In November, 1987, the Mayor and Common Counei1 established a Mobi1ehome
Park Spaee Rental Assistance Program. Although the program was
reeommended as early as February, 1991, it was not until May, 1991 that
the Community Development Commission approved $100,000 from Twenty
Percent (20%) Set-Aside Funds for the eontinuation of said program.
Proar.. Guidelines
An Agreement has been drafted to implement the Mobilehome Park Spaee
Rental Assistanee Program. (See Attaehment I.) rhe following guidelines
will apply:
1. rhe minimum amount for housing will be thirty pereent (30%) of ineome.
2. rhe maximum amount of monthly subsidy will te $50. rhis amount will
be subjeet to periodie reviews by the Housing Committee.
3. rhe County of San Bernardino Community Services Department will
operate the program.
4. Persons whose rent subsidy requests are denied may appeal to the
Mobilehome Rent Board.
5. rhe County will be instructed to make the eheeks payable to both the
recipient and the Mobilehome park to ensure that the funds are
utilized to subsidize spaee rental eosts.
Based upon the preeeding information, staff reeommends adoption of the
form motion.

I. Recitals
(a) WHBRBAS, the DBPARTMBRT has developed and implemented a
proqram to provide rental assistance payments to qualified low income
mobilehome park tenants residinq in mobilehome parks located within the
incorporated boundaries of the City of San Bernardino;
(b)
WHBRBAS, the DBPARTMERT has established a special fund
(
which will serve as the source of this financial assistance;
(c) WHBRBAS, the County has administered a similar program
operated in the Yucaipa area, and has administered the ezistinq proqram for
)
the City over the past two and one-half (2 1/2) years;
(d)
WHBRBAS, the DBPARTMBRT desires to continue to retain the
services of the County, throuqh its Community Services Department (CSD), to
administer the City's rental assistance proqram and the County aqrees to
undertake such administration;
The parties, therefore, mutually aqree as followsl
II.
SCODe of Servic.sl CSD shall perform the followinq tasks under
this aqreementl
(a) Work with the City to develop the appropriate
information, correspondence and application materials for the Rental
Assistance Program, which will be identified on all forms, checks and
correspondence as the "City of San Bernardino MObilehome Park Space Rental
Assistance proqram".

(b) Disseminate information and application materials. CSD

will maintain in its office copies of information and application materials

for the City's Space Rental Assistance Program, and will make that information
available to mobilehome park tenants upon request. CSD will not be involved
in any other outreach or promotional activities reqardinq the proqram.
(c)
Certify applicant eliqibility. CSD will certify

applicant eliqibility for rental assistance payments, qive eliqibility
criteria established by the City based on, (1) current income limits adjusted
by family size (eliqibility may be certified bond or copies of checks and/or
check stubs, siqned tax returns, investment and/or trust fund income and/or
pension statements or checks) and, (Z) amount the household currently spends
for housinq (includinq a sworn statement of family size and documentation of

housinq ezpenses includinq space rent, plus rent or mortqaqe payment on the
coach, plus utilities and insurance).
(d) When eliqibility is denied, CSD will send a notification

to the applicant, informinq the applicant of the reason for denial. Questions
and review will be directed to

When eliqibility is approved, CSD will send a
notification of approval statinq the amount of the qrant payment, when it will
beqin, and the requirement for annual recertification of eliqibility. At least
thirty (30) days prior to the annual recertification date, CSD will inform the
qrantee of the need to recertify information and proceed with recertification
and subsequent qrant adjustment or termination, as appropriate.

(f) CSD will maintain a separate file for each applicant and

shall update and maintain this file as additional correspondence and
information are received. csn will also maintain a computer-based file on each
applicant with the information. recorded in such form as to facilitate
subsequent analyses, summarization, and for periodic program evaluation
purposes.

csn shall prepare and distribute '1rant checks. Special
imprinted checks shall be used by csn with the City of San Bernardino
Mobilehome Park Space Rental Assistance Pro'1ram identified thereon. csn will
require signature authority for the checks and will use whatever name and
title the City designates. Checks will be prepared by csn and distributed (by
mail) sometime bet_en the 25th and 30th of each month, so that clients may
(
apply the payment to the space rent due on the first of the followin'1 month.
Checks will be made payable to the mobilehome park and the client.
(h) csn shall administer the Rental Assistance pro'1ram Fund.

Upon initiation of this pro'1ram, the City will deposit with csn a sum not to
ezceed $10,000.00. csn will assume responsibility for fund administration,
includin'1 investin'1 the fund balance in a bank or bank branch within the City
of San Bernardino area for additional interest income, reconcilin'1 the
account, and reportin'1 on the fund balances monthly as indicated below.
(i)
Provide monthly reports. csn will provide a monthly
statement of fund activity to the nEPARTMEHT. The report will document the
'1rant payments made to individuals or families durin'1 the month, fees paid to
csn for administration, and indicate the fund's be'1inning and endin'1 balance,
including any interest earned.

(j) Upon r.quest, CSD will provide summary analytical reports
indicating grant activity trends, geographic distribution of grantees by park,
and other information of interest to the City and/or CSD which may be
qenerated from program operations.
(k)
These funds will be audited under the single Audit Act of
1984.
III. COmDensation to eSD for Administration I CSD agrees to
administer the City's Mobilehome Park Space Rental Asaistance Program,
including the tasks d.scribed in Section "II" above, for the following
compensation I
(a)
Actual monthly cost of postage xeroz copies, computer
time, and supplies such as envelopes and stationary, payable to CSD's
(
Corporation account. Copies of invoices will be forwarded to the City.
(b) Actual cost of occasional ezpenses such as printing of
checks and application forms, and a pro-rated share of CSD's audit and
)
computer programing costs. Copies of invoices will be forwarded to the
DEPAllTMENT.
(c)
per month for onqoing program
administration and reporting, as described in Section "II", items (a) through
(k) above.
CSD's fe.. will be paid out of the fund upon presentation of
invoice. CSD reserves the right to re-ezamine the fee structure after one (1)
year and propose revisions in compensation arrangements.

Aqreement will commence on July 1. 1991 aDd continue until the fUDe!. balance is
totally expended as determined by the Bzecutive Director of the Development
Department of the City of San Bernardino. This Aqreement may be terminated
upon sixty (60) days written prior notice by any party to the other.
V. RelationshiD of Parties. Under this Aqreement. CSD is
serving as an independent contractor to the City to provide the services as
described above. The CSD staff shall not be supervised. directed. or under
the control or authority of any DEPARTMEHT officer or employee.
VI.
Amendment.. This Aqreement may be amended or modified only by
written agreement by both parties. and failure on the part of either party to
enforce any provision of this Aqreement shall not be construed as a waiver of

the right to compel enforcement of such provision or provisions. nor act to
release any surety from its obligations under this Aqreement.
VII. Notices. ALL notices herein required shall be in writing and

IX. Entire Aareement. This Agreement and any document or
instrument attached hereto or referred to herein inteqrates all terms and
conditions mentioned herein or incidental hereto. and supersedes all
neqotiations and prior vritinq in respect to the subject matter hereof. In
the event of conflict between the terms. conditions or provisions of this
Agreement. and any such document or instrument. the terms of this Agreement
shall prevail.
