STAFF REPORT
Due to the development of the Verdemont area located North of the 1-215 freeway.
it was necessary to obtain an easement for street and highway purposes from the
San Bernardino County Flood Control District to improve Little League Drive and
to construct a box culvert at Cable Creek.
The Flood Control District was reluctant to grant an easement over the land in
question as they must also use the area in the maintenance of their Flood Control
Channel located at Cable Creek. They have therefore offered a Common Use
Agreement which is acceptable to us, and provides us with the authority to do the
necessary work. Federal Bridge Replacement Funds are available to finance 80l of
the cost of this work.
This individual acceptance is necessary as the Common Use Agreement from the
County contains certain conditions and covenants. The document, however, does
not contain any unduly adverse restrictions or reservations. and no appropriation
of money is required. At the bottom of Page 1 of the Co_on Use Agreellent is the
statement "Whereas, the City is the ~ of certain lands...." the reference
here is to City ri2ht of wav on Little League Drive, and not to fee ownership.
The Flood Control District has accepted our self insurance status as evidenced by
the attached letter. and the subject letter has been attached to the agreeaent as
required. Upon execution of the Co_on Use Agreement by the Mayor. the document
will be returned to the Flood Control District for their execution and recording.
It is therefore Staff's recommendation that the Resolution be adopted and the
document(s) be executed.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE ACCEPT-
ANCE AND EXECUTION OF A COMMON USE AGREEMENT WITH THE SAN BERNARDINO COUNTY
FLOOD CONTROL DISTRICT FOR THE CONSTRUCTION OF STREET AND FLOOD CHANNEL
IMPROVEMENTS CONCERNING PROPERTY GENERALLY LOCATED AT THE INTERSECTION OF
LITTLE LEAGUE DRIVE AND THE CABLE CREEK FLOOD CHANNEL.
BE IT RESOLVED BY THE I1AYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of S6II Bernardino is here-
by authorized and directed to execute and accept on behalf of said City. a
Common Use Agreement with the San Bernardino County Flood Control District.
a copy of which is attached hereto and incorporated by reference herein. as
fully as though set forth in length. marked Exhibit "A". for the con-
struction of a box culvert crossing. including curbs. gutters. landscaping
and appurtenances. more particularly described in said Common Use Agreement
and concerning that certain real property in the City of S6II Bernardino.
County of San Bernardino. State of California. generally located at the
intersection of Little League Drive and the Cable Creek Channel. Said City
consents to the recordation thereof.
SECTION 2. The authorization to execute the above-referenced
agree.ent is rescinded if the parties to the agreement fail to execute it
within one hundred twenty (120) days of the pllssage of this resolution.

Dear Mr. Gbaly:
Tbis letter is to inform you tbat tbe City of San Bernardino is
self-insured for tbe first $500,000 of any workers' compensation
claim and maintains an Excess Workers' Compensation Policy,
tbrougb the Big Independent CiUes Excess Pool, for $10,000,000
combined workers' compensation and employer's liability.
. Also, witb respect to general liability coverage, we are self
insured for legal liability up to $1,000,000. A sec.ond
$l,OOO,OOOcoverage is provided by tbe .Big Independent Cities
Excess Pool' (BICEP). An excess policy issued by AIG in tbe'
amount of $8,000,000, brings coverage to tbe $10,000,000 level,
wbere a $15,000,000 umbrella is added by BYCEP to complete
coverage to $25,000,000.
Pursuant to your instructions, tbe following paragrapb is in-
sertedas it relates to Professional Liability coverage:
wInsurance coverage afforded by tbis policy sball also apply
to the liability assumed by tbis Insured under tbis Agreement
witb the County of San Bernardino Flood Control District for
. box culvert maintenance provided such liability results from
an error, omission, or negligence of tbe insured, its
officers,. employees, agents of subcontractors. Allotber
provisions of this policy are to remain uncbanged.-
