REOUEST
Staff request that the Mayor and Common Council adopt the attached
ordinance amendment for the Municipal Code, concerninq the
permittinq of educational services in the C00-1, COo-2, IL and IB
zoninq/land use districts subject to the approval of a Conditional
Use Permit.
BACKGROUND
On Auqust 6, 1991, the Planninq commission reviewed the ordinance
and recommended that the Mayor and Common Council adopt the
ordinance as proposed.
ANALYSIS
Section 19.06.020, Table 06.01 presently permits educational
services, as cateqorized by Industry Group No. 82 of the Standard
Industrial Classification Manual, in the CG-1 and CG--2, General
Commercial and in the CR-2 and CR-3, Reqional Commercial land use
districts/zoninq. There are several educational proqrams
classified under Industry Group No. 82 that should more
appropriately be located in other zoning/land use districts. Auto
repair and industrial traininq progrlmB are two such us_ in which
the industrial land use desiqnations IL and IB, would be considered
more fitting. Office/Clerical training programs and medical
assistant traininq programs could be considered more appropriate
for the Office Commercial districts COo-l and COo-2, where the
facilities most likely to employ graduates of these proqrams are
located.
The ordinance, as written, would permit a Conditional Use Permit
application to be submitted for a training program that _y not be
compatible with the zoning/land use desiqnation in which the
proqram is proposed to be located. For example, an application
could be made for a welding school in the CO-l, CO-2, CG-l, CG-2,
CR-2 and CR-3 districts where it may clearly be incompatible with

other surrounding land uses. However, the Conditional Use Permit
application process and the findings that must be made under the
process concerning suitability of site, land use compatibility with
adjoining properties, an no harmful effects upon desirable
neighborhood characteristics, will preclude the approval of
incompatible training services in inappropriate zoning/districts.
CONCLUSION
Amending Table 06.01 in section 19.06.020 of the Development Code
in order to permit educational services in the 00-1, CO-2, IL and
IH land use designations and zoning, subject to a Conditional Use
Permit, will allow more educational/training programs to be located
in districts more consistent with surrounding land uses. The
Conditional Use Permit application process will prevent training
programs that are incompatible with surrounding land uses frOll
being approved or established.
RECOMMENDATION
Staff recommends that the Mayor and Common Council adoptl., the
Negative Declaration for the ordinance and adopt the ordinance
amendment.

An Initial Study for the proposed ordinance was prepared by staff
and presented to the ~nvironmental Review Committee (ERC) on July
11, 199~. A Negative Declaration was proposed. The Initial
study entered ~~e 21 day public review period on July 18, 1990.
The public reviev period vill end on August 7, 1991. See Initial
study, Attachment -3-.

The proposed ordinance vould amend Section 19.06.020, Table
06.01, per2ittlng educational services, as classified by Industry
Group No. 82 of the Standard Industrial Classification Kanua1, in
the CO-l, CO-2, XL. and IH land use desi;nations/:oning, SUbject
to the approval of a COnditional Use Permit application.
Industry Group No. 82 includes: elementary and secondary schools;
colleges, universities, and professional schools; libraries; and
voca~ional/trade schools. Application of the proposed amendment
would ~e City-vide in the above listed districts.
'rable16.01 of the Development ~ode presently permits' educational
services, as classified by Industry Group No. 82, in the CG-l and
03-2, Commercial General and in the ca-2 and ca-], Commercial
Regional land use designations/zoning. There are several
educational service ?rograms in Industry Group No. 82 that may
not be as appropriate in the present per2it~ed dtstricts as in
~he CO-l, CO-2, IL, lnd In land use districts. Auto repair trade
schools and indust:ial appren~iceshi~ training sc~ools/proqrams

ENVIRONMENTAL ASSESSMENT
The amendment could re~ult in the development of trade
schools and other institutions offerinq eductional services
in areas located within the Alquist-Priolo Special Studies
zones, Airport Districts, area~ ~ubject to water and wind
ero~ion, or within area~ ~ubject to land~lide~, mud~lide~,
liquefaction, hiqh wind and other similar hazards. The
amendment could result in the development of educational
facilities in areas potentially impactinq bioloqicial
resource~, archaeoloqical resources, or other adjacent
sensitive land uses. The environmental constraints and
concerns of specific developments, their location' in
relation to hazards and their potential for impactinq
resources or other land u~es i~ project ~pecific. Such
is~ues will be addressed within the context of the ~pecific
development applications prior to their approval.
4. CONCLUSIONS
Potential impacts re~ultinq directly from the proposed

Review committee found that the project will not have a

WATER DEPARTMEN'l' PROJECT NO. 91-05 - A proposal to drill a
well, to rehabilitate an existinq reservoir, to inst!lll
l:)ooster pUlllps and to install pipelin_ in Acacia and Baseline
Streets. The project is located near the northeast corner of
11th and Acacia Streets at the City CUltural Center in the
CG-l, cOlIIIDereial General, General Plan land use d_"iqnation.
GENERAL PLAN AMENDMENT NO. 91-10 - To add Policy 1.29.13',to
the General Plan which would allow existinq sinqle-family
residential st..""Uctur_ in the CO-2, COIIIIDercial Office-Resi-
dential, land use desiqnation as a permitted use.
CONDITIONAL USE PERMIT NO. 91-14 - To construct a 122 unit
apartment complex on the north side of Coulston Street
between curtis Str_t and Rosena Avenue in the RII, Residen-
tial Medium, General Plan land use desiqnation.
CONDITIONAL USE PERMIT NO. 90-77 AND TENTATIVE TRACT NO.
15187 - To construct a 20-unit condollliniUIII project. Subject
property consists of 3.01 acrea located on the easterly side
of Kendall Drive, approxilllately 390 feet south of Pine
Avenue, in the RU-l, R_idential Urban, Ger.eral Plan land use
desiqnation and partially located within the Hillside Manaqe-
ment overlay District.
CONDITIONAL USE PEKPI.l.T NO. 91-30 - To construct a 60-bed
orthopedic rehabilitation hospital at the northwest corner of
16th Street and Medical Center Drive in the 00-1, COIIIIDereial
Office, General Plan land use d_iqnation.
