STAFF REPORT
Bids for this project were opened at 2:00 p.m. on
Tuesday, 4-30-91.
A total of 4 bids were received, ranging from
$1,482,667.64 to $1,673,304.80. The low bid is 5.3% below the
Engineer's Estimate of $1,566,274.80.
This project is funded through Federal-Aid Urban funds
and, as such, administered by Caltrans. Caltrans has reviewed
the bids and the submittal of Disadvantaged Business Enterprises
information and concurs with the City in awarding a contract to
the low bidder.
Below is the total estimated project cost, based upon the
actual low bid price:

Execution of Program Supplement No. 64 served to obligate
$1,771,169 in Federal-Aid Urban Funds. An amount of $270,340
has been allocated, under Account No. 242-362-57658, to finance
the 14% Local Agency share. In addition, the Cooperative Agree-
ment with the County provides for $50,327 to be provided from
County funds. Therefore, the total ava ilable funds for this
project are:

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO E. L. YEAGER CONSTRUCTION COMPANY, INC. FOR PAVEMENT
REHABILITATION, BRIDGE, AND TRAFFIC SIGNAL MODIFICATIONS ON
WATERMAN AVENUE, FROM REDLANDS BOULEVARD TO MILL STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. E. L. Yeager Construction Company, Inc. is the
lowest responsible bidder for: Pavement Rehabilitation, Bridge,
and Traffic Signal Modifications on Waterman Avenue, from
Redlands Boulevard to Mill Street, in accordance with Plan No.
7679. A contract is awarded to said bidder accordingly for the
total amount of $1,482,667.64, but such award shall be effective
only upon the contract being fully executed by the parties. All
other bids therefore are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the
CitYl a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60l days of the
passage of this resolution.
