STAFF REPORT
In September, 1990, Assembly Bill 2766 was signed into law,
authorizing an annual vehicle registration fee to fund programs
that reduce mobile source air pollution. cities receive a portion
of the fee to support community-based projects. Fiscal year
1991/92 revenue estimates for the City of San Bernardino are
$107,000 and $214,000 for FY 1992/93.
Use of the funds is restricted and must be used with the goal of
reducing vehicle trips. Currently, the City is using a portion of
the funds to finance its Trip Reduction Plan required by the South
Coast Air Quality Management District Regulation XV. Another
acceptable use of the money is to fund on-site employee childcare,
since vehicle trips would be reduced if parents and children had
the same destination every day.
The City Administrator's office has done an initial analysis of
employee childcare needs. An employee childcare survey was
distributed in March. Approximately 200 were returned, with the
majority of responding employees citing childcare problems as a
major conflict to job performance.
Based on the employee survey responses, Administration staff
requested proposals from local childcare consultants to perform a
needs assessment and feasibility study for worksite childcare.
Based upon past experience, reference checks, proposed scope of
work, and estimated cost, it is recommended that the City hire
Alliance of Businesses for Childcare Development (ABCD), a non-
profit agency with experience in setting up childcare centers for
the cities of Long Beach and Los Angeles and Los Angeles Unified
School District. ABCD has proposed a two phased approach (see
Attachment A). Phase one is a needs assessment that would
realistically measure projected employee childcare usage. Phase
two is a feasibility to implement various childcare options, based
upon the employee needs assessment. Total estimated cost for both
phases is $15,000.
RECOMMENDATION
It is recommended that the Mayor and Common Council authorize a
contract with Alliance of Businesses for Childcare Development to
perform a needs assessment and feasibility plan for on-site
childcare.

CHILD CARE NEEDS ASSESSMENT AND PLANNIN&
CITY OF SAN BERNARDINO
SCOPE OF WORK
A. Conduct a child care needs assessment of the employee population
(approximately 1.200) for the City of San Bernardino.
To accomp'1sn this, the ABCD consultant team will:
. Design a survey instrument with input from City representatives.
. Coordinate the lay-out and printing of the survey.
. Plan the distribution and collection of the survey with City
representatives.
. Assist City personnel in planning the "marketingl' of the survey to
encourage a good return (151 or better).
. Input the data from the returned surveys.
. Review demographic data supplied by City personnel to verify that returned
surveys are representative of the general employee population. This data
includes:
· numbers of women
· work site 1ocations (number of employees at each work site)
· age break down
- job classification (number of employees in each)
I Analyze survey data.
I Review current child care resources available to meet the needs stated in
the survey results,
. Prepare a report which includes results of the survey and recommendations
for action.
. Present surv~ results and recommendations to City representatives.
B. StudY the feas1bi1ity of implementing recommended options selected by the
City based on the surv~ report.
To do this. the ABeD consultant team wi":
. Research the costs of selected options and deve10p pro forma budgets for
start-up and operation. This will include capital expenses in the case of
a child care center.
. Research and present funding strategies including use of transportation
funds, block grant funds, etc.; develop a fee structure for a child care
center program.
. Identify potential contractors able to provide the services which are being

SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City an
Agreement with Alliance of Businesses for Child Care Development a
copy of which is attached hereto, marked Exhibit "A" and
incorporated herein by reference as fully as though set forth at
length.
SECTION 2. The authorization to execute the above-referenced
Agreement is rescinded if the parties to the Agreement fail to
execute it within sixty (60) days of the passage of this
resolution.

AGREEMENT
THIS AGREEMENT I made and entered into this day of
1992 by and between the CITY OF SAN BERNARDINO
("City") and ALLIANCE OF BUSINESSES FOR CHILD CARE DEVELOPMENT
( "Consul tant ") :
WITNESSETH
NOW THEREFORE, the parties hereto agree as follows:
1. City hereby engages Consultant to perform the following
services:
A. Perform an assessment analyzing City employees' and
businesses directly adjacent to City Hall's needs,
both current and projected, for on-site child care.
The needs assessment shall include, but is not
limited to, the following:
1) surveying employees, using a survey instrument
which is designed with input from City
employees. Consultant shall design, print,
distribute, and tabulate survey results,
ensuring that surveys returned are
representative of the general employee
population. Information resulting from the
survey shall include, but is not limited to:
employees' current child care circumstances,
including rates of pay for care givers, types
of care provided, distance from worksite, ages
of children provided for; parental eligibility

for governmental subsidies; hours of usage;
and other factors as deemed necessary.
2) City-provided demographic data to assist in

3) Employees' projected child care needs and
circumstances for the next five years,
including the above-mentioned factors.
4) Non-City employer contributions, both in-kind
and monetary, which may be used toward start-
up or administration of a City Hall-based
child care center.
5) Preparation of a report which includes survey
results and recommendations for action.
6) Presentation of findings and analysis to City
representatives.

recommended by Consultant.
3) Identify potential contractors able to provide
the recommended services being studied.
Consultant shall be paid at the rate of $100 per hour for
principals, which includes all clerical and
administrative support to the project. Maximum
compensation shall not exceed $16,000.
Consultant shall maintain and file with the City
Administrator of City a record of all hours worked on
assigned study. supervision of Consultant shall be
coordinated with the City Administrator or her designee.
Consultant shall at such time intervals as directed by
the City Administrator, submit a claim based on such
records to the City in the manner and form as prescribed
by the City Administrator.
This Agreement shall commence upon execution of this
contract by both parties. This Agreement may be
terminated by either party upon thirty (30) days written
notice to the other.
For all purposes, Consultant shall be considered as an
independent contractor and not as an employee of the
city.
Except as specifically provided herein, Consultant shall
not be entitled to any employee benefits, such as, but
not limited to, vacation leave or accrual, sick leave,
retirement benefits, paid vacation, seniority, etc. City

shall not deduct from Consultant's compensation any
withholding except as is required for such independent
contractors. Consultant shall be responsible for all
taxes on said compensation.
Provider shall not discriminate in its recruiting,
hiring, promotion, demotion or termination practices on
the basis of race, reI igious creed, color, national
origin, ancestry, sex, age or physical handicap in the
performance of this Agreement and shall comply with the
provisions of the state Fair Employment Practices Act as
set forth in Part 4.5 of the Division 2 of the California
Labor Code, the Federal civil Rights Act of 1964, as set
forth in Public Law 88-352, and all amendments thereto;
Executive Order 11246; and all administrative rules and
regulations issued pursuant to such acts and order.
