies/procedures of The City Of San Bemardino. Wackenhut's account supervision will be delegated the authority to provide services in accordance with terms of the contract for such services and as otherwise directed by The City Of San Bemardino, in an efficient, effective manner. As such, the Account Manager shall provide the single point of contact through which all ContractoNThe City Of San Bemardino communications, work, and technical direction shall flow. Wackenhut pledges to maintain its contract performance on the highest priority level. It is Wackenhut policy on all major protective services to designate a Senior Corporate Quality Assurance Officer. It is the responsibility of that individual to conduct periodic management quality assurance reviews of the entire project and to inquire into the satisfaction of the client. In the event of major technical problems with any service or deliverables provided under this contract, this individual will have the authority to direct additional resources to the contract. - As representative of the interest of Wackenhut in The City Of San Bemardino's project, Mr. George Zeiss, Vice President, Client Relations, will be the designated Corporate Quality Assurance Officer for the proposed effort. Wackenhut will 14 1999-323 I , develop, implement, operate, and maintain a Quality Control Plan designed to optimize effective and responsive security services in support of The City Of San Bemardino's property. The Quality Control Plan will establish standards of performance and provide a reporting and evaluation system that will assist the Wackenhut Account Manager and Area Manager to identify problem areas and improve performance. The Quality Control Plan also will insure that security force operations are coordinated, integrated, and accomplished in the most efficient, proficient, and cost-effective manner possible. Specific objectives of the Quality Control Program will ensure that: All requirements of the contract are fully implemented and maintained. " Supplies utilized and services performed are subject to inspection and control. Each Supervisor is assigned clear and specific responsibilities and performance standards. ` Objective assessment of service is accomplished through inspections. Data, trends, and actions taken are recorded and analyzed to insure contract compliance and improve performance. Statistical planning and analysis of procedures are accomplished to determine program effectiveness. All administrative procedures, reports, and records are integrated, coordinated, complete, and current. All required reports are complete, accurate, and timely. The Account Manager will be responsible for the daily quality control activities, to include personnel qualifications and performance; suitability, quantity, and quality of equipment, materials, and supplies; accurate reports, records, budgetary and financial data in compliance with all contract requirements; and professional and on-time services. Wackenhut is committed to excellence in the providing of security services and will provide a high standard of quality assurance. Commitment to quality begins with making key decisions; investments of time, money and resources uo-front vs. reaction to problem resolution in the past tense. In an international corporation such as Wackenhut, a team effort is required if good service is to result. Managers at the wrporate level establish the standards and guidelines of performance to ensure that required resources are supplied down-line to the local level of operation. Local management must be able and willing to achieve the standards that have been established. The Wackenhut Riverside Office is awaiting the opportunity to exercise the Wackenhut advantages for The City Of San Bernardino. 15 1999-323 UNIFORMS UNIFORM MAINTENANCE PROGRAM Wackenhut provides a complete complement of uniforms for all of our employees at no cost or deposit to the individual. They are required to maintain their uniforms in neat and orderly manner at all times. Wackenhut pays for all cleaning of uniforms. A copy of the Uniform Brochure is provided at the end of this Section. The standard uniforms available for use at The City Of San Bernardino is located on the last page of the brochure (with soft insignia, no rank). These uniforms are well suited for patrolling and access control, easily recognizable as security, and generally project authority. We are willino to customize a uniform as Iona as it meets the state regulations. There should be no additional cost unless the desioNuniform are too extravaoant/costly. Not only will Wackenhut issue the required number of uniforms, we also encourage the officer to maintain a professional appearance. Formal inspections by the Account Manager and Shift Supervisors will identify those uniforms in need of replacement, repair, or new issue. Additionally, officers are encouraged to exchange uniforms showing unsightly wear or stains. Newly issued and replacement uniforms are provided at no cost or deposit to the employee. Proper wearing of the uniform presents an image of authority while aiding in public relations and creates a sense of responsibility in the Security Officer position. 16 1999-323 • i BILL RATES BILL RATES 8 FRINGE BENEFITS Wackenhut has developed what we believe is a comprehensive wage, incentive and fringe benefit plan included in the below bill rate. The following package will allow us to attract and retain a competent and well motivated security force. Please note, however, that we remain flexible with regard to the exact composition of these benefit plans and would welcome the opportunity to discuss ways to improve upon them. The plan pays 80°~ of 17 1999-323 reasonable and customary covered medical expenses after the satisfaction of a $500 per person calendar year, all Gause deductible. Life-time maximum benefit per person is $250,000 plus a $50,000 annual cap. $1,000 Life Insurance ($500 if age 70 or over). $1,000 Accidental Death and Dismemberment ($500 if age 70 or over). Employees age 70 and over, eligible for Government Medicare, are eligible only for the life insurance and accidental death and dismemberment parts of the above coverage in the reduced amounts shown. Dependent Coverage -Three Month Waiting Period The employee has the option of including dependents, spouse under 70 and unmarried children from birth to age 19, and from 19 to 23 if they are attending school as a full- time student during that period of time, for the $500 Deductible Comprehensive Medical Coverage. Each member in the family will be covered for payment of 80°r6 of any reasonable and customary medical expenses after each member has satisfied the $500 calendar year, all clause deductible. This is an overall maximum benefit for each family member the same as the deductible. This coverage is at the employee's expense through payroll deductions. Additional GfOUD Life Insurance -Three Month Waiting Period Eligible employees also have the option of selecting an additional $2,000 life insurance ($1,000 if age 70 or over), $2,000 accidental death and dismemberment insurance ($1,000 if age 70 or over), through payroll deductions. This is in addition to the life insurance and accidental death and dismemberment paid by the company described under "Basic Coverage on Employee" above. These amounts and premiums, therefore are reduced 50% on all life insurance and accidental death and dismemberment when the employee reaches age 70. Vacation Policy We will offer all full-time personnel (40 hours per week) accrue paid vacation. This will also act as an incentive to retain officers and avoid tum over. To the extent practical and consistent with operational requirements, employees will be permitted to take vacation consistent with their preference but in accordance with the period scheduled by Wackenhut. Employees are eligible to take their vacation upon completion of their first year of employment. Consistent with California Labor Law, an employee who leaves the company prior to one (1) year service, but after a 90-day probationary period, will receive monetary compensation for vacation time accrued. 18 1999-323 HOLIDAYS TWC recognized holidays for hourly employees shall be: ' New Years Day 'Labor Day " Memorial Day 'Thanksgiving Day * Independence Day * Christmas Day Employees required to work on these days will be paid at time and one half rate. We will be glad to include any client holidays not on the list. SAVINGS PLAN 401(K) This summary highlights the main features of the 401 (K) Plan for employees of The Wackenhut Corporation. It is not intended to provide a complete plan description. Eligible Emolovees: When employees have completed one year of service, they are eligible to participate, providing they are not already a participant in another Company- sponsored 401 (K) Plan. Years of service with any affiliated or subsidiary company of Wackenhut will be recognized. Emolovee Contributions: Employees can contribute 1 °k to 20% of their compensation to the plan on a payroll deduction basis. The maximum contribution is $7,000 per year. The contribution will be on a pre-tax basis. The earnings will be tax deferred until distributed. Vesting: Employees are always 100% vested in their contributions and the earnings on their contributions. Death Benefits: If an employee should die, the beneficiary will receive full payment of all funds and earnings in the employee's account as of the date of death. Disability Benefits: If an employee becomes disabled and qualifies for benefits under the Social Security Act, the full amount of the employee's account becomes available to supplement Social Security or the money can remain in the account for future needs. Remaining funds will be credited with investment earnings. Normal Retirement: The normal retirement date is age 65. Earlv Retirement: When an employee has ten years of service, he can request early retirement at age 55 and after. Retirement Benefit: When an employee retires, he will be entitled to the full amount in their account at the time of retirement. 19 1999-323 i Retirement Ootions: (Either early or normal retirement.) Options available under the plan include: 1) Case. 2) Life Annuity. 3) Life Annuity with 10-year Certain. 4) Joint Survivor Annuity. (If the employee is married when the benefit is payable, he must elect this option unless his spouse agrees othervvise.) In-Service Withdrawals: Withdrawal of any of an employee's pre-tax contributions is permitted, providing he has a legitimate financial hardship approved by the Administrative Committee. Loans: Participants can borrow against their pre-tax contributions, subject to the limits imposed by the Internal Revenue Service. The principal may be no more than the smallest following amounts: * $50,000 ;or * the vested portion of all the employee's accounts; or 'the greater of $10,000 or 50°~ of the vested portion of all the employee's accounts. Repayment must be made over a five year period and interest will be charged at a reasonable rate. Investments: The funds will be invested in a competitive guaranteed interest contract with an insurance company. EMPLOYEE INCENTIVE PROGRANt The Wackenhut Corporation offers many programs which recognize the pertormance, service, longevity, etc. of its employees. The criteria for such nomination will involve: * Appearance * Attendance * Attitude * Job Performance The Senior Vice President, Domestic Operations will convene a panel and select the Officer of the Quarter. The person selected will be awarded a $100 U.S. Savings Bond. From the selected Officers each quarter, the panel will select the Officer of the Year, who will be awarded a $500 U.S. Savings Bond. 20 1999-323 l Wackenhut Service Awards Employees are recognized for various years of service (5, 10, 15, 20, 25, and 30) with the Company. Service awards (gift or pin selection) are present each month to the employee in a,- dignified, appropriate ceremony. Photographs will appear in the "Wackenhut Pipeline". W-Valor (Outstanding Servicel Award Occasions may arise when a member of the Wackenhut Security Force at your facility performs a noteworthy service such as saving another person's life, apprehending a criminal, thwarting an intrusion, etc. Such meritorious action will be recognized. Besides an appropriate certificate and a sterling silver W-Valor pin, the recognition will also provide a monetary award of $50 to $250, as deemed appropriate by the Wackenhut District Manager. Incentive Award TWC employees are recognized for outstanding or unusual performance of duty by formal certifications of appreciation, recognition, and distinction. 21 1999-323 INSURANCE PROGRAM INSURANCE The Wackenhut Corporation has what it believes to be the most comprehensive program available in today's insurance market. The program covers the parent Corporation and all domestic subsidiaries. Coverage is written by one of the nation's largest insurance companies. A resume of our portfolio follows for your consideration. Coverage COMPREHENSIVE GENERAL AND AUTOMOBILE LIABILITY POLICY GENERAL LIABILITY 1. Bodily Iniurv and Property Damage Liabilitv -Covers legal liability for bodily injury and property damage arising out of an occurrence involved in the operations of The Wackenhut Corporation; limits of $5,000,000 combined single limit and $5,000,000 aggregate. 2. Personal Iniurv Coverage -Covers legal liability for damages resulting ftom personal injury including; but not limited to, false arrest, false imprisonment, detention, libel and slander, malicious prosecution, invasion of privacy, wrongful eviction or wrongful entry, mental injury, mental anguish, shock, defamation of character, discrimination; limits of $5,000,000 combined single limit and $5,000,000 aggregate. 3. Independent Contractor's Protective Liabilitv -Covers legal liability for either bodily injury or property damage to others arising out of the operations of independent contractors who are subcontractors of The Wackenhut Corporation; limits of $5,000,000 combined single limit and $5,000,000 aggregate. 4. Client Property Coverage -Covers legal liability for loss or injury to or destruction of property of the client entrusted to The Wackenhut Corporation caused by dishonesty or negligence of its employees; limits of $5,000,000 combined single limit and $5,000,000 aggregate. 5. Errors and Omissions Coverage -Covers legal liability for losses from errors, omissions, or negligent acts of employees of The Wackenhut Corporation in the conduct of its business; limits of $5,000,000 combined single limits and $5,000,000 aggregate. 7. Comarehensive Automobile Liability -Covers legal liability for bodily injury and property damage arising out of the ownership, maintenance, or use of any vehicle utilized in connection with the operations of The Wackenhut Corporation; limits of $5,000,000 combined single limit for bodily injury and property damage. WORKER'S COMPENSATION Workers Compensation and Employer's Liability Insurance covers all employees of The Wackenhut Corporation in every state allowing Worker's Compensation Insurance to be written by an Insurance Company. In those few states requiring State Fund Insurance, The Wackenhut Corporation is a subscriber to the state program. BONDING In lieu of bonding its employees, The Wackenhut Corporation provides insurance coverage for dishonest acts under its Broad Form Property Endorsement Policy inclusive of base coverage of $5,000,000.
