STAFF REPORT On June 30, 1991, the a9reement for joint operational responsibility for the Seccombe Lake State Urban Recreation Area came to an end. The agreement provided for phasing out the State's responsibilities for the park over a period of 5 years arid upon termin- ation of the agreement for transferring all titles to, and operation and maintenance responsibility for all See combe Lake Park property to the City for park purposes in perpetuity, and no other use, sale, or disposition of the property shall be permitted except by specific act of legislature. (See attached copy of Assembly Bill 3984, Chapter 1488). The attached resolution and copy of the Quit Claim Deed is submitted for approval and acceptance by the Mayor and Common Council. Upon approval and acceptance, a certified copy of the resolution will be forwarded to the Department of General Services, which will in turn forward to the City the original deed for recording. The Quit Claim Deed and all descriptions as listed on Exhibit "A" thereto have been reviewed by the City Real Property Division and the State Department of General Ser- vices prepared the final documents. The California Park and Recreaticmal Facilities Act of 1984 I authorizes state general obliptlon bonds for, amOng other things, the acquISition of real property u an addition to an existing unit of the state park ~ and the deve10pment of real property lor the state park system. . .' .' Under existing law, the SeccOmbe Lake State Urban Recreation Area in the Oty of Sari Bernardino is a unit of the state park system, and the Department of Paries and Recreation is required to provide for operation of the urban recreation area on a cost-sharing buis with the city. . This bill would repeal those provisions relating to. department operation of the area on a cost-sharing buis. The bill would amend and supplement Item 3790-304-722 of the Budget Act of 1986, to appropriate n,176:000 hom the Parklands Fund of 1984 to the department for working drawings and construction at the urban recreation area if .the city and state enter into a 5-year operation and maintenance agreement with specified terms for the area. The bill would, upon the expiration or termination of that agreement, require the state to trllJlSfer all title to, and responsibility for the operation and maintenance of, the urban recreAtion area, to the city for park purposes only, in perpetuity, and DO other use, sale, of disposition of the park would be permitted, except by specific act of the Legislature. Upon a breach of any condition of the trllJlSfer, the state would be authorized to reenter the property and it would revert to the State. The bill would require that while the agreement is in force Seccombe Lake Park remain a unit of the state park system 91 IlO ~",.'"-'--- ,.,_..~ o o Ch. 1488 -2- and upon the expimtion or termination of the agreement, the park would become a municipal park of the City of San Bernardino. The bill would also require transfer to the city of fee title to specified parcels in the urban recreation area, with title to a specified parcel to be transfeued immediately upon receiving approval from the U.S. Department of the Interior. The bill would require that, during the 5-year period of joint city and state operation of the recreation area, all revenues therefrom be retain'ed by the city for Seecombe Lake Park purposes. The bill would make conforming changes. The bill would appropriate $66,000 from the General Fund to the department for operation costs of the Seccombe Lake State Urban Recreation Area for the 1986-87 fiscal year. The bill would state the intent of the. Legislature that the state operation costs of the recreation area be included in the annual Budget Act in subsequent fiscal years. The bill would declare that it is to take effect immediately as an urgency statute. . - Appropriation: yes. .The people of the State of California do enact as follows: SECTION 1. Section 50(17.1 of the Public Resources Code is amended to read: ' 5007.1. Lands' purchased- or otherwise acquired by 'the department at the Pail p'acific project, which are to be operated and maintained by other public agencies under agreements entered into pursuant to Section 5080.30, shall not be subject to the provisions of Section 5002.1, 5002.2, 5002.3, or 5002.4, or Article 1.7 (commencing with Section 5019.50) of this chapter, during the term of those agreements. Any facilitY to be developed on those lands shaII only be constructed in accordance with a development plan approved by the director. SEC. 2. Item 3790-304-722 is added to the Budget Act of 1986, to read: -- . The sum of sixty-six thousand dollars ($66,000) is hereby appropriated from the General Fund to the Department of Parks and Recreation for the 1986-87 fiscal year for operation costs of the Seccombe Lake State Urban Recreation Area. . It is the intent of the Legislature that state operation costs for Seccombe Lake State Urban Recreation Area, incurred while the agreement required by Item 3790-304-722 of the Budget Act of 1986 is in force, be included in the annual Budget Act. SEC. 6. This act is an urgenCy statute necessary for the immedi- ate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to accept on behalf of said City a Quit Claim Deed from the State of California, a copy of which is attached hereto marked Exhibit "A" and incorporated by reference herein as fully as though set forth at length, concerning that certain real property in the City of San Bernardino, California more particularly described'in said Quit Claim Deed, and known as Seccombe Lake State Urban Recreation Area bounded by 5th Street, 7th Street, Waterman Avenue and Sierra Way.
