No.) Acct Description) Finance: Council Notes: 4t- 3 2 II _ CITY OF SAN BERNARDINO—REQUEST FOR COUNCIL ACTION STAFF REPORT Submitted by: City Clerk's Office Council Meeting of June 2,2008 Subject An Ordinance of the City of San Bernardino amending San Bernardino Municipal Code Section 5.20.040 relating to fees for massage parlors and massage technicians operating within established beauty salons. Back rground In response to updating the master fee resolution,the City Clerk's Office is suggesting a fee increase for both the background investigation and examination fee for massage parlors and massage technicians to better reflect the actual costs of these services. At the Ways and Means Committee meeting on May 7,2008,the committee recommended an Ordinance be adopted prior to recommending fee adjustments to reflect stand alone and larger salon type operations. The City Clerk's Office,together with the Police Department who conducts the background investigation, and Civil Service who proctors the examination,have analyzed staff s time in providing these services. Results show an actual cost for the background investigation of$293.00 and$152.00 for the examination fee. At this time we propose the full costs of$293 for stand alone massage parlors and massage technicians working in these establishments and the full examination fee of$152.00 for the examination. We are proposing a lesser amount of$60 for the investigation and$60 for the exam fee for massage technicians operating in established beauty salons holding a current business registration certificate and providing massage services as an incidental or accessory service. Below are shown the current fees and the proposed fees: Stand Alone Massage Parlor Current Proposed Permit Fee-Owner $100 $293 Permit Fee-Technician $ 25 $293 Exam Fee—Owner $ 60 $152 Exam Fee—Technician $25 $152 Beauty Salon—Accessory Service—(Established Salons holdine current business registration) Current Proposed Permit Fee—Technician $25 $60 Exam Fee—Technician $25 $60 Financial Impact Changes to the investigation and examination fees for massage would result in approximately$2,500 in additional revenue. Recommendation That the ordinance be laid over for final adoption. COP3Y I ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUNICIPAL CODE SECTION 5.20.040 RELATING TO FEES FOR 3 MASSAGE PARLORS AND MASSAGE TECHNICIANS OPERATING WITHIN ESTABLISHED BEAUTY SALONS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 5.20.040,subdivisions Band Care hereby amended to read as follows: 7 5.20.040 Permit-Application-Fee 8 B. Massage Parlor-Each application shall be accompanied by a non-refundable investigative fee 9 established by resolution of the Mayor and Common Council for each owner, plus an additional non-refundable fee established by resolution of the Mayor and Common Council 10 for each massage technician. 11 Beauty Salon- Accessory Service-For established beauty salons holding a current business registration certificate and providing massage services as an incidental or accessory service, 12 each application for a massage technician providing massage services shall be accompanied by a non-refundable investigative fee established by resolution of the Mayor and Common 13 Council. 14 C.
