Avenue, South of Highland Avenue, WIlS approved for rec~..~ndation by the City's Underground utility District Committee at their lItleting of June 6, 1991. This project was rec~ed based on the proposed EIlSterly extension of the cross-town freeway and includes those arellS where the freeway extension is proposed to cross Central Avenue and Pal. Avenue. On July 15, 1991, authorization to proceed was given and Resolution No. 91-319 was adopted, setting a public hearing for August 5, 1991. All affected utility cOllpllJlies were notified by mail of the proposal. No property owners are affected by this proposal since the extent of the district, and the work, is all in the right of way, and no conversions will be necessary. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UIlJ)ERGROUND UTILITY DISTRICT NO. 21, ALONG pORrIONS OF CENTRAL AVENUE, SOUTH OF HIGHLAND AVENUE AND ALONG pORrIONS OF PALM AVENUE. SOUTH OF HIGHLAND AVENUE. WIIEJlEAS, a public hearing was held on August .5. 1991. at the hour of 10:00 a.m.. at the Council Chambers. 300 North "D" Street. San Bernardino. California. to determine whether the public necessity. health, safety or welfare required the fOrBation of an Underground utility District No. 21 located along portions of Central Avenue. South of Highland Avenue and along portions of Palm Avenue, South of Highland Avenue San Bernardino. California; and WIIEJlEAS. notice of such hearing has been given to all affected utilities concerned in the aanner and for the time required by law; and WIIEJlEAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, UltalEFORE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San Bernardino Municipal Code of the City of San Bernardino. and to definitions contained therein that the public necessity, health. safety and welfare require the fOrBation of an underground utility district located along portions of Central Avenue. South of Highland Avenue and along portions of Palm Avenue. South of Highland Avenue. in the City of San Bernardino, State of California. public streets which are extensively used by the general public and carry a heavy vol_e of vehicular traffic. in order to remove utility poles. overhead wires and associated structures and to underground utilities along said portions of said streets. SECTION 2. An underground utility district to be known as RESOLUTION ~TING UNDERGROUND UTILITY DISTRICT NO. :':1. LU\.tu= "..,,~~~_. ALONG PORTIOA.",J>F CENTRAL AVENUE AND ALONG Po(""'nNS OF PALM AVENUE. SOUTH OF HIGHLAND AVENUE . ',~F 1 Underground Utility District No. 21 is here~ established in that area 2 located along portions of Central Avenue. South of Highland Avenue and along 3 portions of Palm Avenue. South of Highland Avenue. in the City of San 4 Bernardino. state of California. the boundaries of which are more 5 particularly shown on Plan No. 8479. on file in the office of the City Clerk 6 of said City. 7 SECTION 3. All poles. overhead wires and associated overhead 8 structures shall be removed and undergrounded within said underground 9 utility district within the following times: 10 a. Underground installation ~ utility companies and not later 11 than August 31. 1992. 12 b. Removal of poles. overhead wires and other associated 13 structures not later than December 31, 1992. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 c. Said times say be extended ~ the Director of Public Works. as deemed necessary. for the proper scheduling and coordinating of appurtenant work. SECTION 4.
