View Cemetery, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the proposed annexation of Mt. View Cemetery (located northeasterly of Highland Avenue and Waterman Avenue) Before LAFCO can issue a Certificate of Filing, Section 99 of the Revenue and Taxation Code requires that the distribution of property taxes, relative to the proposed boundary changes, be negotiated and agreed upon by all affected local agencies. The County Board of Supervisors shall negotiate with tbe City, any exchange of property tax revenues on behalf of all affected agencies, except as provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations between the City and County took place in 1980, when County staff and a committee of City managers agreed upon a formula for property tax transfers, and Resolution 82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct the establishment of a policy for the formula. The adoption of the attached resolution fulfills the City's compliance with said Section 99 . RESOLtTrION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2684, FOR THE AREA GENERALLY LOCATED NORTHEASTERLY OF HIGHLAND AVENUE AND WATERMAN AVENUE (MT. VIEW CEMETERY) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change will negotiate and determine by resolution the amount of property tax revenues to be exchanged between and aJlong such local agencies. 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or Blore special districts, the Board 19 of Supervisors of the County of San Bernardino shall. on behalf of the 20 district or districts. negotiate any exchange of property tax revenues. 21 c. The Mayor and Co_on Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 amount of property tax revenues to be exchanged as a result of 24 jurisdictional change described by LAFCO 2684. 25 SECTION 2. IlII1>leBlentation. 26 A. The column 2 entitled "Estimated Current Tax Revenue" shall represent the amount of 3 property tax revenues for the current year to be paid to the County of San 4 Bernardino and its affected agencies. 5 B. The annual tax increment generated in the area subject to the 6 jurisdictional change and attributable to the Local Agencies whose service 7 area or service responsibilities will be altered by the proposed 8 jurisdictional change shall be allocated in the future years pursuant to the 9 provisions of Section 96 of the Revenue and Taxation Code. 10 SECTION 3.
