ORDINANCE NO.
AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE APPOINTMENT OF HEARING OFFICER(S) AND PROVIDING
FOR SAID HEARING OFFICER(S) TO HEAR ANY ITEM ON THE AGENDA OF THE
BOARD OF BUILDING COMMISSIONERS IN THE ABSENCE OF A QUORUM AND ANY
CONDITIONAL USE PERMIT REVOCATION I~EM ON THE PLANNING COMMISSION
AGENDA IN THE ABSENCE OF A QUORUM AND-PROVIDING FOR SAID HEARING
OFFICER( S) TO HEAR ANY ITEM REFERRED TO SAID HEARING OFFICER( S) BY
THE BOARD OF BUILDING COMMISSIONERS OR THE PLANNING COMMISSION AND
DECLARING THE URGENCY THEREOF.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 2.17 of the San Bernardino Municipal
Code is hereby amended to read as follows:
"2.17.080 Hearing Officer(s)
The Board of Building Commissioners or the Planning
Commission may designate such Hearing Officer( s) as are
necessary to hear such matters as are hereinafter described.
2.17.090
Hearing Officer(s) appointed pursuant to this chapter
may hear any and all matters on the agenda of the Board of
Building Commissioners in the absence of a quorum of said
Board and may hear any Conditional Use Permit Revocation
item on the agenda of the Planning Commission in the absence
of a quorum.
2.17.100
Hearing Officer(s) appointed pursuant to this chapter
may hear any item referred to said Officer by the Board of
Building Commissioners or by the Planning Commission.
2.17.110
Decisions of Hearing Officer(s) shall be appealable in
the manner provided by ordinance or other law within the

time(s) provided by said ordinance or other law, and any
appeal taken shall be in the same manner prescribed for
appeals of the Commission the Hearing Officer is acting on
behalf of.
SECTION 2. Urgency. It has come to the attention of the
Mayor and Common Council that certain hearings, required to be
held within specific time periods or within a reasonable period of
time are not being held due to the lack of a quorum of the Board
of Building Commissioners and the Planning Commission. Because.,
due to certain pending hearings, there is insufficient time to
allow an ordinance to take effect, and because some of these
hearings involve people's rights as well as the safety of certain
buildings and the health and safety of the public occupying andlor
doing business in certain buildings, therefore, in order to
protect the public health, safety and welfare it is necessary that
this ordinance take effect immediately.
