Recommended motion:
That the appeal by Lionel S. Heller, of the requirement to underground
utilities adjoining a proposed development at 455 South "0" Street, be
set for a public hearing before the Mayor and Common Council on
Tuesday, 9-8-87, at 10:00 a.m.

STAFF REPORT
We have been contacted by Mr. Lionel S. Heller relative
to conditions of approval that will be imposed upon his proposed
development at 455 South "0" Street. He was advised that one
condition would be Standard Requirement No. II, requiring under-
grounding of the overhead electrical and telephone lines along
"0" Street.
A letter, dated 8-11-87, has been submitted as an
appeal of this condition. Mr. Heller requests that an assessment
district be created to satisfy this condition by insuring funds to
cover the cost of undergrounding when the entire block is done.
Resolution No. 87-189 allows the Director of Public Works/
City Engineer to accept a cash payment in lieu of actually under-
grounding the utilities at time of development. We understand
the frontage of this development will be 296 feet.
URGENCY CLAUSE
It is necessary to set a public hearin9 in order for this appeal
to be heard by the Mayor and Council. Failure to be considered
at the Council Meeting of 8-17-87 will result in a 3 week delay.

Dear Mr. Hardgrave:
Regarding this project, we are respectfully requesting an
exemption on underground electrical at this time based on
the formation of an Assessment District to create funds
for implementation at a later date.
We will be pleased to cooperate in any manner with the City
in order to comply with its long range plans..
Thank you for your prompt action on this matter which will
ssist us in breaking ground in the very near future.
