The Federal Communications Commission ("FCC") further enhanced these obligations in what has been termed "social contracts". Even though there have been changes in California law (DIVCA, 2006) since the 1996 Act, the basic tenets in regards to the support of PEG and inclusion of PEG programming as a core function of local government, although not a mandate, have remained static. It should be noted that DIVCA mandates cable complaints be handled by local governments. Currently, CATV staff is answering approximately 70 calls from the citizenry each month. The calls vary in issue from picture quality to quality of programming. There is a required level of expertise in handling these complaints as federal statutes dictate the types of issues local government may mitigate. Additional background information is attached as Attachment 1. CURRENT ISSUE: The City Council has created a new relationship between the Economic Development Agency of the City of San Bernardino ("EDA") and the CATV Division ("CATV"). The Council has transferred the oversight of CATV from the City's IT Department to the EDA. The EDA views the CATV as a viable resource in marketing the City to potential businesses, residents and event coordinators. CATV should be pivotal in the creation of marketing materials and videos showcasing the advantages of living, working and opening a business in the City of San Bernardino. CATV will not become financially self-sufficient in one year; however the following initiatives will bring CATV closer to the goal of financial stability and self reliance: • Create revenue generation: • Advertising • Sponsorships • Underwriting opportunities • Create target specific programs to expand viewership (i.e. youth programs) • Collaborate with business community for marketing opportunities • Expand contracts services to other cities and their PEG Channels • Provide information to public on employment opportunities (SBETA) • Create Educational Channel with local education institutions (SBUSD, CSUSB, Community College District) • Market services to potential clients at every opportunity, including City Departments • Increase current program fees - current fees established in 1992 —-------—-—-------------------—------------------------------------------------------------------------------------------------------------------------------------------------------------ PAAgendas\Connn Dev Commission\CDC 2008\07-21-08 CATV Operations and Transfer SR.doc COMMISSION MEETING AGENDA Meeting Date: 07/21/2008 Agenda Item Number: 9 38 Economic Development Agency Staff Report CA TV Operations and Transfer of Oversight Page 2 o Seek annual grant funding including live newscast capability at Office of Emergency Services o Increase Channel visibility o Create City Focused Public Service Announcements o Quarterly Reports to the Community Development Commission("Commission") Staff recommends providing the Council/Commission with Quarterly reports, at minimum. As requested by the Ways and Means Committee on July 9, 2008 as well as Councilman Brinker, EDA Staff is currently investigating the costs associated with providing communication to the public in lieu of Channel 3; newsletter, webcast, contract production for City Council meetings and the like. There are numerous aspects of this investigation, including the provision of factual numbers. This report will be provided within 30 days. ENVIRONMENTAL IMPACT: None. FISCAL IMPACT: None. From 1988 to 1992, the division programmed Public, Educational and Government content on one cable channel, Channel 3, providing coverage of council meetings, cable commission meetings, 5-15 minute programs, and taped coverage of community events. The channel also documented community disasters such as the 1989 Duffy Street Cajon Pass Train derailment, providing important emergency information from the city to its residents. From 1992 to 1994, under acting Telecommunications Director Fred Wilson, the division moved its production staff to the production studio located in the Public Enterprise Center and started producing longer studio based productions. The division consolidated its technical and production staff 1994 - 2004, and moved to its current production facilities in 1997. From 1997 - 1998, the division was managed by the EDA but was moved back to the City of San Bernardino ("City") in 1998. A second channel was added during this time, Access San Bernardino, in order to separate Public access programming from Government/Educational programming still on Channel 3. In 2002, the division was the technical and production hub for California State University at San Bernardino's ("CSUSB") short lived ICTN network with upgraded equipment and facilities. The division transitioned into its core role by providing full coverage of the 2003 Old Fire. Information communicated from the City Emergency Operations Center to San Bernardino residents was the only local source of accurate information received by the residents in contrast to other non-local media outlets. From 2004-2006, acting CATV Manager Lori Sassoon, negotiated an MOU with CSUSB to continue its partnership with the City. Through the MOU, CSUSB has a video link directly into the CATV facility from which they can air CSUSB programming from their campus to the community. CATV staff was also instrumental in making sure that legislative programming from Sacramento, The California Channel, was available at no additional cost to cable subscribers. Tom Marek, IT Director, 2006 to present, expanded the channels live insertion capability by adding live insertion points in the Convention Center, EDA Boardroom, and at `B" and Court Streets with plans to activate another live insertion point at the Emergency Operations Center. In 2007, the division again transitioned into its core role of emergency information by informing residents about the Slide Fire and communicated accurate information from the City Emergency Operations Center to the community. It was also during this time the San Bernardino City Unified School District voted to record and air their board meetings on Channel 3. The School District is developing plans to have a direct video connection to the CATV facility to utilize the channel to communicate to their constituents and students.
