STAFF REPORT
Bids for the project were opened at 2:00 p.m. on Tuesday,
5-14-91.
A total of 7 bids were received, ranging from $14,957.30
to $25,610.00. The low bid of $14,957.30 is 35% below the
Engineer's Estimate of $23,024.40.
Below is an estimate of the total cost for providing
these landscape maintenance services, from 7-1-91 to 6-30-92.

The landscaping was installed by the Subdivider. Main-
tenance of the landscaping will be done by the subdivider until
6-30-91, at which time the Contractor will assume this function.
Funding of the costs incurred for maintenance of the
landscaping will be provided pursuant to Resolution No. 90-337
which established Assessment District No. 993.
The Notice to Proceed will be effective as of 7-1-91.
The term of the contract will be for one year, until 6-30-92.
Two one-year extensions may be granted by mutual agreement of
the City and Contractor.
The cost of maintenance will be up fronted by the City,
and reimbursed from assessments placed on the parcels in the
district. Interest will be recovered on the funds advanced to
pay the maintenance costs as they are incurred.
We recommend that a contract be awarded to the low price
bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO J & R LANDSCAPE dba EXCEL LANDSCAPE FOR MAINTENANCE
OF LANDSCAPING IN ASSESSMENT DISTRICT NO. 993, GENERALLY LOCATED
SOUTHWEST OF CAJON BOULEVARD AT JUNE STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
J & R Landscape dba Excel Landscape is the
lowest responsible bidder for:
Maintenance of Landscaping in the

basins
located
and

of
Tracts
Boulevard at June Street, in accordance with Plan No. 8155.
A
11 contract is awarded to said bidder accordingly for the total
12 amount of $14,957.30, for the Basic Bid and supplemental items of
13 work, but such award shall be effective only upon the contract
14 being fully executed by the parties. All other bids therefore
15 are hereby rejected. The Mayor is hereby authorized and directed
16 to execute said contract on behalf of the City; a copy of the
17 contract is on file in the office of the City Clerk and incorpo-
18 rated herein by reference as fully as though set forth at length.
19 SECTION 2. This contract and any amendment or modifica-
20 tions thereto shall not take effect or become operative until
21 fully signed and executed by the parties and no party shall be
22 obligated hereunder until the time of such full execution. No
23 oral agreements, amendments, modifications or waivers are
24 intended or authorized and shall not be implied from any act or
25 course of conduct of any party.
26 SECTION 3. This resolution is rescinded if the parties
27 to the contract fail to execute it within sixty (60) days of the
28 passage of this resolution.
