CiTY OF SAN BERNAGDINO - REQUEST FcQ COUNCIL ACTION STAFF REPORT A request was received by this office from Cove Development to vacate a portion of Huff Street lying between "G" Street and Crescent Avenue. This request now represents 1001 of those owners who adjoin the area proposed for vacation. On 03-05-90, authorization was given to proceed with the proposed vacation, and Plan No. 8031 was approved. All of the interested City Departments and Utility Companies were notified of the proposal on 05-08-90, with a reply due by 06-08-90. The responses are attached for your information. Reservations of easements for the City of San Bernardino fot storm drains and a water line and appurtenant facilities were requested, along with a request for reservations of easements for public utility purposes, which will have to be reserved, as set forth in the attached Resolution of Intention. Also, the City will reserve an easement for ingress and egress across the entire area proposed, to ensure the accessibility of the property for emergency vehicles and others who would like to use the property in question. On 04-15-91, a Negative Declaration was adopted and a finding of consistency with the General Plan was made. On 05-20-91, the Resolution of Intention was continued to the June 17, 1991 Council Meeting. This proposed vacation was put on hold last Spring, as the two property owners could not come to an amicable conclusion as to the best use of their properties. Concern was also indicated by Council members as to traffic flow over Huff Street. Recently, the two property owners have worked out a plan to best use the property and would like to go forward with the proposed vacation. In response to the Council members concern regarding the amount of traffic using Huff between "G" Street and Crescent Avenue, a traffic study was conducted April 15, 1991, with a total of 158 cars using this portion of Huff Street over a 24 hour period. The developer has paid the entire street vacation fee of 8750.00 and it is recom- mended that favorable consideration be given to the requested vacation. The Reso- lution of Intention, which sets a protest date of 07-15-91 has been attached hereto for your action also. RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF IRJFF STREET BETWEEN "G" STREET AND CRESCENT AVENUE. AND RESERVING EASEMENTS FOR STORM DRAINS. WATER LINES AND APPURTENANT FACILITIES AND EASEMENTS FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declare their intention to order the vacation of a portion of Huff Street. described as follows: That portion of Huff Street as conveyed to the City of San Bernardino by document recorded September 17. 1953, in Book 3243. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements belonging either to the City of San Bernardino or to any public utility and there are hereby specifically reserved for the Citv of San Bernardino. easements for storm drains. water lines and street light purposes in. over. under. and across the real property hereinabove described. and the right at any time or from time to time. to construct. maintain. operate. replace and renew one or more pipelines and all appurtenances thereto. The easements herein granted shall also include the right to use such area adjacent to the easements as may be reasonably necessary for performing the work and for access to the work during construction and includes rights of ingress and egress. There is hereby specifically reserved for Southern California Edison, an easement over the hereinabove described real property. to construct, place, operate. inspect. maintain. repair. replace and remove such aerial and underground electrical transmission structures. as the company may from time to time require. consisting for poles. anchors. wires. cables, conduits, manholes, markers and necessary fixtures and appurtenances. including the right of ingress and egress thereto. There is also hereby specifically reserved for emergency vehicles. an easement for ingress and egress to above property. SECTION 5.
