All as described in a report dated 4-23-91 by Building Inspectors Clark and Emery. REOUEST The appellant, Mr. Edward Duke requests that the Mayor and Common Council waive certain requirements that he believes to be arbitrary and capricious. Mr. Duke agrees to correct some of the violations, however he denies that he is legally required to correct other violations. Mr. Duke believes that he has an existing non- conforming situation. The issue is Health and Safety and living conditions for his tenants and lack of maintenance. BACKGROUND 11-1-71 A Certificate of occupancy was issued for 5 rental units on the property. 1987 General clean up and painting was completed to meet the city's requirement. 12-29-89 Applied for Certificate of occupancy. 4-23-91 An inspection and a report was made when a new certificate of occupancy was applied for. Mr. Duke appeared before the BBC and was ordered to correct the deficiencies or abate the nuisance at 1246 West Rialto Avenue. 8-16-91 Mr. Duke cannot rent, lease or occupy the structure until the structures meet the 1988 Uniform Housing Code Standards. 8-30-91 Appealed to the Council to reverse all or part of the BBC decision. 75.0264 - ~ o o Appeal of Findings of the BBC for 1246 W. OR Identify those violations that would be required to correct and waive those items that are believed to be arbitrary or excessive. In order to get a Certificate of Occupancy, an inspection must be made of the premises. Several deficiencies were noted at the time of inspection and these were to be corrected before a Certificate of Occupancy could be issued. ~. '" ~ , . It was noted at the time, that the buildings were built shortly after the turn of the century and therefore, were preexisting, non-confOrbling buildings. I was the Code Enforcement Officer .on the case, and I worked with Dean Pagel and Charles Emery to bring these buildings to as near compliance as was allowed by the codes. To my knowledge and recollection, there were five units on this property. . , t The buildings were repaired, repainted, and re-occupied. It is my opinion that anythin~ required over and above property maintenance and health safety items would constitute undue hardship and would not be required under existing codes G~d ordinancp.s. Based upon the evidence which was submitted, it is found and determined that the bui1ding(s) or premises 1246 Ria1to Avenue San Bernardino, at located California, constitute a public nuisance for the reasons set forth in Exhibit "A" attached hereto and incorporated herein by reference as though fully set forth at length as the finding of fact of the Board. SECTION 2. The owner is hereby directed to complete the abatement of the public nuisance by obtaining all necessary permits to correct the immediate health & safety hazards of the property within ten (10) days, which was the recommend- ation given by the Board of Building commissioners. SECTION 3. In the event the public nuisance is not abated within the prescribed period of time, the tenants will be vacated and the building(s) or premises shall be abated by the City of San Bernardino, or by a person(s) authorized by the Building Official, and the costs thereof made a lien on the lot or parcel of land upon which the public nuisance exists. Such costs may be added to any existing costs, made a personal obligation of the property owner and subject to immediate recovery by commencement of court proceedings against said party. SECTION 4. Request: The appellant, Mr. Maurice Peters requestst that the Mayor and Common Council waive certain requirements that he believes to be incompetent and deceitful. Mr Peters believes that he should not have to bring the structure(s) up to current Building and Safety Codes, that the vehicles should be disposed of in an orderly and decent manner, and that all administrative costs should not be assessed. Mr. Peters also requests that all Certificates of Occupancy and business licenses be issued immediately. Background: 5-31-91 Inspection made by the Code Compliance Division. At the time of inspection abandoned vehicles, large amounts of junk, trash and debris were located on the property. Inspection of the structure revealed substandard conditions and hazardous electrical wiring. 7-1-91 Reinspection was made by the Code Compliance Division. At the tim of in- spection violations observed on the original inspection still existed. A Ten Day Notice To Abate Nuisance was mailed to the owner on 7-1-91 with no response. 7-11-91 A follow up inspection made by the Code Compliance Division found that the violations still existed and had not been corrected. Therefore, the case was presented before the Board of BUilding Commissioners Meeting of 8-16-91. 8-16-91 Mr. Peters appeared before the BBC and was orderd to correct the deficiencies and abate the nuisance at 1095 W. Spruce. 8-30-91 Appealed to the Council to reverse all or part of the BBC decision. Mayor and Council Options: Uphold the findings of the Board of Building Commissioners and require owner to correct Health and Safety Violations and to rehabilitate the structure(s) to meet all Building and Safety Codes. BACKGROUND This is the first of several General Plan and Development Code amendments proposed by staff in an effort to preserve unique residential structures in the vicinity of Atlantic Street and Palm Avenue, as directed by the Common Council. The purpose is to allow the residences to be preserved until conversion to low intensity office uses occurs sometime in the future. The qeneral plan amendment was reviewed by the Environmental Review Committee (ERC) on July 11, 1991 and a determination was made that the proposed amendment will not have any siqni- ficant effects on the environment. The ERC recommended adoption of a Neqative Declaration. The 21 day public review and comment period extended from July 18, 1991 to Auqust 7, 1991. No comments were received. (Attachment A of Attach- ment 1, Initial study). On Auqust 6, 1991, General Plan Amendment No. 91-10 was reviewed by the Planninq Commission at a noticed public hearinq. The Planninq Commission recommended that the Mayor and Common Council adopt the resolution amendinq the General Plan and adopt the Neqative Declaration. The proposed amendment is internally consistent with the General Plan in that General Plan policies, objectives and goals encourage the revitilization of existing housing stock and the conversion of residential uses in the CO-2 to low intensity office uses and permitting existing residences to become conforming furthers the policies contained in the General Plan. 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience or welfare of the City in that adding residential use of existing residential structures as a permitted use allows the structures to be a conforming use which ensures the owners of the ability to maintain the structures which is in the public interest. 3. The proposed amendment would maintain the appro- priate balances of land uses in the city in that permitting an existing land use does not affect the balance of land use. RECOMMENDATION Staff recommends that the Planning commission make a recommendation to the Mayor and Common Council that: 1. BACKGROUND When the General Plan was adopted on June 2, 1989, it in- cluded provisions for the conversion of a residence to an office in CO-2. On April 15, 1991, the Mayor and Common council added provisions for a combination residence/office use in CO-1 and CO-2. CEOA STATUS An Initial Study of the proposed General Plan Amendment was prepared and presented to the Environmental Review Committee on July 11, 1991. A Neqative Declaration is proposed. The Initial Study was advertised and made available for public review from July 18, 1991 to Auqust 7, 1991. No comments were received. ANALYSIS The General Plan desiqnates a very small portion of the City (approximately 22 acres total) as CO-2, Commercial Office. The purpose of the district is to allow the conversion of residential structures to low intensity office uses. Therefore, many sinqle family residences now exist in the Commercial Office desiqnation. These homes have become leqal non-conforminq uses when occupied as a residence. As a leqal non-conforminq use, the homes may be occupied unless vacated for a continuous period of 6 months. However, repairs, alterations, and additions are severely limited. It is proposed that "1.29.13 - Allow existinq sinqle family resid- ential structures to remain as conforminq permitted uses" be added to the General Plan on paqe 1-94 (Attachment A). The purpose of the amendment is to make existinq residences a permitted use thereby a110winq them to become a conforminq use aqain. Goal 1A of the General Plan is to "provide for the continua- tion and development of sufficient land uses to serve the housinq, commercial, educational, cultural, recreational and social needs of existinq residents and population qrowth". Goal 1G(C) of the General Plan is to "provide for the revita- lization, adaptive reuse, and upqrade of deteriorated neiqh- borhoods and districts." The objective of the qoal (Objective 1.7) is to provide for the evolution of random patterns of development into a network of interrelated activities. The policy statement to achieve the qoal is 1. 7.1 "accommodate new development, adaptive reuse, and renovation in accordance with the Land Use Map." it planning commiss~ Meeting August 6, 1991 <:> General Plan Amendment No. 90-10 page 2 Objective 3.2 is to "provide incentives to private owners of historic resources to maintain and/or enhance their properties in a manner that will conserve the integrity of such resources in the best possible manner". Policy 3.2.7 is to "encourage appropriate adaptive reuse of historic resources in order to prevent misuse, disrepair and demolition, taking care to protect surrounding neighborhoods from disruptive intrusions." The proposed general plan amendment is consistent with these goals, objectives and policies. The first goal, "continuation...of sufficient land uses to serve the housing...needs of existing residents..." provides direction that existing housing stock should be allowed to continue. General Plan Amendment No. 91-10 will allow for the maintenance and upkeep of single family residential units until such time as an office conversion is proposed in accordance with Goal 1G(c), objective 1.7 and Policy 1.7.1. To allow the existing residences to become conforming will allow for revitalization and perhaps upgrades of the residential areas designated CO-2. Since many of the single family homes in the CO-2 designations have historic potential, Objective 3.2 and Policy 3.2.7 are both furthered by General Plan Amendment 91- 10. Three of the four existing CO-2 districts lie within the bounds of the Central City Area potential historic district as identified in Implementation I3.9 of the General Plan. The amendment proposed will enable "...maintenance and/or enhancement of . ..properties..." (Objective 3.2) as well as "...to prevent misuse, disrepair and demolition..." (Policy 3.2.7) until such time as an office conversion is proposed. The property owner of a non conforming single family residence in CO-2 may be unable to secure home improvement loans, property insurance and other necessities to maintain a structure. This could lead to further deterioration of single family structures which could eventually cause demolition of the units as opposed to adaptive reuse. To permit the single family use furthers the goals, objectives, CONCLUSION It is necessary to allow existing single family residences as a permitted use in CO-2 to enable the structures to be conforming uses instead of the legal non-conforming status which exists now.
