Description) Finance: Council Notes: Agenda Item No. 316 J.../~ [)D CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: General Plan Amendment No. 99-04/Conditional Use Permit No. 99-14 Mayor and Common Council Meeting of February 22, 2000 BACKGROUND: Moss San Bernardino Properties recently acquired a surplus parcel from the Flood Control District. They request approval of a General Plan Amendment to change the land use designation on the 7.6:!: acre parcel from PFC, Public Flood Control, to CG-l, Commercial General. The applicant also requests approval of a Conditional Use Permit to expand the existing Moss Bros. Dodge and allow for future expansion of an auto dealership and related commercial uses. The current site is approximately 4.1 acres and will encompass approximately 11.7 acres with the additional acreage. (See Exhibits A and B.) The expansion includes construction of an addition to the showroom, remodeling and expansion of the service bays, construction of a parts storage warehouse, landscaping, and construction of a vehicle storage area and a freeway-adjacent display area. An Initial Study was prepared to address the change in land use designation and proposed and future expansion, and a Mitigated Negative Declaration proposed. No comments were received during the public review period that extended from October 21, 1999 through November 10, 1999. The Planning Commission reviewed the project at its January 11, 2000 meeting and unanimously recommended approval. Commissioners Adams, Durr, Enciso, Garcia, Lockett, Ramirez, Thrasher, and Welch were in attendance. Refer to the Planning Commission staff report (Exhibit C) for further discussion. FINANCIAL IMPACT: No cost to City; the applicant submitted the application processing fees. RECOMMENDATION: Staff recommends that the Mayor and Common Council close the public hearing and adopt the Mitigated Negative Declaration and Mitigation Monitoring Program, approve General Plan Amendment No. 99-04 and Conditional Use Permit No. 99-14 based on the Findings of Fact, subject to the Conditions of Approval and Standard Requirements. I REOUEST AND LOCATION The applicant reque&ts approval of a General Plan Amendment to change the land use designation of approximately 8.3 acres from PFC, Public Flood Control to CG-l, Commercial General. Moss Brothers recently acquired approximately eight acres of property adjacent to their existing auto dealership. The property previously was used by County Flood Control, but was no longer necessary for flood control purposes. Moss Brothers purchased the property to expand their auto dealership operation and provide more area for on site storage of vehicles. Conditional Use Permit 99-14 is a proposal to expand the existing auto dealership to allow an additional 1,446 square feet to the showroom, a new covered canopy, remodel existing service bays and add 800 square feet of space, construct a new 21,427 square foot, two-story parts warehouse, and pave approximately 300,000 square feet for additional parking and storage of vehicles, which includes freeway frontage. This Conditional Use Permit will also allow for the future expansion of auto dealership and related uses with an approved Development Permit. Any additional expansion would need to meet development standards for the CG-l, Commercial Generailand use designation such as maximum lot coverage, parking, landscaping, and design review, but the Development Permit would not require further approval by the Planning Commission at a public hearing. The project is located on the west side of South 'E' Street, north of Orange Show Road in the PFC, Public Flood Control and CG-l, Commercial General land use designations. SETTING/SITE CHARACTERISTICS , The site is comprised of approximately 11.7 acres. The existing auto dealership occupies 3.4 acres and the remainder includes the 8.3-acre expansion area. The Public Works Division issued a permit to fill the new portion to an even grade and cover it with gravel. Adjacent to the site to the west is Interstate 215; to the north is the Warm Creek Channel and across that, the Inland Center Mall; general retail and commercial uses are to the south and across 'E' Street to the east. BACKGROUND The Development Review Committee (DRC) initially reviewed the project on September 21, 1999. An Initial Study was prepared and presented to the Environmental Review Committee (ERC) on October 14, 1999. After the required 21-day public review period, no comments were received regarding the proposed Mitigated Negative Declaration and at the November 18, 1999 ERC/DRC meeting, the project was cleared to the Planning Commission. FINDINGS AND ANALYSIS GENERAL PLAN AMENDMENT 99-04 - A request to change the land use designation of approximately eight acres from PFC, Public Flood Control to CG-l, Commercial General. 1. Is the proposed amendment internally consistent with the General Plan? \.... - Conditional Use Permit. 99-14/ General Plan Amendment 99-04 Meeting Date: January 11. 2000 Page 3 ( t. General Plan Objective 1.19 is to "Provide for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents. .." The property was previously used by County Flood Control, but is no longer necessary for their purposes. 'E' Street is a major commercial corridor, and the Commercial General designation is appropriate to achieve the General Plan objective discussed above. 2. Is the proposed amendment detrimental to the public interest, health, safety, convenience, or welfare of the City? The proposal would allow the property to be developed for commercial retail purposes. The development proposal meets all applicable provisions of the Development Code, and will be constructed and operated in conformance with all applicable City and State requirements, as such, it will not pose any threat to the public health, safety and welfare of the citizens of San Bernardino. 3. Does the proposed amendment maintain the appropriate balance of land uses within the City? The property is adjacent to other commercial uses and is no longer needed for flood control. The General Plan Amendment does not impact the balance of land uses within the City. 4. Is the subject parcel physically suitable (including, but not limited to, access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation and anticipated land use development? , All agencies responsible for reviewing access, and providing water, sanitation and other public services have had the opportunity to review the proposal, and none have indicated an inability to serve the project as an auto dealership or related commercial uses. The site meets the minimum requirements of the Development Code in regards to lot size, access, and circulation for the CG- 1 land use designation. All future development that would be permitted on site must also conform to all Development Code standards. CONDITIONAL USE PERMIT 99-14 - A request to expand an existing auto dealership and allow future expansion of auto dealership and related uses on the remainder of the property with an approved Development Permit. I. Is the proposed use conditionally permitted within, and not impair the integrity and character of the subject land use district and complies with all of the applicable provisions of this Development Code? .~~ A portion of the project site is located in the PFC, Public Flood Control that does not permit auto dealership and related uses. However, these uses are permitted in the CG-l designation subject to a Conditional Use Permit pursuant to Development Code Sections 19.06.030(2)(0). As such, Conditional Use Permit. 99-14./ General Plan Amendment 99-04 Meeting Date: January /1, 1000 Page 4 (0 approval of the associated General Plan Amendment will alleviate the project's inconsistency with the General Plan. The proposed project complies with all applicable provisions of the Development Code as shown in Table 'A' below. Any future expansion will be reviewed for consistency with the Development Code through a Development Permit. General Plan Objective 1.19 states that it is the objective of the City of San Bemardino to: , "Provide for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents. . ." The expansion of the existing auto dealership will provide additional services for residents and visitors. It is at an appropriate location along the 'E' Street corridor. 3. Is the approval of the Conditional Use Permit for the proposed use in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030(6) of the Development Code? A Mitigated Negative Declaration and Mitigation MonitoringIReport Plan is proposed for the Conditional Use Permit and General Plan Amendment. The applicant will need to secure a "Letter of Map Amendment" from the Federal Emergency Management Agency to remove the property from the flood zone' A' designation prior to submitting plans for future building expansion. The current plans for expansion of the facility will not have a significant impact on the environment. l. + Freeway Corridor Overlay Conditional Use Permit. 99-14 / General Plan Amendment 99-04 Meeting Date: January II, 2000 Page 5 " ( 4. Are there potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored? As noted on the Summary page and in Finding #3, a Mitigated Negative Declaration is proposed for this project. The mitigation measures wiIl reduce all potential environmental impacts to a level ofIess than significant. 5. Is the location, size, design, and operating characteristics of the proposed use compatible with the e;tisting andfuture land uses within the general area in which the proposed use is to be located and will not create significant noise, traffic or other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the public interest, health, safety, convenience, or welfare of the City? The Conditional Use Permit wiIl allow expansion of an existing auto dealership and this use is considered to be compatible with other surrounding uses. The project has been reviewed by the appropriate departments and agencies and is not anticipated to cause significant noise, traffic or other conditions that may be detrimental. The Conditional Use Permit wiIl allow future expansion on the subject property with a Development Permit. Any proposal for further expansion wiIl be evaluated for compliance with all Development Code standards. Parkin!! The Development Code requires I space each 400 square feet of showroom and office, I space for every 2,000 square feet of outdoor display area, I space for each 500 square feet for vehicle repair, plus I space for every 300 square feet of the parts department. Based on these requirements, 172 parking spaces need to be provided, and 210 are proposed. A majority of the spaces in the front half of the property are for auto display and are not counted toward the available total. A large area beyond the parking area is proposed as car storage on alc paving. This area wiIl be used to store vehicles for sale, but is not accessible by the public. This area does not count toward required parking nor is it used to calculate the total parking requirement. , Landscaoin!! The Development Code requires that 15% of the parking area be landscaped. The project provides for a ten foot landscaped setback, which does not currently exist. Additional landscape planters will be provided adjacent to the customer parking near the front along 'E' Street. The site is with the Freeway Corridor Overlay that requires a 25-foot landscaped setback next to the freeway right-of-way, which is depicted in the site plan in the area for car storage. The total landscaped area is 25,288 square feet. Landscaping is proposed only in customer parking areas visible from 'E' Street, and adjacent to the freeway. Other proposed parking areas not visible from 'E' Street wiIl not be landscaped. ~. Conditional Use Permit. 99-14 / General Plan Amendment 99-04 Meeting Date: January II. 2000 Page 6 ( 6. Is the subject site physically suitable for the type and density/intensity of use being proposed? The site is physically suitable for the type and density/intensity of the project being proposed as evidenced by project compliance with all applicable Development Code Standards as noted above. The site is also suitable for future expansion of auto-related uses. 7. Are there adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety? All agencies responsible for reviewing access, and providing water, sanitation and other public services have all had the opportunity to review the proposal, and none have indicated an inability to serve the project. The proposal will not be detrimental to the public health and safety in that all applicable Codes will apply to the construction and operation of this project. CONCLUSION The proposal meets all the necessary Findings of Fact for approval of the General Plan Amendment, Development Code Amendment, and Conditional Use Permit. ,. RECOMMENDATION Staff recommends the Planning Commission recommend that the Mayor and Common Council: , 1. Adopt the Mitigated Negative Declaration and Mitigation MouitoringIReporting Plan, and; 2. Approve General Plan Amendment 99-04 and Conditional Use Permit No. 99-14, based upon the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval (Attachment C) and Standard Requirements (Attachment D). ~~ Michael E. Within two years of development approval, commencement of construction shall have occurred or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null and void. PROJECT: CONDITIONAL USE PERMIT NO. 99-14 EXPIRATION DATE: TWO YEARS FROM MAYOR AND COMMON COUNCIL ACTION 2. The review authority may, upon application being filed 30 days prior to the expiration date and for good cause, grant a one-time extension not to exceed 12 months. The review authority shall ensure that the project complies with all current Development Code provisions. 3. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City, its officers, agents and employees from any claim, action or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City of any costs and attorneys' fees which the City may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. , 4. Construction shall be in substantial conformance with the plan(s) approved by the Director, Development Review Committee, Planning Commission or Mayor and Common Council. Minor modification to the plan(s) shall be subject to approval by the Director through a minor modification permit process. Any modification which exceeds 10% of the following allowable measurable design/site considerations shall require the refiling of the original application and a subsequent hearing by the appropriate hearing review authority if applicable: a. On-site circulation and parking, loading and landscaping; b. Placement and/or height of walls, fences and structures; c. Reconfiguration of architectura1 features, including colors, and/or modification of finished materials that do not alter or compromise the previously approved theme; and, d. A reduction in density or intensity of a development project. *Amended per Planning Commission on 1/11/00. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no change of use ofland or structure(s) shall be inaugurated, or no new business conunenced as authorized by this permit until a Certificate of Occupancy has been issued by the Department. A temporary Certificate of Occupancy may be issued by the Department subject to the conditions imposed on the use, provided that a deposit is filed- with the Department of Public Works prior to the issuance of the Certificate, if necessary. The deposit or security shall guarantee the faithful performance and completion of all terms, conditions and performance standards imposed on the intended use by this permit. 6. This permit or approval is subject to all the applicable provisions of the Development Code in effect at the time of approval. This includes Chapter 19.20 - Property Development Standards, and includes: dust and dirt control during construction and grading activities; emission control of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design and control; noise control; odor control; screening; signs, off-street parking and off-street loading; and, vibration control. Screening and sign regulations compliance are important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. 7. Signs are not approved as a part of this permit. Prior to establishing any new signs, or replacing existing signs, the applicant shall submit an application, and receive approval, for a sign permit from the Planning Department. , 8. Future expansion of the auto dealership and related uses, such as auto sales, showroom, auto repair, parts department and other auxiliary uses on the entire subject property shall be subject to approval of a Development Permit Type II. * 9. Prior to issuance of a building permit for future building expansion on the freeway adjacent lot, the applicant shall provide a "Letter of Map Amendment" from the Federal Emergency Management Agency (FEMA) confirming removal of the property from Flood Zone A. 10. All fencing materials shall conform to the Chapter 19.20 of the Development Code. Barbed wire, razor wire and electrified fencing are prohibited and shall be removed immediately. * 11. The storage of vehicles shall occur only on an improved surface. Permits for the vehicle storage area paving and related landscaping shall be obtained within 30 days of Mayor and Conunon Council action. Work shall be completed within 4 months of permit issuance. The south end of the property designated as gravel shall not be used for vehicle stOrage, display or parking except temporarily while construction work on the adjacent portion is underway. 12. All parts, accessories, etc., shall be stored within a fully enclosed structure. *Amended per Planning Commission on 1/11/00. All customer and employee parking shall be on-site and not on 'E' Street. 15. Noise from bells or loudspeakers shall not be audible beyond the property line at liny time. 16. No vehicle service or repair work shall occur except within a fully enclosed structure. 17. This permit or approval is subject to the attached conditions or requirements of the following City Departments or Divisions: a. Department of Development Services - Public Works Division b. They may be submitted prior to submittal of Building Plans. 1. Drainaae and Flood Control a) A permit will be required from the Department of Transportation and Flood Control if any work is required within the Flood Control District's right-of- way. / ( b) A local drainage study will be required for the project. Any drainage improvements, structures or storm drains needed to mitigate downstream impacts or protect the development shall be designed and constructed at the developer's expense, and right-of-way dedicated as necessary. , c) All drainage from the development shall be directed to an approved public drainage facility. If not feasible, proper drainage facilities and easements shall be provided to the satisfaction of the City Engineer. d) If site drainage is to be outletted into the public street, the drainage shall be conveyed through a parkway culvert constructed in accordance with City Standard No. 400. Conveyance of site drainage over the Driveway approaches will not be permitted. e) Applicant shall mitigate on-site storm water discharge sufficiently to maintain compliance with the City's NPDES Storm Water Discharge Permit Requirements. DISCUSSION OF SPECIFIED CHECKLIST RESPONSES I a) The proposal will change the land use designation of approximately 8 acres from PFC, Public Flood Control to CG-l, Commercial General. This land was previously used by Flood Control, but was sold as it was considered surplus. Surrounding properties on the north, south, and east are all zoned commercial. Interstate 215 is located to the west. The change of zone will be consistept with surrounding uses. ill c) Dust and erosion may result temporarily during grading and construction of the site. These impacts are less than significant and will be mitigated by proper grading and erosion controls as outlined in Municipal Code Chapter 15 and the City of San Bernardino Department of Public Works Grading Policy and Procedures including the preparation of a truck routing plan. All parking of vehicles will be done on improved surfaces. i) The project is located within an area identified by the General Plan as having high liquefaction susceptibility. Proposed development in areas of liquefaction susceptibility are subject to the requirements of MC-676 for submission of liquefaction studies with appropriate mitigation prior to the issuance of building permits. Potential impacts are not significant. IV e) The northwest section of the recently aquired land is within flood zone 'A' (areas subject to flooding by a l00-year flood) as determined by the Flood Insurance Rate Map. The development of structures within areas designated flood zone 'A' is not permitted. Future development on these sections of the parcel will require a redesignation of the flood plain by the Flood Insurance Administation of the Federal Emergency Management Agency. No development within the affected areas is currently proposed. Mitigation Measure 1. Prior to submittal of building plans for the approximately 8 acre site, the applicant shall secure a IS 13 CITY OF SAN BERNARDINO PLANNING AND BUILDING SERVICES r INITIAL STUDY "letter of map amendment" from the Federal Emergency Management Agency to remove the property from the flood zone 'A' designation. VI a) The project bas the potential to cause additional vehicular trips. Most of the increase in floor area is for a parts warehouse which will not generate additional vehicle trips. An increase in the parking areas and storage areas on site will reduce to the need to store vehicles off-site and having- employees shuttle the inventory of vehicles onto the site - thus having the potential to decrease the number of vehicle trips. Additional vehicle trips may also be created by the change in land use designation of approximate 8 acres from PFC. Public Flood Control to CG-l. Commercial General. A portion of this area is proposed as new parking for the existing auto dealership. The remaining 6.2 acres will be split between vehicle storage and an unimproved slag area. The maximum building density allowed by the General Plan is 0.7 FAR. which would allow 189.050 square feet of new floor area. The area will most likely be developed as a new model line to the existing facility. Based on the existing building density of .28 FAR. the undeveloped section would yield 75.620 square feet of new building area. The City's traffic engineer bas reviewed the project and determined that the additional trips are not sufficient to cause a significant impact on the adjacent street system and that total traffic volume will be less than the street design capacity. IX. Auto related uses generally involve the use. storage and sale of such toxic materials as POL's. lubricants, degreasers. solvents and other like compounds. These types of materials are classifies! as hazardous materials under State law and require special permitting by the San Bernardino County Department of Environmental Health Services (DEHS). The applicant will be required to prepare a Hazardous Materials Disposal "Business Plan" to assure that emergency services personnel and employees are able to respond effectively should an accidental spill or an emergency related to hazardous materials occur on the site. A copy of the Business Plan must be maintained on the site and copies must be submitted to the Fire Department and the DEHS. Adherence with these requirements will mitigate impacts to below a level of significance. XI. The project will have a minor impact on municipal services including fife, medical aid. police, solid waste. and the maintenance of public roads. San Bernardino as it implements mitigation measures for a change in land use designation of approximately 8 acres from PFC, Public Flood Control to CG-I, Commercial General and a Conditional Use Permit to allow expansion of an existing auto dealership and the future expansion of auto dealership uses on currently undeveloped land proposed by the Moss San Bernardino Properties. This Program has been prepared in compliance with the California Environmental Quality Act (CEQA) and the State and City CEQA Guidelines. CEQA Section 21081.6 requires adoption of a reporting and/or monitoring program for those measures or conditions imposed on a project to mitigate or avoid adverse effects of the environment. The law states that the monitoring or reporting program shall be designed to ensure compliance during project implementation. The Mitigation MonitoringlReport Program (MMRP or Program) contains the following elements: I. The mitigation measures are recorded with the action and procedure necessary to ensure compliance. The program lists the mitigation measures contained within the Initial Study. , 2. A procedure for compliance and verification has been outlined for each mandatory mitigation action. This procedure designates who will take action, what action will be taken and when, and to whom and when compliance will be reported. 3. The Program contains a separate Mitigation Monitoring and Compliance Record for each action. On each of these record sheets, the pertinent actions and dates will be logged, and the City of San Bernardino will retain copies of permits, correspondence or other data relevant. 4. The Program is designed to be flexible. As monitoring progresses, changes to compliance procedures may be necessary based upon recommendations by those responsible for the Program. If changes are made, new monitoring compliance procedures and records will be developed and incorporated into the Program.
