STAFF REPORT
Bids for this project were opened on February 18, 1992, at
2:00 p.m.
A total
to $50,462.60.
of $32.317.00.
of 5 bids were received, ranging from $31,335.75
The low bid is 3% under the Engineer's Estimate
Additive Alternates A and B were included in the contract
documents, in the event that there would be sufficient funds to
finance these items. Alternate "A" is for the removal and re-
placement of the sand filters, and Alternate "B" is for
replacement of the chain link fence with wrought iron fence. The
Department of Parks and Recreation has indicated that they would
like to have both of these alternates included in the contract
award.
Below is the total estimated project cost, based upon the
actual low bid price:

An amount of $90,145.00 has been allocated under Account
No. 91-18.60 within the CDBG budget. Another project (Account
No. 90-58.35 - Renovation of Nunez Pool and Bath House) has also
been recently bid and surplus funds are available in that account
for transfer. Motion 1 approves the transfer of $8,055.00 from
Nunez Pool to the Delmann Heights Pool project. The Nunez Pool
renovation will still be adequately funded with 15% contin-
gencies.
Staff reconunends adoption of the resolution awarding the
contract.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MISSION POOLS OF ESCONDIDO FOR RENOVATION OF DELMANN
HEIGHTS COMMUNITY CENTER SWIMMING POOL.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Mission Pools of Escondido is the lowest
responsible bidder for: Renovation of Delmann Heights Community
Center Swimming Pool, per Plan No. 8630. A contract is awarded
accordingly to said bidder for the Basic Bid of $31,335.75,
Additive Alternate A for $27,529.00 and Additive Alternate B for
$21,221.59, for the total sum of $80,086.34, but such award shall
be effective only upon the contract being fully executed by both
parties.
All other bids, therefore, are hereby rejected. The
Mayor is hereby authorized and directed to execute said contract
on behalf of the City; a copy of the contract is on file in the
office of the City Clerk and incorporated herein by reference as
fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
