A total of 12 bids $375,602.35 to $484,476.95 for $375,602.35 is 17.8% under $456,778.00. were received, ranging from the Basic Bid. The low bid of the Engineer's Estimate of Below is an estimate of the total project cost, based upon the actual low bid price: construction Contract (Basic Bid) Engineering & Inspection (W.O.#1837) Water Dept. (Relocate Facilities/Meter Fee) Sub-Total Contingencies (15%)t TOTAL ESTIMATED PROJECT COST $375,602.35 23,080.00 15,000.00 $413,682.35 62,317.65 $476,000.00 The installation of a pedestrian bridge over the East Branch of the Lytle Creek Flood Control Channel was included in the special provisions as Additive Alternate "A." The special provisions specified that the bridge be furnished by the Continental Bridge Co., or approved equal. Any requests to substitute another vendor were to be submitted to our office in writing, at least seven (7) working days prior to bid opening. This time frame was specified in order to allow us sufficient time to review the bridge proposed to be substituted in lieu of the bridge by the Continental Bridge Co., and, if approved, allow the vendor time to disseminate a price quote to the prospective bidders. Another company contacted our office within seven (7) working days of the bid opening and requested that their bridge be approved as an equal to the Continental Bridge. This company was advised that it wa.s too late to accept proposed substitutions. However, this company apparently contacted some bidders and represented that their bridge has been approved by the City. The price they quoted was evidently about $50,000 less than the price quoted by Continental Bridge Co. A review of the bid prices for Additive Alternate "A" in- dicates that some bidders were using the price quote from Con- tinental Bridge Co., and some were using the quote from this other company. Due to the fact that some bidders based their price for Additive Alternate "A" on the price quote for the unapproved bridge, we recommend that this alternate not be included in the contract award, but that the bridge be advertised as a separate project. 3-18-92 75-0264 ..L CITY OF SAN BEOARDINO - REQUESQFOR COUNCIL ACTION > STAFF REPORT Page 2 of 2 The special provisions state that bidders are to submit certain items with their bid. The low bidder failed to submit the Labor Certification and Prevailing Wage Certification, but faxed them to our office by 4:30, Tuesday, 3-17-92. This situ- ation has been discussed with Mr. Dennis Barlow of the City Attorney I s office, who advised us that this omission can be considered as a minor irregularity and can be waived. RESOLUTION CONTRACT TO ALLIED 30F NUNEZ PARK. 4 5 6 7 8 OF THE CITY OF SAN BERNARDINO AWARDING A SPRINKLER COMPANY, INC., FOR PHASE I EXPANSION BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Allied Sprinkler Company, Inc., is the lowest Phase I Expansion of Nunez Park, per responsible bidder for: Plan No. 7946. A contract is awarded accordingly to said bidder for the total amount of $375,602.35 for the Basic Bid, but such 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 award shall be effective only upon the contract being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifica- tions thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3.
