Penman, City Attorney December I, 1999 December 20, 1999 Ordinance of the City of San Bernardino Adding Section 10.16.240 of the San Bernardino Municipal Code relating to Parking on Unpaved Surfaces. Currently, San Bernardino Municipal Code ~ 15.24.040(A)(5) makes it unlawful for any person to park a vehicle on an unimproved surface. Currently, to cite such a violation, Code Compliance Officers must contact the owner and provide himlher with a Notice to Appear or file a Long Form Complaint against the alleged violator. This new ordinance will allow Code Compliance Officers to issue parking control notices and place them on the offending car. This will streamline the process and allow Code Compliance to address the problem in a far more efficient manner. The following proposed new SBMC section mects two goals: (I) prevent the parking of motor vehicles on dirt/yards; and (2) making it more efficient for Code Compliance Officers to enforce. It is therefore recommended that the attached proposed section 10.16.240 be adopted. SMMltbm[IOJ6240.sr] 1 ORDINANCE NO. 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION 3 10.16.240 RELATING TO PARKING VEmCLES ON UNPAVED PARCELS OF REAL PROPERTY 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 10.16.240 is hereby added to the San Bernardino Municipal Code to read as follows: 7 Section 10.16.240 Parking on Unpaved Parcels of Real Property. 8 A. A person shall not stop, stand or park a vehicle on any unpaved parcel of real 9 property; provided however, that nothing in this section shall be construed to prevent the parking of a vehicle in a residential zone on an unpaved driveway or a drive approach to a garage or other 10 durable or permanent driveway or pad installed for the purpose of parking such vehicle on a parcel of real property which is not subject to Section 19.24.060(18) of the City of San Bernardino 11 Development Code at the time of violation. 12 B.
