STAFF REPORT
Bids for this project were opened at 2;00 p.m. on
Tuesday, June 18, 1991.
A total of 5 bids were received, ranging from $1,136,310
to $1,299,000. The low bid of $1,136,310 is 6.5% below the
Engineer's Estimate of $1,215,620.
Below is the total estimated project cost, based upon the
actual low bid price:

Funds have been allocated under Account No. 242-362-
57667, for a total amount of $1,658,000. The City's share is
14%, or $204,120, with the County's contribution not to exceed
the amount of $15,000.
We recommend that a contract be awarded to the low
bidder.
URGENCY CLAUSE
A contract was previously awarded to E. L. Yeager for rehabili-
tating the section of Waterman Avenue, from Redlands Boulevard
to Mill Street. Work is scheduled to start under this contract
on 7-11-91. It is necessary to award the contract for this
project on 7-15-91, in order for the Contractor to work on both
sections concurrently.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO E. L. YEAGER CONSTRUCTION COMPANY, INC. FOR PAVEMENT
REHABILITATION ON WATERMAN AVENUE, FROM MILL STREET TO FIFTH
STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
E. L. Yeager Construction Company, Inc. is
the lowest responsible bidder for: Pavement Rehabilitation on
Waterman Avenue, from Mill Street to Fifth Street, in accordance
with Plan No. 8038.
A contract is awarded to said bidder
accordingly for the total amount of $1,136,310.00, but such award
shall be effective only upon the contract being fully executed by
the parties.
All other bids, therefore, are hereby rejected.
The Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is on file
in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
