CITY OF SAN BERfi,4RDINO - REQUEST ~R COUNCIL ACTION ': ' ""..1 ., STAFF REPORT On May 1, 1991, the City of San Bernardino began the inspection of Mobi1ehome Parks within the City. The City of San Bernardino has been given authority by the State of California under the auspices of the Mobilehome Rent Board to conduct these inspections. CUrrently, the City receives approximately $25,200 a year to conduct these inspections. Through these inspections the City of San Bernardino is helping to eliminate blight and improve the quality of the life within the mobilehome parks. On the whole, the inspection program has met with great success. In fact, the meetings that have been held prior to inspecting the parks has ended in rounds of applause. As in any program, there are a few who have refused to correct their violations and will force the City into following up on the citations to obtain compliance. It was discovered when the City began to enforce it's citations that although the City had the authority to perform the inspections, it does not have the authority to enforce the law. (CCRT.25 2.1. 1004) "Requires Local Agencies to adopt by Official Ordinance Title 25 the state law governing mobilehome parks.: Since there is nothing on file to indicate the City has adopted Title 25; and thus received the authority to enforce the law, it is necessary for the Mayor and Common Council to approve adding Chapter 15.55 to the San Bernardino Municipal Code which will give the City inspectors the authority to enforce the law. AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 15.55 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO LOCAL ENFORCEMENT OF LAWS AND REGULATIONS RELATING TO MOBILE HOME PARKS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 15.55 is hereby added to the San Bernardino Municipal Code to read as follows: 15.55.010 Authority. This Chapter is adopted pursuant to the authority of Health and Safety Code S18300 and Section 1004 of Title 25 of the California Code of Regulations. 15.55.020 Assumption of Responsibility. The City of San Bernardino hereby assumes responsibili ty for enfoJ::cement of the Health and Safety Code, Division 13, Part 2.1, (beginning with S18200), and the related administrative regulations as are adopted from time to time. This assumption of responsibility shall be effective sixty ( 60) days after the adoption of this Chapter. 15.55.030 Enforcement Responsibility. The Planning and Building Services Department of the City shall have the responsibility to enforce the statutes and regulations referred to in this Chapter. The Department shall be assisted by any other City officer, employee, board or commission in bringing deficiencies or violations to the attention of the Department while in the process of fulfilling their statutory responsibilities. The City will provide qualified personnel adequate to enforce the provisions of the statutes and regulations referred to in this Chapter. Currently, the City has four (4) Code Enforcement Officers with one ( 1 ) supervising personnel and five (5) Building Inspectors with four (4) supervising personnel to enforce these provisions, which total numbers may be adjusted from time to time. 15.55.050 Fees. The Mayor and Common Council shall from time to time by resolution adopt a schedule of fees consistent with those established from time to time in Health and Safety Code, Division 13, Part 2.1, and related administrative regulations. 15.55.060 Objectives. The City hereby adopts and approves the State program and objectives as contained in Health and Safety Code, Division 13, Part 2.1, and related administrative regulations. 15.55.070 Existing Mobile Rome Parks. There are currently forty-two (42) mobile home parks in the City ranging from excellent condition with few violations to poor condition with numerous building violations. Generally, these are at or near maximum occupancy. 15.55.080 Local Findings and Inspection. The Mayor and Common Council, therefore, direct that each of the parks be inspected on a regular ongoing basis in compliance with state regulations to ascertain compliance with the applicable codes to assure that such residents have a safe and healthful place in which to live. 15.55.090 Forms.
