August 6, 2007 -
Mayor and Council unanimously adopted MC-1253, an Urgency Interim Ordinance
of the City of San Bernardino Establishing a Temporary Moratorium on the
Establishment and Operation ofNew ParoleelProbationer Group Homes, Registered
Sex Offender Group Homes and Unlicensed Group Homes, Declaring the Urgency
Thereof, and Taking Effect Immediately.
August 20, 2007 -
Mayor and Council considered an Ordinance adding Section 19.06.070 to the San
Bernardino Municipal Code (Development Code ) and Prohibiting the Establishment
and Operation of New ParoleelProbationer Group Homes and Unlicensed Group
Homes, and continued this matter to a workshop at a date and time to be
determined.
September 17, 2007 - Mayor and Council adopted MC-1256, an urgency ordinance which extended the
temporary moratorium by ten months and fifteen days.
October I, 2007 -
Mayor and Council adopted MC-1257, a non-urgency regular ordinance which
extended the temporary moratorium by ten months and fifteen days.
Recommended motions:
A. That said Urgency Ordinance be adopted.
B. That said non-urgency Ordinance be laid over for final adoptio .

THE ESTABLISHMENT AND OPERATION OF NEW

OFFENDER GROUP HOMES AND UNLICENSED GROUP
HOMES.
On August 6, 2007, the Mayor and Conunon Council unanimously adopted Ordinance No.
MC-1253, "An Urgency Interim Ordinance of the City of San Bernardino Establishing a Temporary
Moratorium on the Establishment and Operation of New Parolee/Probationer Group Homes,
Registered Sex Offender Group Homes and Unlicensed Group Homes, Declaring the Urgency
Thereof, and Taking Effect Inunediately." Ordinance No. MC-1253 was adopted by the Mayor and
Council based on documentary evidence and testimony presented at the Council meeting regarding
the over-proliferation of registered sex offenders and parolees living within the City; the increasing
numbers of parolee/probationer group homes, registered sex offender group homes, and other State
licensed and unlicensed group homes located in the City's single family residential neighborhoods;
and growing concern expressed by City residents regarding the significant adverse impacts caused
by these uses on the surrounding residential neighborhoods. Ordinance No. MC-1253 and the
Request for Council Action, Staff Report, and other documents and public testimony previously
submitted to the Mayor and Council in support of said Ordinance are hereby incorporated within this
Staff Report by this reference.
After Ordinance No. MC-1253 was adopted, City officials continued to study and discuss
appropriate regulations to address the over-proliferation of registered sex offenders and parolees
living within the City; the increasing numbers of registered sex offender group homes,
parolee/probationer group homes, and other State licensed and unlicensed group homes; and the
significant adverse impacts caused by these uses on the surrounding residential neighborhoods.
These matters were discussed at the Legislative Review Conunittee meeting on August 7, 2007 and
again at the Council Meeting on August 20, 2007. The Mayor attended the League of California
Cities, City Attorneys Department Conference Program presentation in Sacramento on September
7, 2007, entitled "Transitional Housing/Group Home Complaint Investigations" by Greg Priamos,
City Attorney for Riverside, which was patterned after San Bernardino's successful closures of
illegal parolee housing in 2002.

On September 17 and October 1, 2007, the Mayor and Council adopted Ordinance Nos. MC-
1256 and MC-1257, respectively, an urgency ordinance and a non-urgencyreguJar ordinance which
extended the temporary moratorium by ten months and fifteen days. Ordinance Nos. MC-1256 and
MC-1257, and the Request for Council Action, Staff Report, and other documents and public
testimony previously submitted to the Mayor and Council in support of those two Ordinances are
hereby incorporate within this Staff Report by this reference. Since that time, the Mayor has
appointed Superior Court Judge Tara Reilly, Councilmembers Wendy McCarnmack, Rikke Van
Johnson, and Tobin Brinker, and the Mayor to a Parolee Reentry Ad Hoc Committee for the purpose
of discussing how to control and improve services for parolees and probationers.
According to the California Attorney General's website on Megan's Law
(www.meganslaw.ca.gov). as of July 16, 200S, there are 459 registered sex offenders living within
the City and abutting County islands, more than any other city in the County of San Bernardino.
Attached as Exhibit A iu Table ofRegisteredSexOffender Statistics as ofJuly 16, 200S, derived
from information on the Attorney General's Megan's Law website and the United States Census
Bureau, which compares San Bernardino to the cities of Fontana, Ontario, Rialto, Yucaipa,
Redlands, Highland and Colton. Although the City of San Bernardino has only 9.77% of the
County's population, we currently have 16.96% of the County's registered sex offenders living here,
almost twice our fair share. All of the other cities listed have percentages of the County's registered
sex offenders about equal to or less than their proportionate share based on that city's population.
Attached as Exhibit B is information printed from the Attorney General's Megan's Law
website identifying the 459 registered sex offenders living in the City of San Bernardino and abutting
County islands, along with their registered addresses.
Unlike with registered sex offenders, there is no publicly accessible list of
parolees/probationers, or their residence addresses, who are living in the City of San Bernardino.
From data provided by the San Bernardino Police Department, as of June 30, 200S, there were 1,S15
parolees living within the City.
The Staff Report for MC-1253, adopted on August 5, 2007, discusses the ten local cities
which have already passed permanent ordinances addressing similar problems caused by registered
sex offender group homes, parolee/probationer group homes and unlicensed group homes. Fontana,
Ontario, Riverside, Hesperia, Apple Valley, Victorville, Murrieta and Yucaipa have all adopted
permanent zoning ordinances prohibiting or regulating these group homes. Both Highland and
Redlands adopted and extended temporary moratorium ordinances for two years from 2005 to 2007,

which prohibited the establishment of these group homes similar to San Bernardino's current
ordinance. In November 2007, Highland adopted a permanent zoning ordinance prohibiting more
than one parolee from living in a boarding or rooming house unless that boarding or rooming house
has 10 or more dwelling units. Redlands allowed their temporary moratorium ordinance to expire
after two years on September 20, 2007. Redlands is now considering permanent zoning ordinances
to regulate those uses.
Because Ordinance No. MC-1256 expires on August 1, 2008, the attached Urgency
Ordinance proposes to extend the current temporary moratorium for 12 months, so that City officials
will have additional time to discuss, process and adopt permanent ordinances regulating these uses.
Other than its effective dates, the attached Urgency Ordinance is identical in substance to Ordinance
No. MC-1256.
A second, non-urgency regular Ordinance, virtually identical to the proposed Urgency
Ordinance, is also attached to this Staff Report, which will extend the same temporary moratorium
fOl'_12 months. The League of California Cities, in its California Municipal Law -Handbook,
recommends in its "Practice Tips" that a city adopt an identical "back up" ordinance, by way of the
usual procedure (two readings), when an urgency ordinance is proposed for adoption, a practice
which our City Attorney's Office has recommended with previous urgency ordinances adopted by
the Mayor and Council. This proposed Urgency Ordinance and non-urgency regular Ordinance can
be amended or terminated by action of the Mayor and Council at any time.

AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO EXTENDING
3 TEMPORARY MORATORIUM ON THE ESTABLISHMENT AND OPERATION OF
NEW PAROLEE/PROBATIONER GROUP HOMES, REGISTERED SEX OFFENDER
4 GROUP HOMES AND UNLICENSED GROUP HOMES, DECLARING THE URGENCY
THEREOF, AND TAKING EFFECT IMMEDIATELY.

The Mayor and Common Council ofthe City of San Bernardino do ordain as follows:

WHEREAS, Section 40(z) ofthe City Charter vests the Mayor and Common Council with
7
e power to make and enforce all laws and regulations with respect to municipal affairs, subject only
8

to the restrictions and limitations provided in the Charter or by State law; and
WHEREAS, Sections 31 and 121 of the City Charter provide for the adoption of an urgency
ordinance for the immediate preservation of the public peace, health, or safety if passed by a two-
ird's (2/3) vote of the Council; and
WHEREAS on November 1,2005, the Mayor and Common Council adopted a revised and
updated General Plan. The General Plan provides a vision for our City's future which includes,

among other requirements, the use and development ofland which ensures the safety of our streets

and neighborhoods, and the compatibility between land uses, and provides for a coordinated law and
ode enforcement presence so that our residents will be safe in their homes, places of business,
schools, and neighborhoods (General Plan, pages 1-21&22); and
WHEREAS, the City has received evidence of increasing numbers of group homes that are
ansient in nature and operate more like institutional and commercial boarding house uses than as
single family homes. Uses such as homes for parolees and probationers, registered sex offenders,
and transients, group homes, and other similar uses are operating as businesses in residentially zoned

areas of the City; and
WHEREAS, citizens of the City have expressed significant concerns regarding the adverse
impacts that an over-proliferation of parolee/probationer group homes, registered sex offender group
25
omes, and state licensed and unlicensed group homes has on the surrounding residential
26

eighborhoods, including, but not limited to, impacts on traffic and parking, excessive delivery times
and durations, the commercial use of public property, commercial and/or institutional services

o 1 ffered in private residences, more frequent trash collection, daily arrival of staff who live off-site,
2 second-hand smoke, possession and use of illegal drugs, loitering, trespassing,. trash, debris,
3 unmaintained landscaping, depreciation of property values, and nuisance behavior such as noise,
4 litter, loud and offensive language, and public drunkenness; and
5 WHEREAS, according to the California Attorney General's website on Megan's Law
6 (www.meganslaw.ca.gov).as ofJuly 16, 2008, there were 459 registered sex offenders living within
7 the City and County islands located within the City's borders, which number is disproportionate and
8 at a much higher percentage ofthe total number of registered sex offenders living in San Bernardino
9 County when compared to the percentage of the City's population to the County's total population;

WHEREAS, according to the San Bernardino Police Department, as ofJune 30, 2008, there
ere 1,815 parolees living within the City; and
WHEREAS, significant concerns have been raised by residents in the community regarding
e over-proliferation of registered sex offenders and parolees living within the City; and
WHEREAS, on August 6,2007, the Mayor and Common Council unanimously adopted
Ordinance No. MC-1253, "An Urgency Interim Ordinance of the City of San Bernardino
stablishing a Temporary Moratorium on the Establishment and Operation of New
aroleelProbationer Group Homes, Registered Sex Offender Group Homes and Unlicensed Group
Homes, Declaring the Urgency Thereof, and Taking Effect Immediately." OI:!linance No. MC-1253
and the Request for Council Action, Staff Report, and other documents and public testimony
reviously submitted to the Mayor and Council in support of said Ordinance are hereby incorporated
22 herein by reference.
23 WHEREAS, on September 17 and October I, 2007, the Mayor and Common Council
24 adopted Ordinance Nos. MC-1256 and MC-1257, respectively, an urgency ordinance and a non-
25 gency regular ordinance, which extended the temporary moratorium by 10 months and 15 days.
26 Ordinance Nos. MC-1256 and MC-1257, and the Request for Council Action, Staff Report, and
o 27 ther documents and public testimony previously submitted to the Mayor and Council in support of
28

2 WHEREAS, Ordinance No. MC-1256 expires 10 months and 15 days after the date of
3 adoption, which will occur on August I, 2008, unless extended by action of the Mayor and Council.
4 WHEREAS, the Mayor has appointed Superior Court Judge Tara Reilly, Councilmembers
5 endy McCammack, Rikke Van Johnson, and Tobin Brinker, and the Mayor to a Parolee Reentry
6 d Hoc Committee for the purpose of discussing how to control and improve services for parolees
7 and probationers.
8 WHEREAS, the City requires additional time to study and determine the actual adverse
9 impacts of parolee/probationer, registered sex offender, and State licensed and unlicensed group
10 omes now permitted in residentially zoned areas ofthe City. The City also requires additional time
II to study and determine appropriate uses in residentiaily zoned areas, to reduce adverse impacts while
12 complying with federal and state laws protecting the disabled, and to specify appropriate permitting
13 conditions, requirements, and procedures and desired levels of discretionary review; and
14
WHEREAS, the Mayor and Common Council requires additional time to receive public
IS comment prior to enacting any permanent regulatory ordinances; and
16 WHEREAS, the Mayor and Common Council hereby specifically finds as follows:

Section 1.
Findings.
a.
The above recitals are true and correct and incorporated herein by this reference.
The owners or operators of parolee/probationer group homes, registered sex offender

20 group homes, or unlicensed group homes are likely to commence operations of such uses before the
21 studies are completed and appropriate regulations and safeguards are adopted, thereby adversely
22 .mpacting the peace, health, safety, and welfare of the community; and

Parolee/probationer group homes, registered sex offender group homes, or unlicensed

24 group homes may be established in areas that would be inconsistent with the surrounding uses or
25 .th the character of a residential neighborhood and would be immediately detrimental to the public
26 eace, health, safety and welfare of the community; and

d.
If new parolee/probationer group homes, registered sex offender group homes, or
28 unlicensed group homes are established, such uses could conflict with, and defeat the purpose of,

he proposal to study and adopt new regulations regarding these uses; and
e. In accordance with City Charter Sections 31 and 121, based on the recitals and
findings referenced above, the Mayor and Common Council hereby finds that this urgency ordinance
is .neCeSSlil)' for the immediate preservation of the public peace, health, or safety.
NOW THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS:
Section 2.
Imposition of Moratorium.
A. Notwithstanding any conflictingprovision( s) in any other section of the San Bernardino
Municipal Code, including the Development Code, no new parolee/probationer group home, registered
sex offender group home, or unlicensed group home shall be established or operated; and no
Conditional Use Permit, Development Permit, Building Permit, Certificate of Occupancy or Zoning
Verification Review (also referred to as "Zoning Consistency Review") shall be issued or granted for
the establishment or operation of a new parolee/probationer group home, registered sex offender group
14 home, or unlicensed group home, or similar use.

As usedinJhis Ordinance, the following 1lefmitions apply:.
"Parolee/probationer group home" shall mean any single family residential structure

17 or unit, whether owned and/or operated by an individual or a for-profit ornon-profit entity, that houses
18 two or more parolees/probationers, unrelated by blood, marriage, or adoption, in exchange for
19 onetary or non-monetary consideration given and/or paid by the parolee/probationer and/or any
20 ublic or private entity or person on behalf of the parolee/probationer.

A "parolee/probationer" includes:
a.
Any individual who has been convicted of a Federal crime and sentenced to a
23 term of supervised probation or sentenced to a term of imprisonment in Federal prison, and granted
24 conditional and revocable release into the community under the supervision ofa Federal parole officer.

b.
Any individual who has been convicted of a State crime and sentenced to a term
26 f supervised probation or sentenced to a term of imprisonment in county jailor in a State prison and
27 ho is serving a period of supervised community custody, as defmed in Penal Code Section 3000, and
28 . s under the jurisdiction of the California Department of Corrections, Parole and Community Services

An adult or juvenile sentenced to a term in the California Youth Authority and

"Registered sex offender group home" shall mean any single family residential structure

6 or unit, whether owned and/or operated by an individual or a for-profit or non-profit entity, that houses
7 two or more registered sex offenders, unrelated by blood, marriage, or adoption, in exchange for
8 onetary or non-monetary consideration given or paid by the registered sex offender or any public or
9 rivate entity or person on behalf ofthe registered sex offender.

A "registered sex offender" shall mean any person required to register pursuant to

11 California Penal Code Section 290.

"Licensed group home" shall mean any State licensed residential facility that is
5.
13 aintained and operated to provide non-medical residential care, day treatment, or foster agency
14 services for six or fewer adults, children, or adults and children, and which is required by State law
J 5 _ . beJr.eated.asasingle family residence or .single family dwelling unit for zoning purposes.

"Unlicensed group home" shall mean any residential structure or unit, whether owned

17 and/or operated by an individual or a for-profit or non-profit entity, that is not licensed by the State,
18 at is maintained and operated to provide non-medical residential care, day treatment, or foster agency
19 services for six or fewer adults, children, or adults and children, and which is not required by State law
20 to be treated as a single family residence or single family dwelling unit for zoning purposes.

Section 3:
Reasonable Accommodation.
In compliance with the Federal Fair Housing Act (42 U.s.c. ~~ 3600 et seq.), the Americans
ithDisabilities Act (42 U.S.C. ~~ 12101 etseq.), and the Employment and Housing Act (Gov. Code
24 ~~ 12900 et seq.), it is the City's policy to provide reasonable accommodation in the application of this
25 Ordinance to any person with a disability who seeks fair access to housing. "Disability" shall have the
26 same meaning as the terms "disability" and "handicapped" in the Fair Housing Act.
27 A. An application forreasonableaccommodation in the application of this Ordinance shall
28 e made to the City Planner/Deputy Director of Development Services, and shall include:

requested;
The basis for the claim that the individuals affected are considered disabled

6 3. Any other information the City Planner/Deputy Director of Development
7 Services reasonably determines is necessary.
B. In making a determination regarding the reasonableness of the requested
accommodation, the following factors shall be considered:

Potential impact on, and compatibility with, other property in the vicinity;

Whether the requested accommodation would require a fundamental alteration
18 in the nature of a City program; and

Whether granting the request would be consistent with the City's General Plan.
Any request for reasonable accommodation from the provisions of this Ordinance shall
21 e reviewed and considered by the Planning Commission at a noticed public hearing and may be
22 approved, conditionally approved, or denied by the Planning Commission.

Section 4:
This Ordinance is based upon the recitals and fmdings set forth above, and the
24 accompanying Staff Report and its attachments to this Ordinance, and is adopted pursuant to the
25 authority granted to the City of San Bernardino in Article 11, Section 7 of the California Constitution,
26 and Sections 31, 40(z), and 121 of the Charter of the City of San Bernardino.

Section 6:
During the effective time period of this Ordinance, the Development Services
epartment and the Planning Commission are hereby directed to consider and process a permanent
ordinance regulating the establishment and operation of parolee/probationer group homes, registered
sex offender group homes, unlicensed group homes, and other similar uses in the City of San
ernardino.
Section 7:
Compliance with the California Environmental Quality Act. The Mayor
and Common Council finds that this Ordinance is not subject to the California Environmental Quality
ct (CEQA) pursuant to Sections 15061(b)(3) (the activity will not result in a direct or reasonably
foreseeable indirect physical change in the environment) and 15060( c )(3) (the activity is not a project

5 Tbe Mayor and Common Council oftbe City of San Bernardino do ordain as follows:
6 WHEREAS, Section 40(z) of the City Charter vests the Mayor and Common Council with
7 e power to make and enforce all laws and regulations with respect to municipal affairs, subject only
8 0 the restrictions and limitations provided in the Charter or by State law; and
9 WHEREAS on November 1,2005, the Mayor and Common Council adopted a revised and
10 updated General Plan. The General Plan provides a vision for our City's future which includes,
11 among other requirements, the use and development of land which ensures the safety of our streets
12 and neighborhoods, and the compatibility between land uses, and provides for a coordinated law and
13 code enforcement presence so that our residents will be safe in their homes, places of business,
o 14 schools, and neighborhoods (General Plan, pages 1-21&22); and
15 WHEREAS, the City has received evidence of increasing numbers of group homes that are
16 ansient in nature and operate more like institutional and commercial boarding house uses than as
17 single family homes. Uses such as homes for parolees and probationers, registered sex offenders,
18 and transients, group homes, and other similar uses are operating as businesses in residentially zoned
19 areas of the City; and

WHEREAS, citizens of the City have expressed significant concerns regarding the adverse
impacts that an over-proliferation of parol eel probationer group homes, registered sex offender group
omes, and state licensed and unlicensed group homes has on the surrounding residential
eighborhoods, including, but not limited to, impacts on traffic and parking, excessive delivery times
and durations, the commercial use of public property, commercial and/or institutional services
ffered in private residences, more frequent trash collection, daily arrival of staff who live off-site,
second-hand smoke, possession and use of illegal drugs, loitering, trespassing, trash, debris,
aintained landscaping, depreciation of property values, and nuisance behavior such as noise,

o 1 litter, loud and offensive language, and public drunkenness; and
2 WHEREAS, according to the California Attorney General's website on Megan's Law
3 (www.meganslaw.ca.gov).as ofJuly 16, 2008, there were 459 registered sex offenders living within
4 the City and County islands located within the City's borders, which number is disproportionate and
5 at a much higher percentage of the total number of registered sex offenders living in San Bernardino
6 County when compared to the percentage ofthe City's population to the County's total population;

WHEREAS, according to the San Bernardino Police Department, as of June 30, 2008, there
ere 1,815 parolees living within the City of San Bernardino; and
WHEREAS, significant concerns have been raised by residents in the community regarding
the over-proliferation of registered sex offenders and parolees living within the City; and
WHEREAS, on August 6, 2007, the Mayor and Common Council unanimously adopted
Ordinance No. MC-1253, "An Urgency Interim Ordinance of the City of San Bernardino
Establishing a Temporary Moratorium on the Establishment and Operation of New
ParoleelProbationer Group Homes, Registered Sex Offender Group Homes and Unlicensed Group
omes, Declaring the Urgency Thereof, and Taking Effect Inunediately." Ordinance No. MC-1253
and the Request for Council Action, Staff Report, and other documents and public testimony
reviously submitted to the Mayor and Council in support of said Ordinance are hereby incorporated

20 WHEREAS, on September 17 and October 1, 2007, the Mayor and Common Council
21 adopted Ordinance Nos. MC-1256 and MC-1257, respectively, an urgency ordinance and a non-
22 rgency regular ordinance, which extended the temporary moratorium by 10 months and 15 days.
23 Ordinance Nos. MC-1256 and MC-1257, and the Request for Council Action, Staff Report, and
24 other documents and public testimony previously submitted to the Mayor and Council in support of
25 ese two ordinances are hereby incorporated herein by reference.
26 WHEREAS, Ordinance No. MC-1256 expires 10 months and 15 days after the date of
C 27 adoption, which will occur on August I, 2008, unless extended by action of the Mayor and Council.

1 WHEREAS, the Mayor hanppointed Superior Court Judge Tara Reilly, COWlcilmembers
2 endy McCammack, Rikke Van Johnson, and Tobin Brinker, and the Mayor to a Parolee Reentry
3 d Hoc Committee for the purpose of discussing how to control and improve services for parolees
4 and probationers.
5 WHEREAS, the City requires additional time to study and determine the actual adverse
6 impacts of parolee/probationer, registered sex offender, and State licensed and Wllicensed group
7 omes now permitted in residentially zoned areas of the City. The City also requires additional time
8 to study and determine appropriate uses in residentially zoned areas, to reduce adverse impacts while
9 complying with federal and state laws protecting the disabled, and to specifY appropriate permitting
10 conditions, requirements, and procedures and desired levels of discretionary review; and
II WHEREAS, the Mayor and Common Council requires additional time to receive public
12 comment prior to enacting any permanent regulatory ordinances; and

21 group homes may be established in areas that would be inconsistent with the surroWlding uses or
22 ith the character of a residential neighborhood and would be immediately detrimental to the public
23 eace, health, safety and welfare of the community; and

d.
If new parolee/probationer group homes, registered sex offender group homes, or

25 Wllicensed group homes are established, such uses could conflict with, and defeat the purpose of,
26 the proposal to study and adopt new regulations regarding these uses; and

Section 2. Imposition of Moratorium.
A. Notwithstanding any conflicting provision( s) in any other section of the San Bernardino
Municipal Code, including the Development Code, no new parolee/probationer group home, registered
sex offender group home, or unlicensed group home shall be establishedoL operated; and no
Conditional Use Permit, Development Permit, Building Permit, Certificate of Occupancy or Zoning
erification Review (also referred to as "Zoning Consistency Review") shall be issued or granted for
e establishment or operation of a new parolee/probationer group horne, registered sex offender group
8 horne, or unlicensed group horne, or similar use.
B. As used in this Ordinance, the following defmitions apply:
1. "Parolee/probationer group home" shall mean any single family residential structure
or unit, whether owned and/or operated by an individual or a for -profit or non-profit entity, that houses
o or more parolees/probationers, unrelated by blood, marriage, or adoption, in exchange for
onetary or non-monetary consideration given and/or paid by the parolee/probationer and/or any
. ublic or private entity or person on behalf of the parolee/probationer.

a. Any individual who has been convicted of a Federal crime and sentenced to a
term of supervised probation or sentenced to a term of imprisonment in Federal prison, and granted
conditional and revocable release into the community under the supervision of a Federal parole officer.
b. Any individual who has been convicted of a State crime and sentenced to a term
of supervised probation or sentenced to a term of imprisonment in county jailor in a State prison and
ho is serving a period of supervised community custody, as defined in Penal Code Section 3000, and
is under the jurisdiction of the California Department of Corrections, Parole and Community Services

An adult or juvenile sentenced to a term in the California Youth Authority and
25 ho has received conditional and revocable release into the community under the supervision of a
26 Youth Authority Parole Officer.

"Registered sex.offender group home" shall mean any single farnilyresidential structure
28 or unit, whether owned and/or operated by an individual or a for-profitornon-profit entity, that houses

16 In compliance with the Federal Fair Housing Act (42 U.S.C. ~~ 3600 et seq.), the Americans
17 ith Disabilities Act (42 U.S.c. ~~ 12101 et seq.), and the Employment and Housing Act (Gov. Code
18 ~~ 12900 et seq.), it is the City's policy to provide reasonable accommodation in the application of this
19 Ordinance to any person with a disability who seeks fair access to housing. "Disability" shall have the
20 same meaning as the terms "disability" and "handicapped" in the Fair Housing Act.
