Recommended motion:
1. That the public hearing to receive, consider and rule upon written protests
in the matter of annexation of the territory generally located East of
Waterman Ave., between 6th Street and 3rd Street, designated LAFCO 2671, is
hereby closed.

STAFF REPORT
On October 1, 1990, authorization was given to proceed with the proposed annexation
of the area generally located East of Waterman Avenue, between 6th Street and 3rd
Street. This was a City initiated action.
On April 15, 1991, Resolution No. 91-124 was adopted, making formal application to the
Local Agency Formation Committee (LAFCO).
On June 17, 1991, Resolution No. 91-229 was adopted, determining property tax revenues
to be exchanged between the City of San Bernardino, and the County of San Bernardino.
On June 19, 1991, LAFCO adopted a resolution approving the annexation.
Said resolution by the LAFCO authorizes and directs the City of San Bernardino to
initiate proceedings relative to the proposed annexation. As part of these
proceedings, the City must conduct a public hearing regarding the proposed annexation.
On August 20, 1991, resolution No. 91-373 was adopted, setting a public hearing for
September 16, 1991, regarding the proposed annexation. All property owners owning land
within the proposed territory, and all affected agencies were notified by mail of the
hearing.
The attached resolution, making a determination and ordering the annexation, should
be adopted only if protests are filed and received by less then 25t of the registered
voters residing in the area and less then 25t of the property owners owning less than
25t of the total assessed land value, within the proposed territory

WHEREAS .
pursuant to the provisions of
the Cortese-Knox Local
56000 of the California Government Code. proceedings were initiated by the
Common Council of the City of San Bernardino. to annex to the City of San
Bernardino.
certain contiguous uninhabited territory hereinafter described;
and
12 WHEREAS. the proposed annexation was initiated by the City of San
13 Bernardino in order to facilitate an orderly growth in the area; and
14 WHEREAS, the Local Agency Formation Commission has set forth the
15 following terms and conditions in its Resolution No. 2329:
16 "Condition No. 1. The conducting authority for this
17 proceeding shall be the City Council of the City of San Bernardino.

"Condition No.2. The boundaries are approved as set forth
19 in Exhibit "A" attached.
20 "Condition No.3. The following distinctive short form
21 designation shall be used throughout this proceeding: LAFCO 2671.

"Condition No.4. All previously authorized charges, fees.
23 assessments and/or taxes currently in effect by the City of San Bernardino
24 (annexing agency) shall be assumed by the annexing territory in the same
25 manner as provided in the original authorization pursuant to Government Code
26 Section 56844(c).

provide notices pursuant to the provisions of Government Code Section
57025(b) and 57025(c).
"Condition No.6.
The date of issuance of the
Certificate of Completion shall be the effective date of this annexation.";
and
WHEREAS, a public hearing was held on the 16th day of September,
1991, at the hour of 10:00 am in the Council Chambers of City Hall, 300 N.
"D" Street, San Bernardino, California, and the same was the day, hour and
place designated where any and all persons registered to vote and residing
within the territory proposed for annexation or persons owning land within
11 the territory proposed for annexation may file a written protest with the
12 City Clerk, prior to the conclusion of said hearing; and
13
WHEREAS, all owners of land within the territory proposed for
14 annexation, and all affected agencies were notified of said hearing by
15 mailing, publication and posting of a "Notice of Public Hearing" pursuant
16 to the provisions of California Government Code Section 57025.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That pursuant to Section 57050 of the California
Government Code, a hearing was held on the day, and at the time and place as
set forth hereinabove, and protests were filed and received by less than
twenty five percent (25~) of persons registered to vote within the territory
proposed for annexation and less than twenty-five percent (25~) of property

of said hearing.

2 SECTION 3. The territory herein referred to as being annexed to
3 the City of San Bernardino is more particularly described in the Exhibit
4 "A", attached hereto and incorporated by reference as though fully set forth
5 in length.
6 SECTION 4. The above described territory will be subject to
7 taxation equally with the property within such municipal corporation.
8 SECTION 5. The regular County Assessment Roll is utilized by the
9 City of San Bernardino.
10 SECTION 6. The property herein annexed is declared to be a part
11 of Ward 1 and the boundaries of Ward 1 are hereby altered to include said
12 annexed territory, and has a designated land use of CG-l (Commercial
13 General) and RS (Residential Suburb) and is more particularly shown on the
14 Map of the City of San Bernardino General Plan as it currently exists.

~ECTION 7. The area included in t.he above annexation is hereby
16 detached from County Service Area 38, Improvement Zones G and 1. of County
17 Service Area 38, County Service Area 70, Improvement Zone A of County
18 Service Area 70, and County Service Area SL-l, without split of assets or
19 liability.

property is currently rented to a tenant. The political

PLEASE TAKE NOTICE:
I am a ( ) registered voter ~ land owner in the area.
There are several irregularities in the Registrar of Vot-
ers total list of registered voters in the area including, but
not necessarily limited to the following:
1. Several persons on the list have departed the area (some a
very long time ago.)
2. Some persons on the list are deceased.
3. At least one person on the list has b,een in prison for
about 12 years convicted of murder - a person obviously not
entitled to be on a voters' list.
4. Last week the Registrar of Voters was requested to send out
confirmation cards on several ineligible voters.
5. Available information indicates that agents of the City,
pushing for annexation, knew (or should have known) of some of
these improperly included persons on the Registrar of Voters
list.
THEREFORE, in the interests of justice, fairness and equity,
the Council is requested to direct the City Clerk to delay mak-
ing a finding until the total number of Voters in the area is
fairly established.
