RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO SUPPORTING THE TAKING INTO TRUST BY THE FEDERAL GOVERNMENT OF CERTAIN PROPERTY FOR THE BENEFIT OF THE SAN MANUEL BAND OF MISSION INDIANS. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, the San Manuel Bank'! of Mission Indians is a federally recognized tribe of American Indians which once occupied lands throughout the San Bernardino area but now occupies a small reservation near the City of San Bernardino; and, WHEREAS, the San Manuel Band operates a gaming project on its reservation that makes important contributions to the tribe by providing job training, employment, health and educational benefits, needed revenues to the tribal government, and general self-sufficiency free from state or federal aid; and, WHEREAS, the San Manuel gaming project provides important benefits to the community at large in providing jobs to the general population, supporting many local businesses and suppliers, and making financial contributions to local schools and charities, and which enjoys a good reputation generally in the community and with law enforcement; and, WHEREAS, the San Manuel Band plans to expand its gaming facility but would like to do so at a site which would allow for a greater variety of commercial development in connection with the facility than might be possible on the present reservation site, and the City finds that moving the gaming facility to such a site would have numerous benefits to the City and its population, including increased job opportunities, the development of retail III DABlbg [Indian. Res] 1 November 4, 1991 / o o 1 and entertainment facilities, and the stimulation of further 2 development opportunities for the community; and, 3 WHEREAS, that certain parcel now generally described as the 4 Club development on Waterman Avenue and described more 5 particularly in Exhibit A attached hereto is a substantially 6 vacant commercially developed shopping center that would be a 7 feasible site for the San Manuel Band's gaming project and would 8 allow the tribe suitable space for the related development and job 9 opportunities described above; and, 10 WHEREAS, in order for the San Manuel Band to occupy and 11 operate a gaming project and engage in such development the parcel 12 must be taken into trust by the federal government for the benefit 13 of the Band and as part of its reservation, and the City finds 14 that taking such land into trust would be in the best interest of 15 the San Manuel Band and its members and would be beneficial, and 16 not detrimental, to the surrounding community, 17 NOW THEREFORE, be it resolved that the City of San 18 Bernardino fully supports the taking of the subject property, 19 described in Exhibit A hereto, into trust by the United States for 20 the benefit of the San Manuel Band of Mission Indians and the 21 establishment of the San Manuel gaming establishment on such land 22 and that such entrustment and gaming establishment would be in the 23 best interest of the San Manuel Band and its members and would be 24 beneficial, and not detrimental, to the surrounding community, 25 subject to the fOllowing conditions: 26 a. In such Agreement the San Manuel Band agree to not operate off track betting at the new site.
