Recommended motion:
1. That the transfer of $47,970, from Account No. 248-368-57813,
"Pershing Avenue, Phase II - 40th Street to 42nd St." to Account
No. 248-368-57875, "Olive Avenue Cable Creek to Cul-de-sac," be
approved.
2. That authorization be granted to re~mburse Statewide Investors for
the portion (NOT TO EXCEED $47,970) of the cost of the drainage
improvements in Olive Avenue, from Cable Creek Channel to Cul-de-
Sac, that is beyond their responsibility.
3. That the developer of TR 14044, WestAmerica, will be required to
reimburse the Storm Drain Fund prior to recordation of the final
map or issuance of construction permits for the tract.

STAFF REPORT
In 1985, the Develepment Review Cenunittee appreved
Review ef Plans No.. 85-125, autherizing the censtructien ef 300
apart-ments, cenunenly knewn as "Verdement Villas," lecated en
the westerly side ef Olive Avenue, inunediately nerth ef Cable
Creek. The preject design previded fer a drainage system
censisting ef two. reinferced cencrete pipes and a headwall
eutletting into. Cable Creek, and also. included censtructing the
westerly half ef a knuckle at the seutherly terminus ef Olive
Avenue.
Verdement Villas was the subject ef litigatien during the
meraterium and was determined to. have a vested right to. cen-
struct the preject as eriginally appreved. Statewide Investers
is the preject prepenent.

On June 6, 1989, the Planning Cenunissien appreved
Tentative Tract No.. 14044 to. censtruct 82 single family lets en
the easterly side ef Olive Avenue, nerth ef Cable Creek. This.
preject, eriginally started by Cencerdia Develepment, but new
ewned by West America, prepesed to. knuckle Olive Avenue abeut
100 feet nertherly ef the lecatien appreved fer Verdement Villas
in erder to. impreve the efficiency ef their subdivisien layeut
and to. cenferm to. a City requirement to. aveid grading into. a
hill en the site.
Because ef this change, the drainage design fer the two.
prejects is net cempatible. Statewide Investers has prepesed a
revised drainage design which will be cempatible with beth.
prejects, but will cest censiderably mere than their eriginal
appreved design. The increased cest is due to. the need to. pick
up all sterm flews in Olive Avenue after the knuckle censtruc-
tien is cempleted by Tract No.. 14044. The estimated
censtructien cest fer the sterm drain eriginally appreved fer
Verdement Villas is $16,000.00; hewever, the tetal estimated
cest ef the redesigned sterm drain is $63,970.00, leaving a V
balance ef $47,970.00. ~
Since this additienal cest is actually the respensibility
ef the develeper ef Tract No.. 14044, it is prepesed to. require
reimbursement to. the Sterm Drain Fund prier. to. recerdatien ef
the final map, er issuance ef censtructien permits fer the
tract. West America has been centacted and effered the
eppertunity to. reimburse Statewide directly, but they have
declined to. de so..
Therefere, we recenunend that the transfer ef $47,970,
frem Acceunt No.. 248-368-57813, "Pershing Avenue Phase i, frem
40th Street to. 42nd Street," to. Acceunt No.. 248-368-57875, Olive
Avenue - Cable Creek to. Cul-de-sac," be appreved. Also., that
autherizatien be granted to. reimburse Statewide Investers fer
the pertien ef the cest ef the sterm drain system in Olive
Avenue that is beyend their respensibility.
