CITY OF SAN BEFCARDINO - REQUESTOoR COUNCIL ACTION , ORDINANCE AMENDING SECTION STAFF REPORT 8.60.120 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO FIREWORKS. As the municipal code now reads, the use of safe and sane type fireworks are permitted in city parks except those parks located in high fire hazard areas. This practice has a negative impact on city parks and its patrons. In addition to exposing unsuspecting park patrons to risk of injury, use of "legal" fireworks creates a risk of damage to the parks due to tree and grass fires. The aftermath is usually a great deal of litter and debris left behind, and damage and discoloration to areas where the fireworks were ignited which may include picnic tables, sidewalks or tennis courts. The risks are particularly amplified during the 4th of July Celebration at Seccombe Lake Park. The potential for injury to unsuspecting bystanders, particularly children, is very great due to the very large crowd. Adoption is re- commended. (STAFFRE:FIREWRK) 5/24/91 75.0264 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o 1 ORDINANCE NO. 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 8.60.120 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO 3 FIREWORKS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Subsection A of Section 8.60.120 of the San Bernardino Municipal Code is hereby amended to read as follows: 7 "A. The use of fireworks in the City shall be limited to 8 9 private property except as otherwise provided in this chapter. No fireworks shall be discharged on public, semipubliC or private open areas such as parking lots, vacant properties, or in a public street or right-of-way, or in public parks except when specifically permitted for public display ,and except those areas approved by the Chief Engineer of the Fire Department." Section 2. This is an urgency ordinance that will take effect immediately upon its enactment. The facts establishing the urgency is that the tendency to use open spaces for fireworks has increased in recent years and the heavy spring rains has created a significant fire danger due to such unsupervised use, therefore to protect the public health, safety and welfare, it is necessary to restrict such use at the July 4th celebration of this year and thereafter. / / / / / / / / / / / / / / / DAB/ses/Firewor3.ord May 21, 1991 1 o o 1 AN ORDINANCE.. .
