DescriDtion) Tippecanoe Ave. widening (110 - Hardt) Finance: Council Notes: _0 I I I 75-0262 Agenda Item No .:5-,2 CITY OF SAN BERNCRDINO - REQUEST lOR COUNCIL ACTION STAFF REPORT o On November 18, 1991, an Agreement was executed by Resolution No. 91-465 with REALCO CONSULTANTS for acquisition of the right-of-way necessary for widening the East side of Tippecanoe Avenue between Hardt Street and Laurelwood Drive. As Tippecanoe Avenue is a major street and is subject to some future Federal or State funded prograa, it is necessary to follow the quidelines of the Unifora Relocation Assistance and Real Property Acquisition Policies Act of 1970 in acquiring this right- of-way. Therefore, Realco Consultants has obtained the necessary Appraisal Reports and has taken all the necessary steps to this point. Prior to making a fira purchase offer of just compensation to the Owner of the land, it is necessary that your Honorable Body consider the Appraiser's reports and valuations. If the City accepts the Appraiser's valuation, then a Resolution should be adopted which among other things, establishes just compensation (fair market value) for the property. The attached Resolution serves as the basis for the City's purchase offer to the Owner. If the City does not agree with the "Appraiser's determination of fair market value, then it will be necessary to hire a second Appraiser to re-appraise the land. This office has reviewed the reports submitted by Mr. Don Porterfield, the Appraiser, through Realco Consultants, and recoaends that the reports and the valuations contained therein be accepted and that the proposed Resolution be adopted. 4E> This Resolution will also authorize the payment of the stated amount for the land. ~ CLAUSE: It is necessary for this Resolution to be adopted at the meeting of April 20, 1992 in order to meet negotiation and construction scheduling. RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING THE APPRAISER'S DETERMINATION OF FAIR MARKET VALUE OF STREET AND HIGHWAY EASllKENTS AND RIGHTS OF ENTRY FOR THE EAST SIDE OF TIPPECANOE BETWEEN HARDT STREET AND LAURELWOOD DRIVE, SAN BERNARDINO, CALIFORNIA, AND CERTIFYING THE WORK OF THE APPRAISER. WHEREAS, the City of San Bernardino is contemplating the acquisition of Street and Highway easements and Rights of Entry along the East side of Tippecanoe Avenue between Hardt Street and Laurelwood Drive in the City of San Bernardino; and WHEREAS, Thirteen owners representing nineteen parcels of real 11 property from which the easements and Rights of Entry are to be acquired are 12 involved; and 13 WHEREAS, the City desires to now acquire the said Street and 14 Highway easements and Rights of Entry across said lots and parcels: and 15 WHEREAS, City has reviewed the Appraiser' s determination of the 16 fair market value of the land and his report thereon; and 17 WHEREAS, the City intends to acquire said easements and Rights 18 of Entry with Measure "I" - ~ sales tax funds. 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COHHON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: SECTION 1.
