06/05/72 --- Resolution 11070 adopted authorizing use of 9.200 square feet of
City Hall Space by Municipal Water Department.
09/22/87 --- Resolution 86-383 adopted First Amendment to Lease increasing
rental rate to $1.25 per square foot for 10.557 square feet of
space in City Hall.

STAFF REPORT
The recent move of the Community Development Department from the 5th floor of
City Hall to the City Hall Annex (along with the Redevelopment Agency) left the
Community Development offices vacant.
The Water Department wishes to use this 2.156 square feet for Water Department
offices. This addition to currently occupied space increases the total square
footage being used by the Water Department to 12.248 square feet. The additional
space will be billed at the rate of 51.25 per square foot. bringing the total
rent to 532.340.00 per year. The billing advice reflecting this addition has
been sent to Finance. with the beginning date of August 1. 1991.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF A SECOND AMENDMENT TO LEASE WITH THE BOARD OF WATER COMMISSIONERS
PERTAINING TO THE ADDITION OF 2,156 SQUARE FEET OF OFFICE SPACE ON THE FIFTH
FLOOR OF CITY HALL TO THAT ALREADY LEASED BY THE WATER DEPARTMENT
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION
1.
The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City, a Second
Amendment to Lease with the Board of Water Commissioners relating to the
lease of office space in City Hall, a copy of which is attached hereto.
marked Exhibit "A" and incorporated herein by reference as fully as though
set forth at length.
SECTIOK 2.
The authorization to execute the above-referenced
Amendment to Lease is rescinded if the parties to the Amendment to Lease
fail to execute it within sixty (60) days of the passage of this resolution.

1 SECOND AMENDMENT TO LEASE
2 THIS SECOND AMENDMENT TO LEASE is made and entered into this
3 day of , 1991. by and between the CITY OF SAN
4 BERNARDINO. a municipal corporation, hereinafter referred to as "Lessor".
5 and THE BOARD OF liATER COMMISSIONERS, hereinafter referred to as "Lessee".
6 WITNESSETH
7 WHEREAS. the parties hereto executed a lease dated June 5. 1972.
8 for the rental of office space in City Hall from April 1, 1972 through April
9 1. 2002, hereinafter referred to as "the Agreement"; and
10 WHEREAS. the parties hereto executed a First Amendment to Lease
11 dated October 10. 1986, increasing the annual rental payment due under the
12 Agreement to $1.25 per square foot per month and stating that any additional
13 square footage shall be chargeable at that same rate of $1.25 per square
14 foot; and
15 WHEREAS. the parties hereto desire to amend said lease to modify
16 the description of the real property as contained therein,

18 NOW. THEREFORE, it is mutually agreed between the parties as
19 follows:
20 1. Section 1 Leased Propertv. of that modified lease between
21 the parties hereto dated June 5, 1972. is hereby amended to read as follows:
22 "Lessor hereby leases to Lessee approximately 12.248 square feet of
23 office space located on the second and tifth floors of City Hall. situated
24 in real property generally described as the City Hall, located at 300 North
25 "D" Street, San Bernardino, California, upon the terms and conditions here-
26 inafter set forth."
27 2. All other terms. conditions and covenants of said lease
28 shall remain the same and be in full force and effect.
