The purpose of the policy was to establish specific procedures to enable research institutions to purchase animals, with the qoal of raisinq additional revenue for the City. Durinq Fiscal Year 1990/91, there were 249 animals available for sale for research purposes. Seven purchase requests from local research institutions were made durinq this time, and no animals were actually sold. The last contact from a research institution was Auqust 1, 1990. The estimated City cost to administer the research sales has been $9,100 for FY 1990/91. Given that the oriqinal purpose for research sales was to qenerate revenue, and that research sales have not produced any additional income, but . have qenerated administrative costs, it is recommended that the Mayor and Common Council adopt the resolution rescindinq the current policy reqardinq the sale of animals to research institutions. .0264 . , II C o 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO PROHIBITING THE SALE, DONATION, OR GIVING AWAY OF ANIMALS FOR RESEARCH. WHEREAS, by pOlicy adopted on November 7, 1988, the Mayor and Common Council directed that live animals held in the City Animal Shelter be made available for sale to research facilities but only if such animals had no evidence of being pets, and WHEREAS, the segregation of pets and non pets have cost the City in direct salary and benefits approximately $9,000 per year, and WHEREAS, the Federal Animal Welfare Rights Act (7 USC S2l3l et seq.) and the Federal Pet Theft Act (7 USC S2l58 et seq.) require that where cities allow the sale of animals for research, impounded animals must be kept for 5 days rather than the 3 days otherwise allowed by State law (Food and Agricultural Code SS31108 and 31752), which will substantially increase the cost of operation of the City Animal Shelter, and WHEREAS, the requests by the research community for the purchase of impounded animals have been minimal, NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO HEREBY RESOLVE, ORDER AND DIRECT AS FOLLOWS: SECTION 1. The City shall not sell, give away, or donate, either directly or indirectly, any live animals for the purpose of medical research, testing, experimentation, education or demonstration. SECTION 2. The pOlicy adopted on February 7, 1988, and any other policies, resolutions or directives in conflict herewith are hereby repealed.
