STAFF REPORT
Although ordinances with language similar to that used in
San Bernardino Adult Book Store Ordinance have been upheld, it
would be helpful to prevent any question of vagueness to define
the term "substantial portion" as used in that ordinance. The
attached ordinance would define it as 20% of the face value of
the stock in trade, or 20% of the floor space used for such
material, whichever is more.

2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
19.06.030 OF THE CITY OF SAN BERNARDINO DEVELOPMENT CODE RELATING

4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Subsection 13 is hereby added to Section

19.06.030.2.A. of the City of San Bernardino Development Code to

read as follows:

"13.
Substantial Portion.
For the purposes of
Subsection 2.A.2. of this Section "Substantial
Portion" shall mean 20% or more of the face value of
the stock in trade, or 20% or more of the floor area
of the store, whichever is more."
SECTION 2. This ordinance is declaratory of existing law.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a
