CITY OF SAN BERrQRDINO - REQUEST ~R COUNCIL ACTION STAFF REPORT On October 1, 1990, authorization was given to proceed with the proposed annexation of the area generally located East of Waterman Avenue, between 9th street and 6th Street. This was a City initiated action. On April 15, 1991, Resolution No. 91-123 was adopted, making formal application to the Local Agency FO!'llll.tion Co_ission (LAFCO). Part of those proceedings requires that the affected agencies of the proposed annexation adopt a resolution determining the amount of property tax revenues to be exchanged between the agencies as a result of the proposed change of jurisdictional boundaries. On June 17, 1991, Resolution No. 91-228 was adopted, determining property tax revenues to be exchanged between the City of San Bernardino, and the County of San Bernardino. The proposal has been reviewed and approved by LAFCO, directing the City, as conducting authority, to hold a public hearing on the proposal. RESOLUTION OF THE CIn OF SAN BERNARDINO INITIATING PROCEEDINGS AND Sll'ITING A PUBLIC HEARING FOR THE PROPOSED ANNEXATION OF THE AREA GENERALLY LOCATED EAST OF WATERMAN AVENUE, SOUTH OF 9TH STREET AND NORTH OF 6TH STREET, DESIGNATED LAFCO 2672. WBEIlEAS ,preUainary proceedings for a reorganization (annexation) were initiated when the City of San Bernardino filed its Resolution No. 91- 123, applying to the Local Agency Foraation Co..ission in the County of San Bernardino for annexation of certain territory pursuant to the Cortese-Knox 9 Local Government Reorganization Act of 1985, Division 3, coaaencing with 10 section 56000 of the California Government Code; and 11 WHEREAS, no City other than the City of San Bernardino is affected 12 by this annexation; and 13 WHEREAS, the proposal is for annexation of the territory described 14 below to the City of San Bernardino. The area is legally uninhabited. It has 15 an assessed valuation of $782,087 (land only); and 16 WBEIlEAS, the proposal was initiated by the City of San Bernardino, 17 in order to facilitate an orderly growth of the area; and 18 WBEIlEAS, the Local Agency Foraation Co_ission has set forth the 19 following teras and conditions in its Resolution No. 2330 : 20 "Condition No. 1. The conducting authority for this 21 proceeding shall be the City Council of the City of San Bernardino. 22 "Condition No.2. The boundaries are approved as set forth 23 in Exhibit "A" attached. 24 "Condition No.3. The following distinctive short fora 25 designation shall be used throughout this proceeding: LAFCO 2672. 26 "Condition No.4. All previously authorized charges, fees, 27 assessaents and/or taxes currently in effect by the City of San Bernardino 28 (annexing agency) shall be assuaed by the annexing territory in the saae 07-29-91 _ J.. The conducting authority is required to 4 provide notices pursuant to the provisions of Government Code Section 5 57025(b) and 57025(c). 6 "Condition No.6. The date of issuance of the Certificate 7 of COllpletion shall be the effective date of this annexation."; and 8 WHEREAS, a description of the boundaries for the proposed 9 annexation is as follows: generally located East of WateI'llllll Avenue, South 10 of 9th Street and North of 6th street, and and is .ore fully described in 11 Exhibit "A", attached hereto and incorporated by reference as though fully 12 set forth in length. 13 BE IT llESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1. That a public hearing shall be conducted on Monday, Septllllber 16, 1991, to be held in Council Challbers, City Hall, 300 North "D" Street, San Bernardino. California, at the hour of 10:00 a..., or as soon after that ti~ as the ~tter ~y be heard, to receive, consider and rule upon written protests to the annexation designated LAFCO 2672. SECTION 2. That at any tiae prior to the conclusion of the hearing in the notice given by the clerk, but not thereafter, any owner of land within uninhabited territory proposed to be annexed, ~y file a written protest against the annexation. Each written protest shall state the nue and address of the owner of the land affected and the street address or other description sufficient to identify the location of the land. Protests uy be llade on behalf of an owner of land by an agent authorized in writing by the owners to act as agent with respect to that land.
