STAFF REPORT
Bids for widening the South "E" Street Bridge were opened
at 2:00 p.m., on Tuesday, October 29, 1991.
A total of 8 bids were received, ranging from
$3,599,452.80 to $4,427,157.50, The low bid of $3,599,452.80 is
19.5% under the Engineer's Estimate of $4,472,325.00.
Below is the total estimated project cost, based upon the
actual low bid price:

At their meeting of 8-7-91, the SANBAG Board approved $4.2
Million, in Measure "I" Arterial Funds, for this project. An
additional $1 Million was authorized from bond proceeds by the
Community Development Commission on 9-3-91, for a total available
balance of $5.2 million.
It appears that about $240,000 of the bond proceeds will
be needed to fully finance this project, thereby making $760,000
available for other projects.
An agreement with SANBAG will be needed to stipulate the
procedure for disbursement of the $4.2 million. This agreement
will provide that the City will expend the funds and submit
monthly claims to SANBAG for reimbursement.
The Contractor has indicated there is a 99% chance he will
exercise the contract provision allowing the start date to be
delayed until March 15, 1992. This allows time for ordering of
materials, staging of the project, avoiding working during rainy
weather, and gives sufficient time for utility relocations to be
completed.
Staff recommends adoption of the resolution awarding the
contract to the low bidder.
URGENCY CLAUSE
The Development Agreement with Wal-Mart is scheduled to be on the
Council Supplemental Agenda of 11-4-91, and it proposes that the
available balance of $760,000 from the South "E" Street Bridge be
used to fund the improvements that will be financed by the City.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BRUTOCO ENGINEERING & CONSTRUCTION, INC. FOR WIDENING
3 OF "E" STREET BRIDGE OVER THE SANTA ANA RIVER.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Brutoco Engineering & Construction, Inc. is
the lowest responsible bidder for: Widening of "E" Street Bridge
over the Santa Ana River, per Plan No. 8347. A contract is
awarded accordingly to said bidder for the total amount of
$3,599,452.80, but such award shall be effective only upon the
contract being fully executed by the parties. All other bids,
therefore, are hereby rej ected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
