STAFF REPORT
At the July IS, 1991, meeting of the Mayor and Common
Council, action was taken on the formation of the Assessment
District known as AD 987. Funding for a 50% share was provided
by a loan from the Economic Development Agency. The Mayor and
Common Council have taken previous action to require all
developers in the Verdemont Area to participate in the cost of
designated improvements. They asked staff to formalize the
requirement by ordinance and resolution at the July meeting.
Prior to this action, all development had been conditioned
in the review process to "participate in the assessment district
or other funding program. . .,n as a normal condition. In some
cases, funds had been collected for the Chestnut Drain and for
the box culvert/traffic signal at Palm Avenue and Kendall Drive.
A resolution for the Chestnut Area Drainage surcharge was
prepared in 1990, but no formal action was prepared on the Palm
Avenue Box Culvert/Traffic Signal although conditions did require
payment of a fee of $0.04 per square foot. .
The ordinance was adopted 1-6-92 (MC 816) and the
resolution setting forth the special fees/charges for a specific
area of Verdemont to generate funds for the repayment of the loan
from EDA is attached. Although the item was advertised in The
Sun, per Government Code, the resolution and staff report were
not included in the 2-17-92 agenda. It has been determined that
it should not be considered as a part of the continued item from
10-7-91.
The fee is set at $0.02 per square foot of lot area (50%
of the original $0.04 fee) and provides for repayment of the loan
for these improvements within 7 years at 7% interest. Should the
time frame or interest rates change, the Mayor and Common Council
may take action to amend the resolution and the amount of fee
collected.
The area of special fee collection is the same as the
original proposed assessment district so all necessary findings
of need have been addressed in the Engineer's report.
The recommendation is to close the public hearing and
adopt the resolution setting the special fee and establishing the
fee area..

1 RESOLUTION
2 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING
A SPECIAL FEE AREA FOR PALM AVENUE BOX CULVERT AT CABLE CREEK
3 AND TRAFFIC SIGNALS AT PALM AVENUE AND KENDALL DRIVE.
4 WITNESSETH:
5 WHEREAS, development of the area in the vicinity of
6 Palm Avenue and Kendall Drive is contingent upon the
7 construction of the Box Culvert at Cable Creek and Palm Avenue
8 and the Traffic Signals at Palm Avenue and Kendall Drive, and
9
WHEREAS, construction of the box culvert and traffic
10 signal is needed to provide full access and protection for the
11 existing and future development; and
12 WHEREAS, authorization to proceed with AD 987 has been
13 granted for a 50S portion of the required funding, and
14
WHEREAS, no other financing plan has been established
15 to fund the remaining 50S cost of the improvements; and
16 WHEREAS, the City has advanced funds for construction
17 of the requi red improvements based on a loan from the Economi c
18 Development Agency; and
19 WHEREAS, a public hearing was duly advertised and held
20 on March 2, 1992, and duly closed; and

WHEREAS, it is necessary to impose a special fee of
$0.02 per square foot of net lot area on all development within
the Palm/Kendall Signal and Drain Special Fee Area,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
SECTION 1:
Prior to building permit approval
within the Palm/Kendall Signal and Drain Special Fee Area, the
following special fees shall be paid in addition to the normal
fees:

1 (1) For a 1.1 development, a fee of $0.02 per
2 square foot of the lot, excluding dedicated streets.
3 (2) Said special fee shall be adjusted annually
4 each July 15, in the amount of the change in the yearly
5 Construction Cost Index as published in the Engineering News
6 Record as of July 7 of each year.
7 SECTION 2. The Palm/Kendall Signal and Drain
8 Special Fee is augmented by Assessment District No. 987 which is
9 paying a 50S share of the costs.
10 SECTION 3. The Palm/Kendall Signal and Drain
11 Special Fee area is described as foll~ws:
12 That area shown as Zone 1 of Assessment District No.
13 987 as recorded wi th the County of San Bernardi no, offi ci al
14 records, Book 63, pages 53-72, of Assessment Di stri ct and
15 Community Facilities District Maps, and filed with the City
16 Department of Publ i c Works, in Book 29 begi nni ng at Page 25 of
17 Assessment District Maps.
18 SECTION 4. Funds collected from the special fees
19 in this area shall be applied as a repayment of a loan,
20 including interest, to the Palm/Kendall and Drain Special Fee
