STAFF REPORT
The San Bernardino Valley Municipal Water District o~ns a parcel of land
fronting on 9th Street and which is surrounded by our Encanto Park
propert~.. Their property has a building on it which houses a well.
In conjunction with our Water Department project to pump water to the North
end of the City for percolation. the District must install a Surge Arrestor
which needs a parcel of land 20 feet by 50 feet. There is not sufficient
land on their property to house the Arrestor and the new improvements they
are doing on the property.
Therefore, they have requested the City to grant them an easement over City
property immediately North of and adjacent to their property as shown on
the attached plat map. to hold the underground facility and to fence same.
This office has reviewed the request with Annie Ramos. Director of Parks,
Recreation and Community Services and she has stated that the easement
would have little or no impact on the use of the remaining park area and
has recommended that the easement be granted.
Therefore, we recommend that the Resolution be adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO
SAN BER!\ARDINO VALLE MUNICIPAL WATER DISTRICT, A CALIFORNIA CORPORATION,
OVER CITY OWNED PROPERTY LUCATED NORTH OF NINTH STREET AT ENCANTO PARK IN THE
CITY OF SAN BERNARDINO.
SECTION 1: That the City of San Bernardino execute a Grant of
Easement to San Bernardino Valley Municipal Water District, a California
Corporation for the installation, maintenance, operation and repair of a
Surge Arrestor over a portion of-property owned by the City and known as
Encanto Park.
SECTION 2: That the said Grant of Easement referred to herein,
a copy of which is attached hereto, marked Exhibit "A", and is hereby
referred to and made a part hereof as fully as though set out at length
herein, is hereby approved.
SECTION 3:
That the Mayor and City Clerk of the City of San
Bernardino are hereby authorized and directed to execute said Grant of
Easement on behalf of the City of San Bernardino.
