57478 (40th Street fill in)
07-01-91 -- Resolution No. 91-277 adopted. authorizing execution of a purchase
contract for property along the south side of 40th st.

'CITY OF SAN BER~RDINO - REQUEST CPR COUNCIL ACTION
STAFF REPORT
Plan No. 8433, for the widening the South side of 40th Street, between Third
Avenue aDd Cottage Drive was prepared by the Engineering Division and approved on May
20, 1991. Authorization was given to advertise for bids for the proposed project.
On 3-18-91, Underground utility District 20 was created for undergrounding the
various overhead utilities along 40th Street fro. Kendall Drive to Pal. Drive. The
~jority of the overhead facilities are located along the North side of 40th Street.
The City and .ColDlty have entered into a Cooperative Agree.ent relative to the
preparation of plans and acquisition of the necessary additional right-of-way for the
widening of 40th Street. Acquisition of the additional right-Of-Way is expected to
take up to a year.
The full widening of 40th Street, between Third Avenue and Acre Lane will be
delayed for at least a year to allow for the necessary acquisitions and removal of
overhead utilities. However, the South side of 40th Street, froll Third Avenue to
Cottage can be widened at this ti.e.
On July 1, 1991, resolution 91-277 was adopted, authorizing the execution of a
purchase agre_nt with the San Bernardino COlDlty Flood control, for the acquisition
of a 22 foot wide strip of land located along the South side of 40th Street, West of
Acre Lane.
The attached resolution dedicates that property acquired from the Flood
Control, for street and highway purposes.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A BOUNDARY
FOR A PORTION OF THE SOUTH SIDE OF 40TH STREET, WEST OF -ACRE LANE, AND
DEDICATION OF SAME FOR STREET AND HIGHWAY PURPOSES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor llIld Co_on Council of the City of San
Bernardino hereby establish a boundary for a portion of the South side of
40th street, West of Acre Lane, described as follows:
Portions of those parts of Lot 38, Rancho I'luscupiabe, as per IMp
recorded in Book 7 of Maps, page 23. Records of San Bernardino
County, said parts described in docu.ents recorded April 23, 1940
in Book 1407, page 304 as parcel 3 llIld in docu.ents recorded June
30, 1967 in Book 6848, page 841, both Official Records of said
County, said portions being all of said parts lying within a strip
of land 22.00 feet wide, the South line of said strip being 42.00
feet Southerly of and parallel with the centerline of 40th Street
(40.00 feet wide), as said 40th Street is shown on Record of
Survey recorded in Book 32, page 56, Records of said County.
SECTION 2. That the Mayor and Co_on Council of the City of San
Bernardino hereby dedicate for street llIld highway purposes, all of the
above described portion of the South side of 40th Street, West of Acre Lane.
SECTION 3. That the City Clerk of the City of San Bernardino shall
cause a certified copy of this resolution to be recorded in the office of
the County Recorder of the County of San Bernardino.
