The County Board of Supervisors on August 3, 1987 approved the
attached Resolution placing our transportation sales tax measure
on the November ballot. The SANBAG Board last week approved the
attached ordinance and Expenditure Plan, which is the formal
question to go before the voters. Also approved at the SANBAG
meeting was the first five year arterial program, which is also
attached; we will undoubtedly be making some additions in the
next couple of months.
At the same time, the SANBAG Board felt that it was now
appropriate to urge every member jurisdiction to adopt
resolutions of support for the actual election (an earlier
request had been support for the enabling legislation only). A
draft resolution is enclosed for your use. We would be happy to
work with city staff in supplying information for any revisions
you might wish to make.
Please place this resolution before your Councils for support as
early as possible. We would like to complete action throughout
the County by September 15. Please send completed Resolutions to
us for campaign use.
We also will be seeking support from as many other organizations
as possible, and plan to use the same Resolution in amended form.
If your Chamber of Commerce or other associations can be
persuaded to come into support, please provide them with the
draft resolution for their use.

WHEREAS, the State Legislature has enacted the
"San Bernardino County Transportation Sales Tax Act" with
limited tax authority, subject to voter approval: and

San Bernardino is authorized by said Act to conduct an election
for the purpose of submitting a ballot proposition to the voters
seeking authorization to impose a 1/2 of 1% retail transactions
and use tax solely for highway transportation purposes and to
issue bonds payable from the proceeds of that tax: and
WHEREAS, the San Bernardino County Transportation
Commission by o.rdinance No. A adopted July 29, 1987 and
Resolution No. 87-1 adopted July 29, 1987 has requested the Board
of Supervisors of the County of San Bernardino to call such

WHEREAS, a countywide election will be held on
November 3, 1987:
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of the County of San Bernardino that the measure
hereinafter set forth in full be submitted to the voters of the
County of san Bernardino at a special election to be held and
conducted on November 3, 1987, said special election to be
consolidated with the other elections to be held on the same

BE IT .FURTHER RESOLVED that:
1. The Registrar of Voters on July 28, 1987 published
notice of a deadline of 5 o'clock p.m. on August 4, 1987 for
submittal of arguments for and against the measure, such
arguments to be submitted in accordance with the terms of the
notice.
2. The polls for the election hereby ordered shall be
opened on the day of the election at 7:00 a.m. and shall be kept
open until 8:00 p.m. on the same day, at which time such polls
shall be closed.
3. The consolidated precincts, polling places, and
election officers serving at such election polls in such
precincts shall be the same, where applicable, as provided for
any other countywide or local elections to be held on November 3,
1987.
4. The Registrar of Voters of the County of San
Bernardino is hereby ordered and directed to provide the election
precincts, polling places and voting booths, together with all
other election supplies for the conduct of such election, for the
elections so consolidated, which in this case shall be the same,

and there shall be only one set of election officers at such
precincts. The Registrar of Voters is further ordered and
directed (1) to set forth on all sample ballots relating to suCh
consolidated elections, to be mailed to the qualified electors of
the County of San Bernardino, such measure hereinabove set forth.

copy of arguments. if any, for and against such measure. and (2)
to provide absent voters ballots for such consolidated elections
therewith, for the use of the qualified electors of the County of

SECTION L SUMMARY. This ordinance provides for the imposition
of a retail transactions and use tax of one-half percent, the'
authority to issue limited tax bonds, the administration of the
tax proceeds, a county. transportation expenditure. plan','an.d. ~he,..

SECTION II. DEFINITIONS~ The

A. Expenditure Plan. "The Expenditure Plan" means the San
Bernardino County Transportation Expenditure Plan (adopted as
part of this Ordinance) including any future amendments
thereto.
B. "County" means the. County.. of San Bernardino.

C. "Commission" means the San Bernardino County Transportation
Commission created pursuant to Section 130054 of the Public
utilities Code.
SECTION III. AUTHORITY. This ordinance is enacted, in part,
pursuant to the provisions of Division 20 (commencing with
Section 190000) and Division 25 (commencing with Section 240000)
to the Public Utilities Code, and Sections 7252.21 and 7252.22 to
the Revenue and Taxation Code.
SECTION IV. IMPOSITION OF RETAIL TRANSACTIONS AND USE TAX. Upon
voter approval of the same, the Commission shall impose, in the
incorporated and unincorporated territory of the County of San
Bernardino, a retail transactions and use tax (referred to as
"the tax") at the rate of one-half of one percent (0.5%) for a
period of fifteen (15) years. The tax shall be in addition to
any other taxes authorized by law, including any existing or
future state or local sales tax or transactions and use tax.
SECTION V. PURPOSES. The purposes for which the tax revenues
may be used shall be for transportation purposes only and may
include, but are not limited to, the administration of this
division, including legal actions related thereto and costs of
the initial preparation and election, the construction, capital
acquisition, maintenance, and operation of streets, roads, and
highways, including state highways. These purposes include
expenditures for planning, environmental reviews, engineering and

o design costs, and relat9 right-of-Wayqcquisition. They also 0
include expenditures including, but not limited to, debt service
on bonds and expenses in connection with issuance of bonds.
SECTION VI. BONDING AUTHORITY. Upon voter approval of the tax,
the Commission shall have the power to sell or issue limited tax
bonds in the aggregate principle at anyone time in the amount
outstanding of $500 million to carry out the transportation
projects described in the Expenditure Plan.
SECTION VII. MAINTENANCE OF EFFORT. Tlie-Commission~ by the
enactment of this Ordinance, intends the additional funds
provided government agencies by this chapter to supplement
existing local revenues being used for street and. highway
purposes. The government agencies shall maintain their existing
commitment of local funds for transportation purposes pursuant to
this Ordinance, and the Commission shall enforce this Sectionby~;.;::>
appropriate actions. .
SECTION VIII. ADMINISTRATION OF PLANS. The Commission shall
impose and collect the tax, shall allocate revenues derived from
the tax, and shall administer the Expenditure Plan attached to
this Ordinance, consistent with the provisions and priorities of
the Expenditure Plan, and consistent with the Authority cited
herein.
SECTION IX. ADMINISTRATIVE COSTS. The Commission shall expend
only that amount of the funds generated from the tax for staff
support, audit, administrative expenses, and contract services
that are necessary and reasonable to carry out its
responsibilities, and in no case shall the funds expended for
salaries and benefits exceed one percent (1%) of the annual
amount of revenue raised by the tax.
SECTION X. ANNUAL APPROPRIATIONS LIMIT. Pursuant to Article
XIIIB of the California Constitution and Public utilities Code
S131108(g), an appropriations limit of $150 million is
established for the Commission for each fiscal year. The
appropriations limit shall be subject to adjustment as provided
by law.
SECTION XI. EFFECTIVE AND OPERATIVE DATES. Subj ect to voter
approval, this ordinance shall take effect immediately at the
close of the polls on November 3, 1987, and shall become
operative on the first day of the first calendar quarter
commencing more than 120 days after adoption of the ordinance.
SECTION XII. ELECTION. The Commission requests the Board of
Supervisors to call an election for voter approval of the
attached proposition (Exhibit A), which election shall be held on
November 3, 1987 and consolidated with other elections to be held
on that same date. The election shall be called and conducted in
the same manner as provided by law for the conduct of elections
by a county. The sample ballot to be mailed to the voters shall
be the full proposition as set forth in this ordinance, and the

BY THE SAN BERNARDINO COUNTY TRANSPORTATION COMMISSION
(ADOPTED AS PART OF ORDINANCE NO. A BY SAID COMMISSION)
Authority. In July 1987 the legislature enacted the San.
Bernardino County Transportation Sales Tax Act (Sections 190000
and 240000 et seq of the Public Utilities Code and. Sections
7252.21 and 7252.22 of the Revenue and Taxation Code) authorizing
the San Bernardino County Transportation Commission to adopt .anSt.:;"~.
Ordinance, containing an Expenditure Plan, placing before the
electors an additional one-half percent sales tax over a 15 year..
period to be used for t~ansportation purposes. The Act required
that the Commission include certain specified determinations in
the Ordinance and Plan.
Distribution of Revenues. The revenues to be derived from the
tax shall be distributed in the following proportions:
1. State highways and freeways
2. City and county streets and roads
3. Major arterial highways
