Mayor and Members of the Council,
On Thursday, May 2, 1991, my client, Mr. Hong Wen Yang, attempted to
obtain a building permit in order to make non-structural repairs to his
building located at 668 West 5th St. and to bring the structure into
conformity with the Uniform Building Code. At the direction of the City
Attorney, the Director of Planning and Building Services, Mr. Reed, with-
drew his approval of the issuance of a building permit to Mr. Yong.
We believe that the City Attorney has exceeded and abused his authority.
The City Attorney does not make policy; nor is he the Chief Executive
Officer or the Chief Building Offica!.
It is critical and urgent that Mr. Yang obtain a permit so he may protect
his property, and for the safety and protection of adjacent residents and
structures.
Mr. Yang must also have a permit in order to comply with the Boord of
Building Commissioners Order No. 1458, Report/Project No. 90-3714,
adopted September 7, 1990, which says, in part, "The owner is directed to
obtain permits and to rehabilitate the building in compliance with city
codes prior to any occupancy.". Additionally, Mr. Yang has been cited by
the City for not having a building permit and must respond to this
011 egat ion in court.
Please occept this letter os my client's request to hove the Director of
Plann!ng and Building Services issue a building permit for the repair and
rehobilitation of the building located at _6,~8 West 5th Street ond to hove
this matter ploced on the ogendo of the next city council meeting. q
