In July, 1990, the Mayor and Common Council adopted Resolution lUmbered 90-289 to establish procedures for a Public Rights-of-Way Improvement Program. The Resolution detailed the procedures by which the City and property owners would participate in the removal of existing driveway approaches and infilling of curb depressions and reconstruction of curb, gutter and sidewalka located on public rights-of-way. The program that was to be implemented by the Public Worka/Bngineering Department also stipulated that the City would pay one-half (1/2) of the cost of such work only for those projects for which the City had initiated Chapter 12.92 proceedings against pursuant to the San Bernardino Municipal Code. On April IS, 1991, the Mayor and Common Council amended Resolution lUmbered 90-289 to include the instal1stion of new infil1 improvements in the fifty percent (SOX) City participation program, in addition to repair of existing improvements and removal of abandoned driveways. Despite the programs referenced above, which were established to assist property owners with payment of one-half (1/2) of the cost of the requested improvements, there remain those low to IIOderate income, elderly and handicapped property owners who are unable to cover the remaining one-half of the cost. The Deve1o~ent Department was directed by the Mayor and Common Council to develop a program to finance the remaining fifty percent (501) from CDBG funds for eligible improvements for single family property owners who could not pay one-half of the cost of the requested improvements. Guidelines for Use of CDBG J'lm"s At the present time, the City will pay one-half (1/2) of the property owner'a coat (from the Tax Allocation Bond Proceeds Beautification Fund) if he/she declares an inability to cover the cost. The request must be aubmitted to the Director of Public Works, with final approval to be aranted by the Council's Ways and Means Committee. The Development Department will now be able to utilize CDBG funds to pay the remainina one-half (1/2) of the cost based upon the followina criteria: (a) Amount paid from CDBG funds not to exceed $2,500. (b) Property owner must meet income eliaibility requirements by number of persons in household and maximum snnual income (see Attacbment Number "1"). 2. ". Release Bid Pacuaes to ComDlete the Work in GrouDs In the past, sidewalk locations were identified by Public Works Department and scted upon in small aroups in a random msnner. The aroups of sidewalks will be put into packsses not to exceed a specific dollar amount ($10,000 or $20,000). The City will advertise bid invitations and accept the lowest, most reasonable bid. 5. Notification of Citizens It appears that the msnner in which citizens were notified precipitated nesative reactions from concerned citizens. The city will undertake a public relations campaian to encouraae public improvements, both new construction and repairs. The publicity campaian will be undertaken in one project area and adjacent areas of the City st a time, immediately precedina work to be done in that area of the City. The campaian will inform citizens of the improvement project that is beina funded by both City and federal funds. 4. An information aheet that provides details on the program guidelines and eligibility criteria for CDBS funds (inClUding specific BUD income guidelines by fuily size) will also be included. The protest process will be changed to have citizens make the initial contact with staff of the Public Works Department to allow the opportunity to resolve the issues prior to the citizen making an appeal to the Council's Ways and Means Committee which has the final authority to resolve disputes/protests. Conclusion Joint implementation and coordination of the Public Iaprovements program by the Public Works and Development Departments of an infill progru to be funded by a combination of City and CDBS funds will be easier to implement at the administrative level and will iaprove the present process of service delivery to City residents. The new construction of sidewalks will be phased over several years based upon the uount of funding available in each project area.
