DescriPtion) Finance: Council Notes: 75-0262 :J/~tJfL Agenda Item No. /0 - - . , CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution of the City of San Bernardino confirming cost of abatements and imposing liens on certain parcels of real property located within the City of San Bernardino for the cost of the abatement of public nuisances (building abatements). Background: Chapters 8.30.110 and 8.30.130 of the San Bernardino Municipal Code authorize the city to recover costs against certain properties for the abatement of nuisances. The City's Code Compliance Division has deemed the properties listed on Exhibit "A" (attached) to be a nuisance. Due notice was given to the person or persons having an interest in said properties. A hearing was held by the Hearing Officer to hear protests and to assess the costs of abatements. The Hearing Officer has entered its order determining the cost to be reasonable and proper, and imposing a lien upon the property involved. Notice of the right to appeal to the Board of Building Commissioners has been issued to all affected property holders. This action is to confirm the imposition of liens. City Clerk shall administratively remove any properties from Exhibit "A" which have been paid within five days following the mailing of notice. Financial Impact: None Recommendation: Adopt resolution. o o o 23 24 25 26 27 28 RESOLUTION NO. ~ 1 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COST OF 2 ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE 3 COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (Building Abatements) 4 5 6 7 8 9 10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The City of San Bernardino, pursuant to its authority under San Bernardino Municipal Code Chapter 15.28 and other laws, did lawfully cause public nuisance abatements on the real property described in Exhibit "A", attached hereto and incorporated herein by reference as though fully set forth. If said sum is not fully paid to the City Clerk, City Hall, San Bernardino within five (5) days after mailing a notice to the person or persons having an interest in said property informing said person or persons of the adoption of this resolution 'as to any such individual parcel, then said sum shall be and become a lien on said property pursuant to said Municipal Code provisions and applicable laws and shall be collected as a special assessment thereon. SECTION 4. In the event said sum is not paid as hereinabove provided, the City Clerk is hereby directed to file a certified copy of this resolution with the Auditor of the County of San Bernardino, State of California, directing that sum to be entered as lien charges against said property as it appears on the current assessment rolls, to be collected as the same and in the same manner, subject to the same penalties and interest upon delinquencies, as the general taxes for the City of San Bernardino are collected. The City Clerk shall present for recording appropriate notices of the imposition of these liens with the County Recorder.
