There are several sand and gravel, ready mix concrete plants and construction yards that take access to this section of Alabama Street. The inordinate number of large trucks turning into and from Alabama Street often creates traffic congestion, and potential hazards. In order to alleviate this condition, the adjoining businesses have requested that the street be widened, and left-turn lanes provided. A cooperative project has accordingly been developed between the Cities of Redlands, Highland and San Bernardino. The proposed Agreement relating to the construction of improvements to Alabama Street stipulates the responsibilities and participation by each city. The proposed agreement provides, in general, that Redlands will proceed to have the improvements constructed, and Highland and San Bernardino will pay their proportionate shares. Below is a tabulation of the participation by each city: City of Redlands (59%) City of Highland ( B%) City of San Bernardino (33%) $ 37,100 4,935 20,930 TOTAL ESTIMATED PROJECT COST $ 62,965 The cost is divided in proportion to the area of each city within the project limits. The City of San Bernardino's share will be financed from the funds allocated for minor improvements at various locations, under Account No. 250-670-57477. We recomend that the Agreement be approved. 3-17-92 75-0264 Co co 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CITIES OF RED LANDS AND 3 HIGHLAND RELATING TO THE CONSTRUCTION OF IMPROVEMENTS ON ALABAMA STREET. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The Mayor of the City of San Bernardino is 7 hereby authorized and directed to execute, on behalf of said 8 City, an Agreement with the Cities of Redlands and Highland, 9 relating to the construction of improvements on Alabama Street, a 10 copy of said agreement is attached hereto, marked Exhibit "A" and 11 incorporated herein by reference as fully as though set forth at 12 length. 13 SECTION 2. This agreement and any amendment or modifica- 14 tions thereto shall not take effect or become operative until 15 fully signed and executed by both parties. The City shall not be 16 obligated hereunder unless and until the agreement is fully 17 executed and no oral agreement relating thereto shall be implied 18 or authorized. 19 SECTION 3. Penman City Attorney By(2k~ ( - 2 - Co 00 AGREEMENT RELATING TO THE CONSTRUCTION OF IMPROVEMENTS TO ALABAMA STREET This Agreement is made and entered into this ____day of , 1992, by and among the city of Redlands, the City of San Bernardino and the City of Highland. WHEREAS, the Cities of Redlands, San Bernardino and Highland recognize the need for the construction of certain improvements to Alabama street at a location three-tenths (0.3) of a mile south of Third street, and desire to cooperate in funding the construction of such improvements (the "Improvements") 1 and WHEREAS, the Cities of Redlands, San Bernardino and Highland shall benefit mutually from the Improvements in proportion to the work to be done in each City's jurisdiction as shown in Exhibit "A" attached hereto and the map attached hereto as Exhibit "B"l NOW, THEREFORE, in consideration of the mutual promises contained herein, it is agreed by the Cities of Redlands, San Bernardino and Highland as follows: Co co SECTION ~ OBLIGATIONS Ql ~ ~ Ql REDLANDS A. The city of Redlands shall act as lead agency for purposes of the California Environmental Quality Act and soliciting contracts for the construction of the Improvements. The Improvements shall consist of the following: (1) Grinding one (1) inch of existing pavement. (2) Excavate and install six (6) inches of aggregate base in areas of widening. (3) overlaying existing pavement with three (3) inches of asphalt concrete. (4) Construction of four (4) inches concrete pavement in areas widening. (5) Traffic painting and the installation of raised markers per the approved striping plan. (6) Installation of traffic signs per the approved plan. of of asphalt pavement B. Construction of the Improvements shall be performed in accordance with the Standard Specifications of the City of Redlands. Plans and specifications shall be prepared and all contract administration shall be done by the City of Redlands. The Improvements may be constructed under one or more contracts in accordance with law. -2- Co 00 C. Redlands shall subcontractors to purchase insurance: require contractors and and maintain the following 1. Commercial general liability insurance or equivalent form with a combined single limit of not less than $1,000,000 per occurrence. If such insurance contains a general aggregate limit, it shall apply separately to this Agreement or be no less than two times the occurence limit. Such insurance shall: a. Name the Cities of Redlands, San Bernardino and Highland, their respective officials, officers, and employees as insureds with respect to the construction of the Improvements and contain no special limitations on the scope of its protection to the above listed insureds; b. Be primary with respect to any insurance or self insurance programs covering the cities and their officials, officers and employees; and c. Contain standard separation of insureds provisions. 2. Business automobile liability insurance or equivalent form with a combined single limit of not less than $500,000 per occurrence. Such insurance shall include coverage for owned, hired and non-owned automobiles. 3. Workers' compensation insurance with statutory limits and employers' liability insurance with limits of not less than $1,000,000 per accident. -3- Co co 4. The City of Redlands shall require the contractor to do all the following: a. Prior to the issuance of a notice to proceed for the Improvements, furnish properly executed certificates of insurance, and certified copies of endorsements, and policies if requested by the City, to the city which shall clearly evidence all insurance required in this section. Such certificates shall be endorsed to provide that such insurance shall not be canceled, allowed to expire or be materially reduced in coverage except on 30 days' prior written notice to the City. b. Maintain such insurance from the time a notice to proceed is issued until a notice of completion is filed. c. Place insurance with insurers licensed to do business in California. d. Replace endorsements for any insurance prior to the filing of the Improvements. certificates, policies and canceled or allowed to expire notice of completion for the D. Redlands shall be responsible for 59% of the cost of the design and construction of the Improvements as determined in good faith by the City of Redlands. -4- Co Co E. Redlands shall provide and install all signing fQr the project. Partial reimbursement for signing shall be provided by the Cities of Highland and San Bernardino based upon the schedule attached hereto as Exhibit "C". F. Redlands shall use due diligence to complete the Improvements by August 31, 1992. G. Redlands shall allow the Cities of Highland and San Bernardino to conduct a final inspection of the Improvements prior to the recordation of a notice of completion for the Improvements. H. Following recordation of a notice of completion for the Improvements, Redlands shall provide the Cities of Highland and San Bernardino with an accounting of all costs incurred to construct the Improvements. This accounting shall be used to determine the additional payment or reimbursement required under Sections 2 and 3 of this Agreement. -5- Co co SECTION . OBLIGATION Qf nm ~ Qf QAH BERNARDINO The City of San Bernardino shall pay for 33% of the cost of the design and construction of the Improvements. The parties estimate that this amount shall be $20,930, and the City of San Bernardino shall advance said amount upon the issuance of a notice to proceed for the Improvements. Thirty days following the filing of a notice of completion for the Improvements, one of the following shall occur, as applicable: 1) The city of San Bernardino shall pay for any additional funds necessary to bring the city of San Bernardino's payment up to the above stated percentage of 2) the city of Redlands will return that portion of the advanced funds as necessary to reduce the City of San Bernardino's contribution to the above stated percentage. SECTION 1 OBLIGATIONS Qf :;em ~ Qf HIGHLAND The City of Highland shall pay for 8% of the cost of the design and construction of the Improvements, as determined in good faith by the city of Redlands. The parties estimate that this amount shall be $4,935, and the City of Highland shall advance said amount upon the issuance of a notice to proceed for the Improvements. Thirty days following the filing of a notice of completion for the Improvements, one of the following shall occur, as applicable: 1) The city of Highland shall pay any additional funds necessary to bring the city of Highland's payment up to the above stated percentage of 2) the City of Redlands will return that portion of the advanced funds as necessary to reduce the City of Highland's contribution to the above stated percentage. -6- AGREEMENT: ~~G TO THE ~V STREET . .
