STAFF REPORT
Edison proposed that a Rule 20-B Underground Project be
established to underground the utilities on 21st Street, from
crestview Avenue to San Gabriel Avenue. At the Council meeting
of 8-5-91, the expenditure of $94,000 from the 1991/92 Street
Lighting and Street .Sweeping District was approved.
The estimated cost to the City for undergrounding Edison's
facilities was $64,000. After bids were received, the actual
cost has been determined to be $63,196.00.
The proposed Agreement for Replacement of Overhead With
Underground Distribution Facilities has been prepared by Edison.
This Agreement provides, in general, that the City will pay
Edison the amount of $63,196.00, and Edison will complete the
under grounding (and finance the balance of the total
undergrounding cost).
We recommend that the Agreement be approved.

RESOLUTION NO.

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an Agreement with Southern California Edison Company relating to
9 the replacement of overhead with underground distribution
10 facilities on Twenty-First Street, from Crestview Avenue to San
11 Gabriel Avenue, a copy of which is attached hereto, marked
12 Exhibit "A" and incorporated herein by reference as fully as
13 though set forth at length.
14 SECTION 2. The agreement shall not take effect until
15 fully signed and executed by all parties. The City shall not be
16 obligated hereunder unless and until the agreement is fully
17 executed and no oral agreement relating thereto shall be implied
18 or authorized.
19 SECTION 3. The authorization to execute the above-

between SOUTHERN CALIFORNIA EDISON COMPANY. a corporation. here;naHer called .Utility'. and
the party or parties whose names are subscnbed hereunder as . Applicants'. Ci ty of San
Bernardino.
WITNESSETH:
WHEREAS. Applicants have requested Utility. pursuam to Section B. Of Utility's Rule No. 20.
Replacement of Overhead with Underground 'Distribution Facilities. to replace Utility's existing overhead
with underground distribution facilities at the locatIon or locations in the Coumy of
San B..rna rd i no . State of California. SUbstantially described as follows:

and as shown on the map attached hereto and made a part hereof; and
WHEREAS.
a. It is necessary for all property owners served from UlIlity's overhead facHilles to be
removed to agree in writing to perform the wirin~ chant!:es 011 owners' premises so that service may be
furDlshed from Utility's undergrouud distributiou system in accordance with Utility's rules and that
Utility may discontinue Utility's overhead servICe upon completion of UtIlllY's underpound facIlities. or
b. Suitable legislation is in effect reqUIring such property owuers to make such necessary
wiring changes and authonzing Utility to discontinue UlIlity's ovel'head S"IYlce; and
WHEREAS. Applicants have requested Utility to furnish allll lIlstall the padS and vaults for
transformers and associated equipment. conduits, ducts. boxes. and electrolier bases and to perform
other work related to structures and substructures IIIcluding breaking of pavement. trenching, backfilling,
and repaving required in connection with installation of the underground system; and
WHEREAS. Underground service connections to each applicant from Utility's underground
distribution system will be installed and maintained as provided in UtIlit,Y's rules applicable thereto;
NOW. THEREFORE, in cousideration of the premises, and of the mU1ual promises and
covenants of the parties hereto, hereinafter contained. it is mutually agreed by and between the panies
hereto as follows, viz.: '
1. Applicants ifll1 pay to Utility concurrently with the execution of this agreement the
nonrefundable amount of S 63.196.00, which is the sum of S 53.483.00, the estimated cost of
furnishing and installing the underground structures and substructures. lIleluding breaking of pavement.
trenching, backCillinll, and paving required in connecllon with installatIon of the uuderground system,
and of S 9.713.00, the excess, if any, of the estimated costs, exclUSIve of transformers, meters and
services. of completing the underground system over building a new equivalent overhead system. The
amount contributed by each Of said Applicants is shown hereinal'ler.
2. Utility will complete the undergrounding of said overhead distribullon facilities, pro-
vided. however, Utility has been granted rights of way therefor satisfactory to and without cost to Utility.
3. Said underground distribution facilities will be and will remain the property Of Utility.

5. This contract. is subject to the Rules of Utility.
6. This contract shall at all times be snbject to such chan!\es or modifications by the
Public Utilities Commission of the State of California as said Commission may. from time to time. direct
