REQUEST FOR COUNCIL ACTION STAFF REPORT Subiect: Resolution awarding contract to Valley Slurry Seal Compauy for slurry sealing of various streets, Phase IX per PIau No. 10041 (Areas "C" aud "0"). Back2round: Each year au allocation is made in the 126 Gas Tax Fund aud in the 129 'I2-cent Sales Tax Fund for the rehabilitation of various streets within the community. In a joint effort, the Departments of Development Services aud Public Services review aud recommend streets for rehabilitation. Factors considered are traffic volumes, condition of street, construction method to be used, service life of pavement, improvements to be realized with the rehabilitation method aud availability of funding. The areas selected for the ninth phase of this project include the two residential areas shown in Exhibit "A", which are "C" aud "0". Area "C" is located north of 40th Street, east of Mountain View Avenue aud west of Waterman Avenue. Area "0" is located south of 40th Street, north of Lynwood Drive, east of Harrison Street aud west of Sterling Avenue. For reference purposes we are also attaching Exhibit "B" which is a summary of locations where slurry sealing has been completed as part of the currently approved program. The Departments of Development Services aud Public Services have reviewed the streets shown in Exhibit "A" aud have determined that significaut useful life remains for this pavement, provided restoration aud rehabilitation is completed in the near future. These streets have been rated "average" under the City's rating system aud, therefore, will benefit from this process. These areas aud the streets within them meet the criteria established for the slurry seal program. Considering the condition of the existing streets, the life cycle aualysis shows that slurry seal is the most appropriate aud cost effective method of restoring these streets aud extending their useful life . This project consists of sealing cracks, grinding raised areas smooth, cleauing the street aud then applying a slurry seal that restores aud seals the street against moisture. Bids were received for the project from six (6) contractors on Jauuary 18, 2000, as indicated on the attached summary of bids. Valley Slurry Seal Compauy submitted the lowest bid. This compauy has previously performed slurry-sealing work for the City aud completed it in au acceptable manner. This project is scheduled to begin the second week of March aud to be completed in May. The project costs are as follows: Construction Cost $440,140 Desi2n, Contract administration & insoection (10% .:!:.) $ 44,000 Subtotal $484,140 Contin2encies (14 % .:!:.) $ 65,860 Total Proiect Cost $550,000 Financial Imoact: All costs incurred for this project will be charged to the $550,000 allocated in the 1999/00 CIP budget under V2-Cent Sales Tax Account No. 129-367-5504-7159 (Citywide Pavement Rehabilitation). There will be no balance remaining in this account at the conclusion of this project. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO VALLEY SLURRY SEAL COMPANY FOR SLURRY SEALING OF VARIOUS STREETS, PHASE IX PER PLAN NO. 10041, AREAS "C" and "D". BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Valley Slurry Seal Company is the lowest responsible bidder for Slurry Sealing of Various Streets. Phase IX Per Plan No. 10041, Areas "C" and "D". A contract is awarded accordingly to said bidder in a total amount of $440,140.00 but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of the passage of the resolution.
