STAFF REPORT
Due to the construction of the new Rialto High School, street improvements are
being installed on the South side of Mill Street between Pepper Avenue and
Eucalyptus Avenue. This construction necessitates the removal and relocation of
some of Southern California Edison's electrical facilities. These facilities are
currently located in previously granted rights-of-way, some of which were granted
as far back as 1956 (see attached "Distribution Easement"). Southern California
Edison is requesting the Common Use Agreement in order that they do not lose
their current "prior" rights-of-way. Essentially, the Co.on Use Agreement
agrees that the City will be responsible for any future relocation costs that
Southern California Edison may incur if the City requests Southern California
Edison to relocate these electrical facilities. The chances of this happening
within the next 30 to 40 years is remote.
This individual acceptance is necessary as the Common Use Agreement from the
County contains certain conditions and covenants. The document. however, does
not contain any unduly adverse restrictions or reservations, and no appropriation
of money is required. Upon execution of the Common Use Agreement by the Mayor
and City Clerk, the document will be sent for recordation by the City Clerk. A
fully executed original document will then be returned to Southern California
Edison for their files.
It is therefore Staff's recommendation that the Resolution be adopted and the
document(s) be executed.

ANCE AND EXECUTION OF A COMMON USE AGREEMENT WITH THE SOUTHERN CALIFORNIA
EDISON COIfPANY FOR THE RELOCATION OF ELECTRICAL FACILITIES FROM PREVIOUSLY
GRANTED RIGHTS-OF-WAY TO Nh'WLY EXrENDED RIGHT-OF-WAY IN THE SOUTH SIDE OF
MILL STREET BETWEEN PEPPER AVENUE AND EUCALYPTUS AVENUE (DUE TO THE CON-
STRUCTION OF THE NEW RIALTO HIGH SCHOOL).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor of the City of San Bernardino is
hereby authorized and directed to execute and accept on behalf of said City,
a . Common Use Agreement with the Southern California Edison Company, a copy
of which is attached hereto and incorporated by reference herein, as fully
as though set forth in length, marked Exhibit "A", for the relocation of
12 electrical facilities for which Southern California Edison Company has
13 previous rights-of-way and easements. more particularly described in said
14 Common Use Agreement and concerning that certain real property in the City
15 of San Bernardino. County of San Bernardino. State of California, generally
16 located on the South side of Mill Street between Pepper Avenue and
17 Eucalyptus Avenue. Said City consents to the recordation thereof.

SECTION 2. The authorization to execute the above-referenced
19 agreement is rescinded if the parties to the agreement fail to execute it
20 within one hundred twenty (120) days of the passage of this resolution.
