BACKGROUND: On November 22, 1999, this office received an application for the vacation of a portion of Lexington Way, southwesterly of Hallmark Parkway. A developer representing the property owner of the property located on the East Side of Lexington Way, at its southerly terminus submitted the request. The owner, Doane Processing Company, is in the process of acquiring the property on the West Side of Lexington and would like to expand the present business, which is a pet food manufacturing company, to include both parcels. Since Lexington Way terminates at his property, the applicant felt that this portion of Lexington Way would no longer be needed as a public right of way. The applicant has submitted one half of the processing fee as required. If authorization to proceed is given, all property owners along Lexington Way, Southwesterly of Hallmark Parkway, will be notified of the proposal, although only the applicants property would be directly affected. If the proposal is approved, the applicant will construct and dedicate a new cul-de-sac just above the vacated area. The area proposed for vacation and the proposed dedication is shown on the attached plan, which is also being submitted for approval. All City departments and utilities will be notified of the proposal for comments or conflicts with any existing utilities. The applicant has stated that there are several utilities within the area proposed to be vacated and these will be relocated as part of the development. FINANCIAL IMPACT: None. Applicant has paid the first half of the processing fee and will pay the remainder prior to the legal proceedings.
