STAFF REPORT
Bids for this project were opened at 2:00 p.m., Tuesday,
on 4-23-91.
A total of 8 bids were received, ranging from
$2,469,567.69 to $4,496,254.00. The low bid of $2,469,567.69 is
33.8% below the Engineer's Estimate of $3,727,875.
The low bid is the total of three zones set forth in the
contract documents. The zones represent Chestnut Avenue Storm
Drain, Palm Avenue street improvements and the installation of a
reinforced concrete box culvert and traffic signals at Palm
Avenue and Kendall Drive.
Listed below is the total estimated construction cost,
based upon the actual low bid price:

Monnig Development voluntarily engaged the services of a
consulting engineer to prepare the plans for the box culvert on
Palm Avenue at Cable Creek Channel, and traffic signals at Palm
Avenue and Kendall Drive. These amounts are listed in the above
estimate of cost, since a request for reimbursement has been
submitted.
Funds for these projects will be derived from the sale of
bonds with the assessment district providing the debt service
for the bonds. As originally proposed, there were four separate
districts. Later action by the Mayor and Common Council
combined all projects into Assessment District No. 987 with
zones separating the various projects and assessment areas.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO RIVERSIDE CONSTRUCTION COMPANY FOR CONSTRUCTION OF
3 REINFORCED CONCRETE BOX CULVERT, TRAFFIC SIGNALS, CHESTNUT AVENUE
STORM DRAIN, AND PALM AVENUE IMPROVEMENTS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Riverside Construction Company is the lowest
responsible bidder for: Construction of Reinforced Concrete Box
Culvert, Traffic Signals, Chestnut Avenue Storm Drain, and Palm
Avenue Improvements, in accordance with Plan
Nos. 7882, 8054,
8162, and 8163. A contract is awarded to said bidder accordingly
for the total amount of $2,469,567.69, but such award shall be
effective
only upon the contract being fully executed by the
parties.
All other bids
therefore are
hereby rejected.
The
Mayor is hereby authorized and directed to execute said contract
on behalf of the CitYl a copy of the contract is on file in the
office of the City Clerk and incorporated herein by reference as
fully as though set forth at length.

SECTION 2. This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
27 passage of this resolution.
