Subject: Verdemont Infrastructure Fee
Parcels in Verdemont Community
Facilities District No. 1006
Synopsis of Previous Council action:
12-04-89 -- Ordinance No. MC-690 adopted levying an infrastructure
development fee for right-of-way improvements in the
Verdemont Area.
06-25-90 -- Resolution No. 90-253 adopted revising infrastructure
fee to be levied, for right-of-way improvements and
public improvements.
11-21-90 -- Ordinance No. MC-755 adopted deferring the time for
payment of the Verdemont Infrastructure Fee until close
of escrow, for any subdivision for which a final map has
been approved prior to establishment of this fee.
Recommended motion:
That further reading of the ordinance be waived and it be laid over for final
adoption.

STAFF REPORT
Several final maps had been approved in the Verdemont Area
at the time the infrastructure fee was approved. The subdividers
of these tracts requested approval to delay payment of the fee
until the close of. .escrow, since it had not been included in
their estimates of costs and payment at time of building permit
issuance would constitute a real hardship. Deferral of this fee
was authorized by Ordinance No. MC-755.
The owners of 11 parcels have signed petitions requesting
formation of another Community Facilities District to finance
their Verdemont Infrastructure Fee and School Impaction Fee.
These petitions and resolutions initiating proceedings for this
district are scheduled to be on the Council agenda of 9-16-91.
According to the preliminary schedule, this district is to be
established in December, 1991.
Letters dated 6-26-91 and 8-05-91 have been received from
Mr. M. J. Gerber, President of Michael John Enterprises,
requesting that the time for payment of the Verdemont Infrastruc-
ture fees be deferred until the close of escrow, or formation of
a Community Facilities District. This request is due to their
expectation to be ready to secure Building Permits in about 60
days, which will be prior to the date for establishment of the
district.
The proposed ordinance authorizes deferral of the
Verdemont Infrastructure fee, for the 11 parcels in proposed
Community Facilities District No. 1006, until close of escrow or
establishment of this district.

ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
15.73.060 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
TIME FOR PAYMENT OF THE VERDEMONT AREA INFRASTRUCTURE FEE.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION 1.
Subsection (el is hereby added to Section
15.73.060 of the San Bernardino Municipal Code to read as
follows:
"(el Notwithstanding anything in this section to the
contrary, the time for payment of the Verdemont Infrastructure
Fee, for the eleven (111 parcels within Community Facilities
District No. 1006, may be deferred until the close of escrow on
each individual lot, or establishment of said district, unless a
later time is allowed by this chapter."
