Bids for this project were opened at 2:00 p.m., on Tuesday,
October 1, 1991.
A total of 15 bids were received, ranging
to $365,787.40. The low bid of $244,930 is

TOTAL ESTIMATED PROJECT COST
An amount of $133,000 has been allocated, under Account No.
248-368-57875, for the Waterman Avenue Storm Drain, and an amount
of $180,000 has been allocated under Account No. 248-368-57809,
for the Nor:thpark Boulevard Storm Drain. The total amount of
funds allocated for this project is, therefore, $313,000.
We recommend that a contract be awarded to the low bidder.
URGENCY CLAUSE:
It is necessary to have the Waterman Avenue Storm Drain completed
before the rainy season in order to provide improved flood pro-
tection.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO KERSHAW CONSTRUCTION COMPANY, INC. FOR CONSTRUCTION
OF STORM DRAIN IMPROVEMENTS IN WATERMAN AVENUE, FROM WEIR ROAD TO
COMMERCIAL ROAD, AND IN NORTHPARK BOULEVARD, FROM "F" STREET TO
MAYFIELD AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1 .
Kershaw Construction Company, Inc. is the
lowest responsible bidder for: Construction of Storm Drain
Improvements in Waterman Avenue, from Weir Road to Commercial
Road, and in Northpark Boulevard, from "F" Street to Mayfield
Avenue" per Plans Nos. 8551 and 8403.

A contract is awarded
accor9ingly to said bidder for the total amount of $244,930.00,
\
comprised of $104,130 for Schedule A (Waterman Avenue) and
$140,800 for Schedule B (Northpark Boulevard), but such award
shall be effective only upon the contract being fully executed by
the parties.
All other bids, therefore, are hereby rejected.
The Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is on file
in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modi fica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
