CiTY OF SAN BERNADINO - REQUEST Fa COUNCIL ACTION STAFF REPORT A request has been received from Lockwood Engineering, on behalf of R. L. Construction, by letter dated 5-28-91 (copy attached - Exhibit "A"), for a waiver of the requirement to connect to the City's sewer system. This request is for two single family houses to be constructed on two adjacent existing lots of record, located on the east side of Severance Avenue south of 40th Street (See Attached map - Exhibit "B"). The nearest sewer main to the site is located in 40th Street at Severance Avenue, but is not available due to adverse grades and a conflicting water main. An analysis by Lockwood Engineering (Exhibit" A") concluded that it is impractical to extend the sewer from 40th Street. The nearest available sewer is located at the intersection of 38th Street and Mountain View Avenue and would require an extension of approximately 2300 feet (See Exhibit "C"). Ordinance No. MC-663 authorizes the Mayor and Common Council to waive the requirement to connect to the sewer system for residential development of 4 or fewer units which qualify as in-fill projects. We feel this project qualifies as in-fill, which requires that at least 75% of the block has structures and none are connected to the sewer system. Granting a waiver of the requirement to connect to the City's sewer system will not be considered permission to install a septic tank. The applicant will be required to apply to the Building Division for a permit to install a septic tank. The administrative fee of $500.00 for processing this sewer waiver request has been paid as evidenced by Receipt #641761. Dear Roger: our office prepared a sewer improvement plan for Severance Avenue, south of 40th Street, in north San B~rnardino. The city performed the plan check for the plan and it was approved on February 18, 1991. The owner, R.L. Construction Company, contracted a pipeline company to install the sewer line and trenching beqan this past week. While trenchinq, the top of the 30-inch water line shown on the plans was encountered at a depth of 6.1 feet. The 30-inch water line is in direct conflict with the proposed sewer line. The City of San Bernardino Water Department estimated the depth of the 30-inch water line to be approximately 30-inches below finish surface. Our office has studies alternative designs to eliminate this conflict. Raising the sewer line over the 30-inch water line is impractical because at the point of connection for the two n..... houses, the sewer woulcl be too shallo.... for connections. Relocatinq the 30-inch water line is impractical since the proposed .ewer is '1:0 serve on1:y.~'twcP'new'''homes. The most reasonabledesign.to sewer ,,-.'...,,"., Severance Avenue is to desiqn the sewer main from the south. That is the natural fall of the land. our proposed sewer is desiqned to "buck" the street grade, making it impossible to extencl to the south for future connections. We feel that there is no practical solution for the Severance Avenue sewer from 40th Street. Therefore, we recommend that the installation of the Severance Avenue sewer from 40th Street be abandon.d. R. L. construction company feels that any additional fees to be paid in exchange for the abandonment woulcl be unreasonable. They have already incurred several thousand of dollars attempting to install the sewer connection to 40th Street; including design fees, plan ohecking fees, contractor mobilization costs, and se....er materials costs. In addition, percolation test fees and septic tank/seepage pit installation costs will now be spent. In sUJl\1llary, it is impractical, from an el\qineerinq stand point, to connect the Severance Street .ewer to 40th Street. It is unreasona~le to demand an additional cash outlay to the city when so much effort was already put into complyinq with the sewer installation request.
